FISH AND GAME COMMISSION - Amends existing law to provide for the
expiration of terms of members of the Fish and Game Commission on June 30
and to provide that for members whose terms will expire in 1999, two
members shall be appointed for a term of three years, with their successors
to be appointed for a term of four years, and two members shall be
appointed for a term of four years.

                                   SENATE BILL NO. 1415

                          BY RESOURCES AND ENVIRONMENT COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE FISH AND GAME COMMISSION; AMENDING SECTION 36-102, IDAHO CODE,
 3        TO PROVIDE FOR THE EXPIRATION OF TERMS ON JUNE 30 AND TO PROVIDE THAT  FOR
 4        MEMBERS  WHOSE  TERMS  WILL EXPIRE IN 1999, TWO MEMBERS SHALL BE APPOINTED
 5        FOR A TERM OF THREE YEARS, WITH THEIR SUCCESSORS TO  BE  APPOINTED  FOR  A
 6        TERM  OF FOUR YEARS, AND TWO MEMBERS SHALL BE APPOINTED FOR A TERM OF FOUR
 7        YEARS.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  Than Section 36-102, Idaho Code, be, and the  same  is  hereby
10    amended to read as follows:

11        36-102.  IDAHO  FISH  AND  GAME  COMMISSION. (a) Creation. There is hereby
12    created the Idaho fish and game commission. The department of fish and game of
13    the state of Idaho is hereby placed under the supervision, management and con-
14    trol of said Idaho fish and game commission, hereinafter referred  to  as  the
15    commission or as said commission.
16        (b)  Membership  --  Appointment  --  Qualifications. The commission shall
17    consist of seven (7) members, to be appointed by the governor of the state  of
18    Idaho,  who  shall  hold  office  during the pleasure of the governor  and who
19    shall be subject to removal by him. The selection and appointment of said mem-
20    bers shall be made solely upon consideration of the welfare and best interests
21    of fish and game in the state of Idaho, and no person  shall  be  appointed  a
22    member  of  said  commission unless he shall be well informed upon, and inter-
23    ested in, the subject of wildlife  conservation  and  restoration.  No  member
24    shall  hold  any other elective or appointive office, state, county or munici-
25    pal, or any office in any political party organization. Not more than four (4)
26    of the members of said commission shall at any time belong to the same politi-
27    cal party. Each of the members of said commission shall be a  citizen  of  the
28    United  States,  and  of  the  state of Idaho, and a bona fide resident of the
29    region from which he is appointed as hereinafter set forth.  Said  members  so
30    appointed  shall  act  and  assume full powers and duties upon appointment, as
31    herein provided, but such appointments shall be subject to confirmation by the
32    senate at its next session.
33        (c)  Creation of Regions  -- Terms of Office . For the  purpose
34    of this act, the state of Idaho is divided into seven (7) regions, which shall
35    be named:
36        (1)  Panhandle  region  to  consist  of  the counties of Boundary, Bonner,
37        Kootenai, Shoshone and Benewah;
38        (2)  Clearwater region to consist of the counties  of  Latah,  Clearwater,
39        Nez Perce, Lewis and Idaho;
40        (3)  Southwestern  region  to  consist  of  the counties of Adams, Valley,
41        Washington, Payette, Gem, Boise, Canyon, Ada, Elmore and Owyhee;
42        (4)  Magic Valley region to consist of  the  counties  of  Camas,  Blaine,
43        Gooding, Lincoln, Minidoka, Jerome, Twin Falls and Cassia;

 1        (5)  Southeastern  region  to  consist  of the counties of Bingham, Power,
 2        Bannock, Caribou, Oneida, Franklin and Bear Lake;
 3        (6)  Upper Snake River region to consist of the counties  of  Clark,  Fre-
 4        mont, Butte, Jefferson, Madison, Teton and Bonneville;
 5        (7)  Salmon region to consist of the counties of Lemhi and Custer.
 6        Each  of  the above enumerated regions shall, at all times, be represented
 7    by  one (1) member of the commission, appointed from said region by the gover-
 8    nor.
 9         (d)  Terms of Office.
10        (1)  Except as provided in paragraph (2) of this subsection, t 
11        T he members of said commission shall be appointed  for  a  term  of
12        four  (4)  years;  provided,  that in the case of the death of any commis-
13        sioner, or his removal from office as hereinbefore provided, the  governor
14        shall  appoint  a  successor  from the same region for the unexpired term.
15         Beginning in 1999 and thereafter, the  term  of  each  member  shall
16        expire  on  June  30.  The term of any member which would otherwise expire
17        prior to June 30 shall be extended to June  30.    No  member  shall
18        serve more than two (2)  consecutive  terms, except that a mem-
19        ber  appointed to fill an unexpired term may be appointed to two (2) addi-
20        tional, full terms. Members serving on the  effective  date  of  this  act
21        shall  be  eligible  to complete the term they are then serving, and shall
22        thereafter be governed by the provisions of this   sub  section
23        limiting the length of any additional terms to four (4) years and the num-
24        ber of  consecutive  terms to two (2).
25          (2)  In appointing successors for the members whose terms expire in
26        1999, the governor shall designate two (2) members to be appointed  for  a
27        term  of three (3) years and two (2) members to be appointed for a term of
28        four (4) years. Successors to the members appointed for a  term  of  three
29        (3)  years  shall  be  appointed  for a term of four (4) years thereafter.

31        ( d  e )  Oath of Office -- Bond. Each  commissioner
32    shall,  before  entering  upon  his official duties, take and subscribe to the
33    official oath, in writing, as provided by section 59-401, Idaho Code, to which
34    said official oath there shall be added a declaration as to the  name  of  the
35    political  party  to  which  such  commissioner belongs, and said commissioner
36    shall be bonded to the state of Idaho in the time, form, and manner prescribed
37    by chapter 8, title 59, Idaho Code.
38        (  e    f  )  Compensation  and  Reimbursement   for
39    Expenses.  Each  member  of the commission shall be compensated as provided by
40    section 59-509(h), Idaho Code. All such compensation  and  expenses  shall  be
41    paid from the fish and game account.
42        (  f    g )  Quorum. A majority of the commissioners
43    shall constitute a quorum for the transaction of any business, for the perfor-
44    mance of any duty, or for the exercise of any power.
45        ( g  h )  Office and Supplies. The commission  shall
46    have  its  principal office in the city of Boise and is authorized to purchase
47    supplies, equipment, printed forms, and notices, and to  issue  such  publica-
48    tions as may be necessary.

                            STATEMENT OF PURPOSE

    The purposed legislation relates to the Fish and Game Commission and will provide 
    for the adjustment of commissioners' terms. In 1999, four terms will expire. To 
    better facilitate the continuity of operation of the Commission, the proposed 
    legislation would provide for two terms to be appointed for three years and their 
    successors would be appointed for four years. The other two terms would be 
    appointed for four years. Therefore, only two commissioners terms would expire at 
    one time. No commissioner shall serve more than two terms.
    
                               FISCAL IMPACT
    
    There would be no fiscal impact to the general fund as the 
    legislation is simply an adjustment of expiration of terms.
