                                   SENATE BILL NO. 1378

 1                                        AN ACT
 2    RELATING TO EASTERN IDAHO TECHNICAL COLLEGE; AMENDING SECTION  33-2208,  IDAHO
 3        CODE,  TO PROVIDE CORRECT TERMINOLOGY, TO CLARIFY USE OF ACADEMIC INSTRUC-
 4        TION AND TO MAKE A TECHNICAL CORRECTION; AMENDING SECTION  33-2210,  IDAHO
 5        CODE,  TO  CLARIFY  THAT  INSTRUCTIONAL PROGRAMS HAVE BEEN APPROVED BY THE
 6        STATE BOARD FOR VOCATIONAL EDUCATION AND TO PROVIDE FOR THE GRANTING OF AN
 7        ASSOCIATE DEGREE OF APPLIED SCIENCE; AND AMENDING SECTION  33-2211,  IDAHO
 8        CODE,  TO  PROVIDE FOR THE GRANTING OF AN ASSOCIATE DEGREE OF APPLIED SCI-
 9        ENCE AND TO MAKE A TECHNICAL CORRECTION.

10    Be It Enacted by the Legislature of the State of Idaho:

11        SECTION 1.  That Section 33-2208, Idaho Code, be, and the same  is  hereby
12    amended to read as follows:

13        33-2208.  EASTERN  IDAHO TECHNICAL COLLEGE CREATED. There is hereby estab-
14    lished in Bonneville County, Idaho a   post-secondary  vocational  school
15      postsecondary technical college  to be designated and known
16    as  the  Eastern  Idaho  Technical  College, consisting of such vocational and
17    technical training  programs, including  academic    courses  
18    necessarily included in such programs  as the state board for vocational
19    education may, from time to time authorize.

20        SECTION  2.  That  Section 33-2210, Idaho Code, be, and the same is hereby
21    amended to read as follows:

22        33-2210.   PROGRAMS AND  COURSES OFFERED -- CERTIFICATES  
23    OF  COMPLETION      AND DEGREES . The Eastern Idaho Technical
24    College shall offer and give instruction in  vocational  and  technical  
25    programs  or    courses  as  are usually included in post-secondary
26    vocational schools   approved by the  state  board  for  vocational
27    education . Such courses or programs may be given or conducted on or off
28    campus,  or in night school, summer school, or by extension courses. The state
29    board for vocational education shall grant certificates    of  completion
30        or  associate  of applied science degrees  for successful
31    completion of courses or programs prescribed by the college.

32        SECTION 3.  That Section 33-2211, Idaho Code, be, and the same  is  hereby
33    amended to read as follows:

34        33-2211.  POWERS  OF STATE BOARD FOR VOCATIONAL EDUCATION. The state board
35    for vocational education shall have the power:
36        1.  To adopt rules  and regulations  for its own government and
37    the government of the Eastern Idaho Technical College;
38        2.  To employ professional and nonprofessional persons  and  to  prescribe
39    their qualifications;

 1        3.  To  acquire  and  hold, and to dispose of, real and personal property,
 2    and to construct, repair, remodel and remove buildings;
 3        4.  To contract for the acquisition, purchase or repair of  buildings,  in
 4    the manner prescribed for trustees of school districts;
 5        5.  To  dispose of real and personal property in the manner prescribed for
 6    trustees of school districts;
 7        6.  To convey and transfer real property of  the  college  upon  which  no
 8    buildings used for instruction are situated, to nonprofit corporations, school
 9    districts,  community college housing commissions, counties or municipalities,
10    with or without consideration; to rent real or personal property for  the  use
11    of  the  college, its students or faculty, for such terms as may be determined
12    by the state board for vocational education; and to  lease  real  or  personal
13    property of the college not actually in use for instructional purposes on such
14    terms as may be determined by the state board for vocational education;
15        7.  To acquire, hold, and dispose of, water rights;
16        8.  To accept grants or gifts of money, materials, or property of any kind
17    from  any  governmental  agency,  or from any person, firm, or association, on
18    such terms as may be determined by the grantor;
19        9.  To cooperate with any governmental agency,  or  any  person,  firm  or
20    association  in  the conduct of any educational program; to accept grants from
21    any source for the conduct of such program, and to conduct such program on, or
22    off, campus;
23        10. To employ a superintendent of the college and,  with  his  advice,  to
24    appoint  such  assistants, instructors, specialists and other employees as are
25    required for the operation of the  college;  to  fix  salaries  and  prescribe
26    duties; and to remove the superintendent or any other employee for cause;
27        11. With  the  advice  of the superintendent, to prescribe the courses and
28    programs of study, the requirements for admission, the time and standards  for
29    completion  of  such  courses and programs, and to grant certificates  of
30    completion   or associate of applied  science  degrees    for
31    those students entitled thereto;
32        12. To employ architects or engineers in planning the construction, remod-
33    eling  or  repair of any building or property and, whenever no other agency is
34    designated by law so to do, to let contracts for such construction, remodeling
35    or repair and to supervise the work thereof;
36        13. To have at all times, general supervision and control of all property,
37    real and personal, appertaining to the college, and to insure the same.

Statement of Purpose / Fiscal Impact


    





                           STATEMENT OF PURPOSE

               This legislation is designed to maintain the current 
    status quo at Eastern Idaho Technical College (EITC). A 
    recent Deputy Attorney General's review of the enabling act 
    shows that EITC lacks the statutory authority to teach 
    academic components of the EITC vocational programs and that 
    EITC lacks the authority to award Associate of Applied 
    Science degrees. EITC has been doing both of these for many 
    years (since the late 1980's) with the approval of the State 
    Board of Education sitting as the Board for Vocational 
    Education. The statutes need to be updated.
    
            No new programs or academic courses are contemplated or 
    allowed by these changes nor do these changes grant 
    "community college,' or "junior college" status to EITC. EITC 
    will not have the authority to offer "general" academic 
    courses but only those academic courses necessary and 
    incidental to its vocational/technical programs. The changes 
    are designed to merely maintain the current operations.
