S1438|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1438 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO SCHOOL DISTRICT'S SALARY-BASED APPORTIONMENT; AMENDING SECTION 3 33-1004, IDAHO CODE, TO PROVIDE A STAFF ALLOWANCE FOR SUPERVISORY AND PRO- 4 FESSIONAL CLASSIFIED STAFF AND A STAFF ALLOWANCE FOR NONSUPERVISORY AND 5 NONPROFESSIONAL CLASSIFIED STAFF; AND AMENDING SECTION 33-1004E, IDAHO 6 CODE, TO INCLUDE APPORTIONMENT FOR SUPERVISORY AND PROFESSIONAL CLASSIFIED 7 STAFF AND FOR NONSUPERVISORY AND NONPROFESSIONAL CLASSIFIED STAFF IN 8 DETERMINING A DISTRICT'S SALARY-BASED APPORTIONMENT. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 33-1004, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 33-1004. STAFF ALLOWANCE. For each school district, a staff allowance 13 shall be determined as follows: 14 1. Using the daily attendance reports that have been submitted for com- 15 puting the February 15th apportionment of state funds as provided in section 16 33-1009, Idaho Code, determine the total support units for the district in the 17 manner provided in section 33-1002 8.b., Idaho Code; 18 2. Determine the instructional staff allowance by multiplying the support 19 units by 1.1. A district must demonstrate that it actually employs the number 20 of certificated instructional staff allowed. If the district does not employ 21 the number allowed, the staff allowance shall be reduced to the actual number 22 employed; 23 3. Determine the administrative staff allowance by multiplying the sup- 24 port units by .075. A district must demonstrate that it actually employs the 25 number of certificated administrative staff allowed. If the district does not 26 employ the number allowed, the staff allowance shall be reduced to the actual 27 number employed, except that not more than twenty percent (20%) of the admin- 28 istrative staff allowance may be noncertificated staff; 29 4. Determine the supervisory and professional classified 30 staff allowance by multiplying the support units by.37531 .078; 32 5. Determine the nonsupervisory and nonprofessional classified 33 staff by multiplying the support units by .297 . 3456 . Additional conditions governing staff 35 allowance: 36 a. In determining the number of staff in subsections 2., 3. , 37and4. and 5. of this section, a district may 38 contract separately for services to be rendered by nondistrict employees 39 and such employees may be counted in the staff allowance. A "nondistrict 40 employee" means a person for whom the school district does not pay the 41 employer's obligations for employee benefits. When a district contracts 42 for the services of a nondistrict employee, only the salary portion of the 43 contract shall be allowable for computations. 2 1 b. If there are circumstances preventing eligible use of staff allowance 2 to which a district is entitled as provided in subsections 2. and 3. of 3 this section, an appeal may be filed with the state department of educa- 4 tion outlining the reasons and proposed alternative use of these funds, 5 and a waiver may be granted. 6 c. For any district with less than forty (40) support units: 7 (1) The instructional staff allowance shall be calculated applying 8 the actual number of support units. If the actual instructional 9 staff employed in the 1994-95 school year is greater than the 10 instructional staff allowance, then the instructional staff allowance 11 shall be increased by one-half (1/2) staff allowance; and 12 (2) The administrative staff allowance shall be calculated applying 13 the actual number of support units. If the actual administrative 14 staff employed in the 1994-95 school year is greater than the admin- 15 istrative staff allowance, then the administrative staff allowance 16 shall be increased by one-half (1/2) staff allowance. 17 (3) Additionally, for any district with less than twenty (20) sup- 18 port units, the instructional staff allowance shall be calculated 19 applying the actual number of support units. If the number of 20 instructional staff employed in the 1994-95 school year is greater 21 than the instructional staff allowance, the staff allowance shall be 22 increased as provided in paragraphs (1) and (2) of this subsection, 23 and by an additional one-half (1/2) instructional staff allowance. 24 d. Only instructional, administrative and classified personnel compen- 25 sated by the school district from the general maintenance and operation 26 fund of the district shall be included in the calculation of staff allow- 27 ance or in any other calculations based upon staff, including determina- 28 tion of the experience and education multiplier, the reporting require- 29 ments, or the district's salary-based apportionment calculation. No food 30 service staff or transportation staff shall be included in the staff 31 allowance. 