S1493|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1493 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE LOTTERY; AMENDING SECTION 67-7408, IDAHO CODE, TO REVISE 3 POWERS AND DUTIES OF THE STATE LOTTERY COMMISSION AND TO MAKE TECHNICAL 4 CORRECTIONS; REPEALING SECTIONS 67-7420, 67-7421 AND 67-7430, IDAHO CODE; 5 AND AMENDING SECTION 67-7451, IDAHO CODE, TO PROVIDE THAT THE STATE LOT- 6 TERY SHALL COMPLY WITH THE PURCHASING LAWS FOR STATE AGENCIES PROVIDED IN 7 STATUTE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 67-7408, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 67-7408. POWERS AND DUTIES OF THE COMMISSION. The commission shall be 12 responsible for establishing the goals and objectives of the lottery and shall 13 have the following duties, powers and responsibilities in addition to others 14 herein granted: 15 (1) The commission shall adopt, upon recommendation of the director, such 16 rulesand regulationsgoverning the establishment and operation 17 of the lottery as it considers necessary under this chapter to ensure the 18 integrity of the lottery and its games and to maximize the net income of the 19 lottery for the benefit of the state. Such rulesand regulations20 shall generally address, but not be limited to: 21 (a) The different types of lottery games to be conducted; 22 (b) The range of prize structures of each lottery game; 23 (c) The method, odds and frequency of selecting winning tickets and 24 shares and the manner of paying prizes to the owners of the winning tick- 25 ets and shares; 26 (d) The terms and conditions of lottery game retailer contracts which may 27 include retailer compensation, bonuses, incentives, fees for redeeming 28 claims, payment and credit terms, retailer application and renewal fees, 29 telecommunication costs, if any, to be paid or allocated to retailers and 30 bonding requirements; 31 (e) The methods to be utilized in selling and distributing lottery tick- 32 ets or shares, including the use of machines, terminals, telecommunica- 33 tions systems and data processing systems; and 34 (f) Other matters necessary or appropriate for the efficient operation 35 and administration of the lottery, for the convenience of the public, and 36 to carry out the provisions of this chapter. Every rule promulgated within 37 the authority conferred by this chapter shall be of temporary effect and 38 must be ratified by the legislature at the regular session first following 39 their adoption. Rules not approved in the above manner shall be rejected, 40 null, void and of no force and effect on July 1, following their submis- 41 sion to the legislature. 42 (2) The commission shall approvemajorprocurements in 43 compliance with the state purchasing laws . 2 1 (3) The commission shall approve the transfer of net income in accordance 2 with the provisions of this chapter. 3 (4) The commission shall have the authority to enter into written agree- 4 ments or contracts, negotiated and prepared by the director, with any other 5 state or states, the government of Canada, the provinces of Canada or an 6 agency or contractor of any of those entities for the operation and promotion 7 of a joint lottery or joint lottery games. 8 (5) The commission shall perform all other acts necessary to carry out 9 the purposes and provisions of this chapter. 10 SECTION 2. That Sections 67-7420, 67-7421 and 67-7430, Idaho Code, be, 11 and the same are hereby repealed. 12 SECTION 3. That Section 67-7451, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 67-7451. LOTTERYEXEMPT FROMSUBJECT TO STATE 15 PURCHASING LAWS.Notwithstanding any other provision of law to the con-16trary, tT he state lottery shallbe exempt from17comply with the purchasing laws for state agencies pro- 18 vided in chapter 57, title 67, Idaho Code.
