That Chapter 3, Title 40, Idaho Code, be, and the same is 30 hereby amended by the addition thereto of a NEW SECTION , to be 31 known and designated as Section 40-322, Idaho Code, and to read as follows: 32 40-322. SPECIFIED HIGHWAY CONSTRUCTION PROJECTS. (1) Under the direction 33 of the Idaho transportation board which has responsibility for oversight of 34 all projects pursuant to this section, the Idaho transportation department is 35 authorized and directed to undertake and complete the projects in the order of 36 priority as listed in subsection (3) of this section. The established priority 37 as listed herein does not preclude the department from simultaneously proceed- 38 ing with portions of each project as necessary to acquire rights-of-way and to 39 prepare engineering and environmental impact analyses, provided adequate funds 40 are anticipated to be available for completion of the projects. 41 (2) Projects listed herein shall be described by Idaho transportation 42 department key number, highway number, project name and by type of work. For 43 the purposes of this section, highway construction projects shall be limited 2 1 to state highways 20, 30, 55, 93 and 95 and interstate interchanges deemed 2 critical to the state highway system. 3 (3) Specified highway construction projects in the order of priority are: 4 KEY 5 NO. That Chapter 7, Title 40, Idaho Code, be, and the same is 48 hereby amended by the addition thereto of a NEW SECTION , to be 49 known and designated as Section 40-701B, Idaho Code, and to read as follows: 50 40-701B. SPECIFIED HIGHWAY PROJECTS CONSTRUCTION FUND. (1) There is 51 established in the state treasury the "Specified Highway Projects Construction 52 Fund" hereafter referred to as the specified projects fund, to which shall be 53 credited: 3 1 (a) Moneys as provided by sections 49-402 and 49-434, Idaho Code; and 2 (b) All other moneys as may be provided by law; and 3 (c) Interest earned on the investment of idle moneys in the specified 4 projects fund shall be paid to the specified projects fund. 5 (2) Moneys distributed from the fund shall be used exclusively on the 6 projects listed in section 40-322, Idaho Code, for construction of major proj- 7 ects for which other funding is not generally available. 8 (3) On or before January 15 of each year, the Idaho transportation 9 department shall submit a report to the germane transportation committees of 10 the legislature describing progress on specified construction projects, the 11 proposed time frame for completion of the projects, an accounting of the 12 moneys distributed to the department for the projects, and recommendations for 13 adjustments to the list in section 40-322, Idaho Code. 14 SECTION 3. That Section 49-402, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 17 truck and each other motor vehicle having a maximum gross weight not in 18 excess of eight thousand (8,000) pounds, designed for the purpose of carrying 19 passengers and not used for hire shall be: 20 Vehicles one (1) and two (2) years old .$4896 .00 21 Of the registration fees collected for vehicles one (1) and two (2) years 22 old, $36.4800 shall be deposited to the highway 23 distribution account and $11.5260.00 shall be 24 deposited to therestricted highwayspecified projects 25 fund. 26 Vehicles three (3) and four (4) years old ........$3678 27 .00 28 Of the registration fees collected for vehicles three (3) and four (4) 29 years old, $33.4834.00 shall be deposited to the 30 highway distribution account and $2.5244.00 31 shall be deposited to therestricted highwayspecified 32 projects fund. 33 Vehicles five (5) and six (6) years old .$36 0 .00 34 Of the registration fees collected for vehicles five (5) and six (6) years 35 old, $26.2800 shall be deposited to the highway 36 distribution account and $9.7234.00 shall be 37 deposited to therestricted highwayspecified projects 38 fund. 39 Vehicles seven (7) and eight (8) years old ........$24 2 40 .00 41 Of the registration fees collected for vehicles seven (7) and eight (8) 42 years old, $22.6823.00 shall be deposited to the 43 highway distribution account and $1 9 .3200 44 shall be deposited to therestricted highway45 specified projects fund. 46 Vehicles over eight (8) years old ..................................$24.00 47 Of the registration fees collected for vehicles over eight (8) years old, 48 $16.080 shall be deposited to the highway dis- 49 tribution account and $7.928.00 shall be depos- 50 ited to therestricted highwayspecified projects 51 fund. 52 There shall be twelve (12) registration periods, starting in January for 53 holders of validation registration stickers numbered 1, and proceeding consec- 4 1 utively through December for holders of validation registration stickers num- 2 bered 12, each of which shall start on the first day of a calendar month and 3 end on the last day of the twelfth month from the first day of the beginning 4 month. Registration periods shall expire midnight on the last day of the reg- 5 istration period in the year designated by the validation registration 6 sticker. The numeral digit on the validation registration stickers shall, as 7 does the registration card, fix the registration period under the staggered 8 plate system of Idaho for the purpose of reregistration and notice of expira- 9 tion. 10 A vehicle that has once been registered for any of the above designated 11 periods shall, upon reregistration, be registered for the period bearing the 12 same number, and the registration card shall show and be the exclusive proof 13 of the expiration date of registration and licensing. Vehicles may be ini- 14 tially registered for less than a twelve (12) month period, or for more than a 15 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 16 tional registration tends to fulfill the purpose of the monthly series regis- 17 tration system. 