                                   SENATE BILL NO. 1460

                        BY COMMERCE AND HUMAN RESOURCES COMMITTEE

 1                                        AN ACT
 2    RELATING TO INSURANCE; AMENDING SECTION 41-1032, IDAHO CODE, TO PROVIDE A LIM-
 3        ITED EXCEPTION FROM LICENSING REQUIREMENTS FOR MOTOR VEHICLE RENTAL COMPA-
 4        NIES.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 41-1032, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        41-1032.  EXCEPTIONS TO LICENSE REQUIREMENT. Sections 41-1030 and 41-1031,
 9    Idaho Code, shall not apply as to:
10        (1)  Salaried home office or branch office employees of insurers, or sala-
11    ried employees in the offices of managing general agents, who perform adminis-
12    trative,  clerical,  or  technical services in such offices and do not solicit
13    insurance business from insureds or prospective insureds.
14        (2)  The regular salaried employee in the office of a general lines  agent
15    or  general  lines  broker,  which  employee devotes full time to clerical and
16    administrative services, with incidental taking of insurance applications  and
17    receiving  premiums in the office of the agent or broker, if the employee does
18    not receive any commissions on such applications and his compensation  is  not
19    varied by the volume of such applications, insurance or premiums; or the regu-
20    lar  salaried  employee  in the office of the life or disability agent or life
21    broker, and who does not solicit or accept from the  public  applications  for
22    life insurance, disability insurance, or annuity contracts.
23        (3)  Service representatives, i.e. officers and traveling representatives,
24    compensated  by  salary  only,  of insurers or of managing general agents, who
25    work with or through resident agents or brokers in the solicitation,  negotia-
26    tion, or effectuation of insurance or annuity contracts.
27        (4)  Officers  and regular representatives, compensated by salary only, of
28    special lines insurers which do not solicit insurance from the general  public
29    and  do  not  use  resident  agents generally in the solicitation of insurance
30    business.
31        (5)  Officers and regular salaried representatives of domestic  reciprocal
32    insurers  writing only workmen's compensation coverages for employers commonly
33    known as self-insurers.
34        (6)  A person who, in the performance of ministerial duties,  secures  and
35    forwards  information for the purpose of group insurance or group annuity cov-
36    erage or for enrolling individuals under such group coverages or issuing  cer-
37    tificates thereunder, where no commission is paid for such services.
38          (7)  A  person  who, concurrent with the rental of a motor vehicle,
39    provides contract options to the standard rental agreement which provide  auto
40    and  travel  related  coverages  through  authorized  insurers during a rental
41    period not to exceed ninety (90) days.

                            STATEMENT OF PURPOSE
                                  RS 08030
    
    This legislation relates to optional insurance products offered as part of a short-term rental of motor 
    vehicles. The legislation excludes these transactions from the licensing requirements of the Idaho Insurance 
    Code if the rental period does not exceed ninety (90) days, the products are products of authorized insurers, 
    and the options are provided concurrently with the rental of a motor vehicle. The people currently engaged 
    in transactions covered by this legislation are not now licensed.
    
    FISCAL NOTE
    
    This legislation will not have an impact on state or local funds.
