HARRIMAN STATE PARK - Adds to existing law to authorize the Park and
Recreation Board to enter into a lease-purchase or other financing
obligation for the design, construction and equipping of facilities for
public recreational use at Harriman State Park, to appropriate user fee
revenues from the Park Trust Fund for Harriman State Park to pay the
obligation, to provide that the obligation shall not be a debt or
obligation of the state and to prohibit the use of the taxing power of the

 1                                        AN ACT
 2    RELATING TO STATE PARKS; AMENDING CHAPTER 42, TITLE 67,  IDAHO  CODE,  BY  THE
 3        ADDITION  OF A NEW SECTION 67-4229B, IDAHO CODE, TO AUTHORIZE THE PARK AND
 4        RECREATION BOARD TO ENTER INTO A LEASE-PURCHASE OR OTHER FINANCING OBLIGA-
 5        TION FOR THE DESIGN AND CONSTRUCTION AND EQUIPPING OF FACILITIES FOR  PUB-
 6        LIC RECREATIONAL USE WITHIN HARRIMAN STATE PARK, TO PROVIDE THE PURPOSE OF
 7        THE  FACILITIES, TO APPROPRIATE USER FEE REVENUES FROM THE PARK TRUST FUND
 8        FOR HARRIMAN STATE PARK TO PAY THE OBLIGATION, TO PROVIDE THAT THE OBLIGA-
 9        TION SHALL NOT BE A DEBT OR OBLIGATION OF THE STATE AND TO PROHIBIT USE OF
10        THE TAXING POWER OF THE STATE TO PAY THE DEBT OR OBLIGATION; AND DECLARING
11        AN EMERGENCY.

12    Be It Enacted by the Legislature of the State of Idaho:

13        SECTION 1.  That Chapter 42, Title 67, Idaho Code, be,  and  the  same  is
14    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
15    known and designated as Section 67-4229B, Idaho Code, and to read as follows:

16        67-4229B.  HARRIMAN STATE PARK -- FINANCING IMPROVEMENTS.  Notwithstanding
17    any  law  to  the  contrary,  the  board  is authorized to enter into a lease-
18    purchase obligation or other financing obligation, in a principal  amount  not
19    to  exceed five hundred thousand dollars ($500,000), for the design, construc-
20    tion and equipping of facilities for public recreational use  within  Harriman
21    state  park, under terms, conditions and covenants as the board may approve by
22    resolution.  The purpose of the facilities is to provide educational and  rec-
23    reational opportunities for park users while generating revenue to assist with
24    operation of the park. The park trust fund for Harriman state park, or so much
25    of  that fund as may be required in the judgment of the board, is continuously
26    appropriated for the purpose stated in this section.  Any  obligation  entered
27    into shall be payable solely from user fees for the facilities within Harriman
28    state  park  deposited  into  the  park trust fund for Harriman state park and
29    shall not be a debt or obligation of the state. The holder or holders  of  the
30    debt or obligation shall not have the right to compel any exercise of the tax-
31    ing  power  of  the state to pay the debt or obligation or the interest on the
32    debt or obligation.

33        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
34    declared to exist, this act shall be in full force and effect on and after its
35    passage and approval.

    STATEMENT OF PURPOSE

    The purpose of this legislation is to authorize the Parks and Recreation Board to take out a 
    low interest loan to finance the construction of additional public recreational facilities at 
    Harriman State Park. A similar effort was successfully used to finance badly needed new 
    boat docks at Spring Shores Marina last year. Receipts from operation of the facility are 
    used to pay back the loan. Harriman State Park was donated to the state with a trust to 
    assist with its operation. However, in order to meet basic operational needs, the department 
    has had to begin using some of the principal of the trust. Construction of additional facilities 
    at the park will bring in the revenue needed to protect the trust principle and operation the 
    park off trust interest and park revenues.
    
                                FISCAL IMPACT
    
    There may be some impact from this legislation. The department will propose to combine a 
    low interest loan with a Genera I Fund appropriation and park revenues to construct the 
    facility. In this way, payments on the loan will be kept small enough to provide the immediate 
    revenue needed to protect the principal of the Harriman Trust.