3267 . In the event that the staff allowance in 33 any category is insufficient to meet accreditation standards, a district may 34 appeal to the state board of education, demonstrating the insufficiency, and 35 the state board may grant a waiver authorizing sufficient additional staff to 36 be included within the staff allowance to meet accreditation standards. Such a 37 waiver shall be limited to one (1) year, but may be renewed upon showing of 38 continuing justification. 39 SECTION 2. That Section 33-1004E, Idaho Code, be, and the same is hereby 40 amended to read as follows: 41 33-1004E. DISTRICT'S SALARY-BASED APPORTIONMENT. Each district shall be 42 entitled to a salary-based apportionment calculated as provided in this sec- 43 tion. 44 1. To determine the apportionment for instructional staff, first deter- 45 mine the district average experience and education index by placing all eligi- 46 ble district certificated instructional employees on the statewide index pro- 47 vided in section 33-1004A, Idaho Code. The resulting average is the district 48 index. Districts with an index above the state average index shall receive 49 their actual index but not more than the state averageplus.0350 plus .03 for the 1994-95 school year, and shall receive their 51 actual index but not more than the state averageplus.0652 plus .06 for the 1995-96 school year, and thereafter shall receive 53 their actual district index. The district instructional staff index shall be 3 1 multiplied by the instructional base salary of $19,715. The amount so deter- 2 mined shall be multiplied by the district staff allowance for instructional 3 staff determined as provided in section 33-1004 2., Idaho Code. The resulting 4 amount is the district's salary-based apportionment for instructional staff. 5 2. To determine the apportionment for district administrative staff, 6 first determine the district average experience and education index by placing 7 all eligible certificated administrative employees on the statewide index pro- 8 vided in section 33-1004A, Idaho Code. The resulting average is the district 9 index. Districts with an index above the state average index shall receive 10 their actual index but not more than the state averageplus.0311 plus .03 for the school year 1994-95, and shall receive their 12 actual index but not more than the state average indexplus.0613 plus .06 school year, and thereafter shall receive their actual 14 district index. The district administrative staff index shall be multiplied by 15 the base salary of $28,843. The amount so determined shall be multiplied by 16 the district staff allowance for administrative staff determined as provided 17 in section 33-1004 3., Idaho Code. The resulting amount is the district's 18 salary-based apportionment for administrative staff. 19 3. To determine the apportionment for supervisory and professional 20 classified staff, multiply $17,848 by the district supervisory and profes- 21 sional staff allowance determined as provided in section 33-1004 4., Idaho 22 Code. The amount so determined is the district's apportionment for supervisory 23 and professional classified staff. 24 4. To determine the apportionment for nonsupervisory and 25 nonprofessional classified staff, multiply $15,300 by the district 26 nonsupervisory and nonprofessional classified staff allowance 27 determined as provided in section 33-100445 ., Idaho 28 Code. The amount so determined is the district's apportionment for 29 nonsupervisory and nonprofessional classified staff. 3045 . The district's salary-based apportionment 31 shall be the sum of the apportionments calculated in subsections 1., 2. , 32and3.,and 4. of this section, 33 plus the benefit apportionment as provided in section 33-1004F, Idaho Code. 34 6. For purposes of the apportionments calculated under this sec- 35 tion, the following definitions shall be determined by the state department of 36 education: "district administrative staff," "instructional staff," 37 "nonsupervisory and nonprofessional classified staff," and "supervisory and 38 professional classified staff."
STATEMENT OF PURPOSE RS7972 The purpose of this legislation is to establish a new category and appropriate formula and salary adjustments in Idaho Code 33-1004, "Salary Allowance" and 33-1004E, "District Salary Based Apportionment." Currently staff allowance formulas exist for the categories of "instructional staff," "administrative staff," and "classified staff." This legislation would add a fourth classification—"supervisory and professional classified staff." It would also establish a ratio and salary allocation amount for this new category and adjust the current ratio for the category of "classified staff." FISCAL IMPACT While there will be no additional cost to any unit of government by the enactment of this legislation, the annual appropriation for public schools will require an additional amount be dedicated to the salary allocation formula, thereby reducing the total amount which will be available for other categorical or discretionary expenditures. Based on the information available from the 1996-1997 school year, the additional amount which would have been designated for the salary allocation formula is approximately $2.5 million.