18 (2) For all motor vehicles equipped to carry passengers and operated pri- 19 marily for hire exclusively within the limits of an incorporated city and 20 adjacent thereto, when the service outside the city is a part of a regular 21 service rendered inside the city, and for school buses operated either by a 22 nonprofit, nonpublic school or operated pursuant to a service contract with a 23 school district for transporting children to or from school or in connection 24 with school approved activities, the annual fee shall be twelve dollars and 25 forty-eight cents ($12.48). 26 (3) For all hearses, ambulances and wreckers the annual fee shall be 27 twenty-nine dollars and forty cents ($29.40), and these vehicles shall bear 28 passenger car plates. No operator of a hearse, ambulance, or wrecker shall be 29 entitled to operate them by virtue of any dealer's license that may have been 30 issued under the provisions of this chapter. 31 (4) For all motorcycles and all-terrain vehicles the annual fee shall be 32 nine dollars ($9.00). For operation of an ATV off the public highways, the fee 33 specified in section 67-7122, Idaho Code, shall also be paid. 34 (5) For all motor homes the fee shall be as specified in subsection (1) 35 of this section and shall be in addition to the fees provided for in section 36 49-445, Idaho Code. 37 (6) Registration fees shall not be subject to refund. 38 (7) A financial institution or repossession service contracted to a 39 financial institution repossessing vehicles under the terms of a security 40 agreement shall move the vehicle from the place of repossession to the finan- 41 cial institution's place of business on a repossession plate. The repossession 42 plate shall also be used for demonstrating the vehicle to a prospective pur- 43 chaser for a period not to exceed ninety-six (96) hours. The registration fees 44 for repossession plates shall be as required in subsection (1) of this section 45 for a vehicle one (1) and two (2) years old. All other fees required under 46 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 47 The repossession plate shall be issued on an annual basis by the department. 48 (8) In addition to the annual registration fee in this section, there 49 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 50 program fee of fifteen dollars ($15.00) for all special license plate programs 51 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 52 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 53 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 54 program fee of twenty-five dollars ($25.00) but there shall be no annual 55 renewal fee. For special plates issued pursuant to sections 49-417 and 5 1 49-417A, Idaho Code, there shall be an initial program fee of thirty-five dol- 2 lars ($35.00) and an annual program fee of twenty-five dollars ($25.00). The 3 fees contained in this subsection shall be applicable to all new special plate 4 programs. The initial program fee and the annual program fee shall be depos- 5 ited in the state highway account and shall be used to fund the cost of admin- 6 istration of special license plate programs which are provided to the public 7 as a personal alternative to the standard license plate requirements. 8 SECTION 4. That Section 49-402, Idaho Code, be, and the same is hereby 9 repealed. 10 SECTION 5. That Chapter 4, Title 49, Idaho Code, be, and the same is 11 hereby amended by the addition thereto of a NEW SECTION , to be 12 known and designated as Section 49-402, Idaho Code, and to read as follows: 13 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 14 truck and each other motor vehicle having a maximum gross weight not in excess 15 of eight thousand (8,000) pounds, designed for the purpose of carrying passen- 16 gers and not used for hire shall be: 17 Vehicles one (1) and two (2) years old .............................$48.00 18 Of the registration fees collected for vehicles one (1) and two (2) years 19 old, $36.48 shall be deposited to the highway distribution account and 20 $11.52 shall be deposited to the restricted highway fund. 21 Vehicles three (3) and four (4) years old ..........................$36.00 22 Of the registration fees collected for vehicles three (3) and four (4) 23 years old, $33.48 shall be deposited to the highway distribution account 24 and $2.52 shall be deposited to the restricted highway fund. 25 Vehicles five (5) and six (6) years old ............................