S1421|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1421, As Amended BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO CLOSURES OF PUBLIC LANDS, HIGHWAYS, ROADS OR PATHS; AMENDING CHAP- 3 TER 23, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-2347A, 4 IDAHO CODE, TO REQUIRE PUBLIC COMMENTS PRIOR TO CLOSURES OF PUBLIC LANDS, 5 HIGHWAYS, ROADS OR ROADWAYS BY THE DEPARTMENT OF FISH AND GAME OR THE 6 DEPARTMENT OF LANDS UNDER CERTAIN CIRCUMSTANCES. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 23, Title 67, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION , to be 10 known and designated as Section 67-2347A, Idaho Code, and to read as follows: 11 67-2347A. CLOSURES OF CERTAIN STATE LANDS -- PUBLIC HEARING. Whenever the 12 Idaho department of lands or the department of fish and game is proposing to 13 close all or a portion of public land, a highway, road or other roadway which 14 has previously been open to public motor vehicle access or travel, it shall 15 first hold a public comment meeting in the county where the proposed closure 16 is to take place before it may take action. The entity shall place a legal 17 notice in a newspaper of countywide circulation in compliance with section 18 60-109, Idaho Code, advertising the proposed closure, the duration of the pro- 19 posed closure, the place of the public comment meeting and the reason(s) for 20 the proposed closure and any agencies, entities or groups who have proposed 21 that the piece of public land, highway, road or roadway be closed. Addition- 22 ally, the department of fish and game or the department of lands shall issue a 23 press release publicizing the public comment meeting and distribute it to 24 television stations, radio stations and other electronic disseminators of 25 information to get notice to the public.

The closure of highways, roads or lands that have
historically been open is a serious matter that impacts the
public directly and sometimes dramatically.
This legislation would ensure that the public has prior
knowledge of proposed closures and the opportunity to give
input by requiring the Department of Fish & Game and the
Department of Lands to hold public hearings prior to closures.
FISCAL NOTE
The fiscal impact would be minimal. An estimated $5000 might
be needed for publicizing and holding hearings, divided
between the two agencies.
