                             SENATE BILL NO. 1490, As Amended

 1                                        AN ACT
 2    RELATING TO SPECIAL APPLICATIONS OF THE SCHOOL FUNDING PROGRAM; AMENDING CHAP-
 3        TER 10, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW  SECTION  33-1003C,
 4        IDAHO  CODE,  TO  PROVIDE A SPECIAL APPLICATION FOR CALCULATION OF AVERAGE
 5        DAILY ATTENDANCE FOR ACQUISITION AND MAINTENANCE OF TECHNOLOGY INSTRUCTION
 6        PROGRAMS.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Chapter 10, Title 33, Idaho Code, be,  and  the  same  is
 9    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
10    known and designated as Section 33-1003C, Idaho Code, and to read as follows:

11        33-1003C.  SPECIAL  APPLICATION  --  TECHNOLOGICAL  INSTRUCTION.  For  the
12    school years 1998-99 and 1999-2000, in order to acquire and maintain  technol-
13    ogy  for  individualized  computer and/or distance learning programs, a school
14    district may use student's documented contact hours on individualized computer
15    education or distance learning programs in determining the district's  average
16    daily  attendance, whether the student is actually in the computer lab or dis-
17    tance learning center, or has logged on to the computer from another location.
18    A district's technology instruction programs shall be subject to the following
19    provisions:
20        (1)  The certification requirements for an alternative  school  using  the
21    individualized  computer  education or distance learning program may be met by
22    having a properly certificated teacher  available  on  a  consultant  tutorial
23    basis.  The  consultant tutors will be available by telephone, fax, e-mail, or
24    in person at the school site on a daily basis.
25        (2)  Districts claiming average daily attendance pursuant to this  section
26    shall  submit  annual  evaluations of the program to the state board of educa-
27    tion.
28        (3)  Districts may offer individualized  computer  education  or  distance
29    learning  programs  on  a  calendar  which  may  differ  from  the rest of the
30    district's instruction, but in no case may a district claim more average daily
31    attendance for a student than the full-time equivalency of a regular  term  of
32    attendance for a single student.
33        (4)  Nonalternative  high  school students may receive individualized com-
34    puter education or distance learning instruction and credit through an  alter-
35    native school site.

                           STATEMENT OF PURPOSE

    The purpose of this Act is to allow school districts a maximum of 3 % of the salary base 
    apportionment to be used for technology instruction programs either through individual tutorial 
    learning or through distance learning programs. It sets for the requirements of the technology 
    programs in order to qualify for apportionment funding.
    
                              FISCAL IMPACT
    
    The bill has no fiscal direct impact since appropriated funds are being redistributed. The bill 
    may encourage school districts to become more efficient in implementing technology and minimizing 
    related labor expenditures.
