FISH AND GAME ADVISORY COMMITTEE - Amends existing law to provide that
members of the Fish and Game Advisory Committee shall be appointed for
three year terms by the respective directors of the Department of Fish and

                                   SENATE BILL NO. 1416

                          BY RESOURCES AND ENVIRONMENT COMMITTEE

 1                                        AN ACT
 2    RELATING TO FISH AND GAME; AMENDING SECTION 36-122,  IDAHO  CODE,  TO  PROVIDE
 3        THAT  MEMBERS  OF  THE FISH AND GAME ADVISORY COMMITTEE SHALL BE APPOINTED
 4        FOR THREE YEAR TERMS BY THE RESPECTIVE DIRECTORS OF THE DEPARTMENT OF FISH
 5        AND GAME AND THE DEPARTMENT OF AGRICULTURE AND SHALL SERVE AT THE PLEASURE
 6        OF THE DIRECTORS.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Section 36-122, Idaho Code, be, and the  same  is  hereby
 9    amended to read as follows:

10        36-122.  ADVISORY COMMITTEE. (a) There is hereby created the fish and game
11    advisory  committee.  The  committee shall consist of twelve (12) members. Six
12    (6) members of the committee shall be appointed by the director of the depart-
13    ment of fish and game to generally represent wildlife interests. Six (6)  mem-
14    bers  of the committee shall be appointed by the director of the department of
15    agriculture to generally represent agricultural interests. At the beginning of
16    each odd-numbered year, the director of the department  of  agriculture  shall
17    appoint  a chairman from among his appointees, and the director of the depart-
18    ment of fish and game shall appoint a vice-chairman from among his appointees.
19    At the beginning of each even-numbered year, the director of the department of
20    fish and game shall appoint a chairman from  among  his  appointees,  and  the
21    director  of  the department of agriculture shall appoint a vice-chairman from
22    among his appointees. The committee shall meet at such times  as  appropriate,
23    but not less frequently than annually.
24        (b)    Commencing July 1, 1994, two (2) of the members of the commit-
25    tee appointed by the director of the department of agriculture and two (2)  of
26    the members appointed by the director of the department of fish and game shall
27    serve  one (1) year terms, two (2) of the members appointed by the director of
28    the department of agriculture and two (2) of  the  members  appointed  by  the
29    director of the department of fish and game shall serve two (2) year terms and
30    two (2) of the members appointed by the director of the department of agricul-
31    ture and two (2) of the members appointed by the director of the department of
32    fish  and  game  shall  serve  three (3) year terms. Thereafter a  
33     A ll members shall  be appointed to  serve  three
34    (3)  year  terms.  Appointments to fill vacancies  shall be for the balance of
35    the unexpired term.  A member may serve  seven (7) consecutive  years  or
36    two  (2)  consecutive terms, whichever is less.  All members shall 
37    be appointed by and  serve at the pleasure of the  respective  directors
38    of  the  department of agriculture or the department of fish and game. Members
39    shall be compensated as provided in section 59-509(b), Idaho  Code,  and  such
40    expenses shall be paid from the big game primary depredation account.
41        (c)  The  department  of  fish and game shall provide staff assistance and
42    support for the committee.
43        (d)  The committee shall have the authority to:

 1        1.  Act as a liaison between the commission, landowners, the department of
 2        agriculture, the department of fish and game, and wildlife, outdoor recre-
 3        ation and sportsmen's organizations;
 4        2.  Act as an independent resource to give advice and  recommendations  on
 5        administration of the programs authorized in sections 36-1108 and 36-1109,
 6        Idaho Code.

                               STATEMENT OF PURPOSE
                                     RS 07473
    
    The purpose of this legislation is to delete the current limit 
    on length of service for Fish & Game Advisory members. This to be 
    replaced with a provision that all members shall be appointed by and 
    serve at the pleasure of the respective directors of department of 
    agriculture or department of fish and game; it further repeals 
    outdated and unneeded language.