$36.00 26 Of the registration fees collected for vehicles five (5) and six (6) years 27 old, $26.28 shall be deposited to the highway distribution account and 28 $9.72 shall be deposited to the restricted highway fund. 29 Vehicles seven (7) and eight (8) years old .........................$24.00 30 Of the registration fees collected for vehicles seven (7) and eight (8) 31 years old, $22.68 shall be deposited to the highway distribution account 32 and $1.32 shall be deposited to the restricted highway fund. 33 Vehicles over eight (8) years old ..................................$24.00 34 Of the registration fees collected for vehicles over eight (8) years old, 35 $16.08 shall be deposited to the highway distribution account and $7.92 36 shall be deposited to the restricted highway fund. 37 There shall be twelve (12) registration periods, starting in January for 38 holders of validation registration stickers numbered 1, and proceeding consec- 39 utively through December for holders of validation registration stickers num- 40 bered 12, each of which shall start on the first day of a calendar month and 41 end on the last day of the twelfth month from the first day of the beginning 42 month. As an option to the trailer and semitrailer annual registra- 39 tion, the department may provide extended registration. 40 (a) The optional extended-registration period shall not extend beyond 41 seven (7) years. 42 (b) The fee shall be fifteen dollars ($15.00) for each year. 43 (c) The license plate originally issued shall remain on the trailer or 44 semitrailer until the registration expires. 45 (d) If the ownership of a trailer or semitrailer changes during the 46 extended-registration period, the original owner may transfer the plate to 47 another vehicle. The remaining fee shall be credited against the cost of 48 the new registration. No refunds shall be given for any unexpired portion 49 of the trailer or semitrailer registration fee if the plate is not trans- 50 ferred by the owner to another trailer. An extended plate shall not be 51 transferred to another owner when the ownership of a trailer or semi- 52 trailer changes. 53 (e) A sticker validating the extended registration shall be affixed to 54 the license plate. The owner shall obtain a replacement plate, validation 55 sticker and a registration document from the department when a plate is 8 1 lost, destroyed or illegible. 2 (4) An annual registration fee of eight dollars ($8.00) shall be required 3 for each rental utility trailer having a maximum laden or gross weight of up 4 to two thousand (2,000) pounds, or fifteen dollars ($15.00) for each rental 5 utility trailer having a maximum laden or gross weight in excess of two thou- 6 sand (2,000) pounds. 7 (a) For a fee of eight dollars ($8.00) or fifteen dollars ($15.00) per 8 year, as applicable, for each rental utility trailer, the department may 9 issue a rental utility trailer license plate that shall remain valid for a 10 period of five (5) years. 11 (b) The license plate shall become void if the owner's interest in the 12 rental utility trailer changes during the five (5) year period. 13 (c) If the owner fails to enter the rental utility trailer on the annual 14 renewal application during the five (5) year period, the registration 15 record shall be purged. Any unrenewed, unexpired plate shall be returned 16 to the department if it is not entered on the renewal application. 17 (5) An administrative fee of four dollars ($4.00) shall be paid and 18 deposited to the state highway account on all registrations completed by the 19 department under this section. 20 (6) In addition to the registration and license fees provided by subsec- 21 tions (1) and (2) of this section, there shall be paid on all commercial vehi- 22 cles having a maximum gross weight in excess of sixty thousand (60,000) 23 pounds, a use fee based upon the registered maximum gross weight in accordance 24 with the following schedule. The 54 owner shall declare a maximum gross weight for each configuration being oper- 55 ated but not more than three (3) maximum gross weights for a vehicle combina- 10 1 tion may be declared. Any owner who receives authority to report and pay use 2 fees at multiple maximum gross weights shall register the motor vehicle in a 3 combination at the highest maximum gross weight of the vehicle. Any owner who 4 reports vehicle combinations at multiple weights and fails to maintain records 5 and furnish said records to the department upon request which show the config- 6 uration of the combination of vehicles and the trailer and unit number for all 7 miles and trip segments traveled shall have all miles assessed at the highest 8 maximum gross weight of the combination of vehicles. 