S1372|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1372 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO LOCAL LAND USE PLANNING; AMENDING CHAPTER 65, TITLE 67, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 67-6509B, IDAHO CODE, TO PROVIDE 4 THAT A CITY OR COUNTY SHALL NOT ADOPT OR ENFORCE ZONING OR OTHER LAND USE 5 REGULATIONS WHICH DISALLOW PLANS AND SPECIFICATIONS FOR A MANUFACTURED 6 HOUSING COMMUNITY SOLELY BECAUSE THE HOUSING WITHIN THE COMMUNITY WILL BE 7 MANUFACTURED HOUSING AND TO PROVIDE A DEFINITION. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 65, Title 67, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION , to be 11 known and designated as Section 67-6509B, Idaho Code, and to read as follows: 12 67-6509B. MANUFACTURED HOUSING COMMUNITY -- EQUAL TREATMENT REQUIRED. A 13 city or a county shall not adopt or enforce zoning, community development or 14 subdivision regulations or ordinances which disallow the plans and specifica- 15 tions of a manufactured housing community solely because the housing within 16 the community will be manufactured housing. Applications for development of 17 manufactured home communities shall be treated the same as those for site- 18 built homes. For purposes of this section, "manufactured housing community" 19 means any site, lot or tract of land under common ownership upon which ten 20 (10) or more manufactured homes may be sited. The developed community may 21 feature either fee simple land sales or land leased or rented by the 22 homeowner.
STATEMENT OF PURPOSE RS 07443 This legislation will prevent cities or counties from disallowing the plans and specifications of a Manufactured Housing Community solely on the basis that it will consist of manufactured homes.