9 (11) An applicant for registration of a commercial vehicle, a noncommer- 10 cial vehicle or a farm vehicle shall set forth the maximum gross weight of the 11 vehicle or combination of vehicles and the applicant shall pay any annual reg- 12 istration fees and any annual license fees on trailers and semitrailers 13 required at the time he makes application for registration subject to the pro- 14 visions of subsections (1) and (2) of this section. No part of the registra- 15 tion or license fees shall be subject to refund. The use fee payment required 16 shall be computed according to the schedule in either subsection (6) or (7) of 17 this section on the mileage operated over the highways of the state of Idaho 18 and the owner of any vehicle against which a use fee is assessed, shall at the 19 time of making his next quarterly report pay the use fee, if any, for the 20 three (3) calendar months immediately prior. In determining the mileage sub- 21 ject to the use fee, there shall be deducted the miles traveled on roadways 22 maintained with private funds by agreement with the public agency or agencies 23 having jurisdiction over them. In no event shall the total money credited to 24 the owner for the mileage exceed the actual cost of maintenance expended by 25 him. 26 (12) Any owner who operates or intends to operate non-Idaho based vehicles 27 in Idaho that are subject to the use fee required under the provisions of 28 this section shall apply for a use fee account before operating the vehicles 29 in Idaho. In lieu of establishing a use fee account the owner may purchase a 30 trip permit under the provisions of section 49-432 or 49-433, Idaho Code, as 31 applicable. The department shall develop rules to administer the use fee 32 account. Any owner who has not established a use fee account or has not pur- 33 chased a trip permit prior to operating in Idaho shall have committed an 34 infraction. 35 SECTION 7. That Section 49-434, Idaho Code, be, and the same is hereby 36 repealed. 37 SECTION 8. That Chapter 4, Title 49, Idaho Code, be, and the same is 38 hereby amended by the addition thereto of a NEW SECTION , to be 39 known and designated as Section 49-434, Idaho Code, and to read as follows: 40 49-434. Sections 1, 2, 3 and 6 of this act shall be in full force and 5 effect when and if those sections are enacted by the First Regular Session of 6 the Fifty-fifth Idaho Legislature. 7 SECTION 10. Sections 4, 5, 7 and 8 of this act shall be in full force and 8 effect on and after January 1, 2011. 9 SECTION 11. The Legislature finds and declares that the issue of highway 10 construction projects is of importance to the citizens of the state of Idaho. 11 As a representative body, members of the Legislature desire to be responsive 12 and responsible to these citizens. For this reason, the Legislature herewith 13 submits an advisory ballot to the electors of the state of Idaho, and the 14 results will guide the First Regular Session of the Fifty-fifth Idaho Legisla- 15 ture in 1999 as to whether the provisions of Senate Bill No. 1467, As Amended, 16 As Amended, of the 1998 Legislative Session, providing for increased motor 17 vehicle registration fees for a twelve-year period with the proceeds to be 18 distributed to the Specified Highway Projects Construction Fund which will be 19 used to finance highway construction projects on State Highway 55, U.S. High- 20 ways 20, 30, 93 and 95 and Interstate Highway No. 84 should be enacted. 21 At the election to be held on November 3, 1998, the question provided 22 herein shall be placed on the ballot as an advisory vote. The Secretary of 23 State and the Attorney General shall perform the duties as prescribed for an 24 initiative in Chapter 18, Title 34, Idaho Code. The question shall be as fol- 25 lows: 26 "Shall the provisions of Senate Bill No. 1467, As Amended, As 27 Amended, of the 1998 Legislative Session, which provides for an increase 28 in motor vehicle registration fees for a twelve-year period with the pro- 29 ceeds to be distributed to the Specified Highway Projects Construction 30 Fund which will be used to finance highway construction projects on State 31 Highway 55, U.S. Highways 20, 30, 93 and 95 and Interstate Highway No. 84 32 be enacted?". 33 The advisory question provided for in this act is hereby declared to be a 34 "measure" for the purposes of Chapter 66, Title 67, Idaho Code, and the provi- 35 sions of Chapter 66, Title 67, Idaho Code, shall apply thereto.
STATEMENT OF PURPOSE RS08045Cl The purpose of this Legislation is to place on the November 3, 1998, General Election Ballot an advisory question regarding a proposal to address 28 Idaho Transportation Department highway construction projects which are currently unfunded, and for which the ITD has no well defined plan for completion. ITD creates a "Five Year Program" or schedule, and it also creates a project list of major unfunded projects. The 28 projects listed represent the majority of the significant unscheduled projects on highways 20, 30, 55, 93, and 95. Completion of these, as well as programmed projects, will significantly enhance statewide access, help to lower highway fatality rates, and insure economic vitality of this state. SECTION 1 - Creates a "specified highway construction project list" composed of major projects which have no anticipated funding by ITD. SECTION 2 - Creates a "specified highway projects construction fund" which is a new account restricted to the projects listed in section 1. SECTION 3 - Raises annual registration fees only on 1991 or newer vehicles under 8,000 GVW and restores five registration levels; additional fees are directed to the Specified Highway Fund.
