                                   SENATE BILL NO. 1495

                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE INFORMATION TECHNOLOGY RESOURCE MANAGEMENT  COUNCIL;  AMENDING
 3        SECTION  67-5745C,  IDAHO CODE, TO PROVIDE THAT THE INFORMATION TECHNOLOGY
 4        RESOURCE MANAGEMENT COUNCIL SHALL DEVELOP  COMPREHENSIVE  RISK  ASSESSMENT
 5        CRITERIA  TO  BE  USED BY STATE AGENCIES AND INCLUDED BY STATE AGENCIES AS
 6        PART OF PROJECT INFORMATION TO BE PRESENTED TO THE  COUNCIL  WHEN  SEEKING
 7        COUNCIL APPROVAL OF LARGE SCALE PROJECTS.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That Section 67-5745C, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        67-5745C.  GENERAL POWERS AND DUTIES OF THE COUNCIL. The council shall:
12        (1)  Review and evaluate the information technology and telecommunications
13    systems presently in use by state agencies;
14        (2)  Recommend policies and prepare statewide short-range  and  long-range
15    information  technology and telecommunications systems plans to meet the needs
16    of state agencies;
17        (3)  Within the context of its strategic plans, establish statewide infor-
18    mation technology and telecommunications standards, guidelines  ,  
19      and  conventions  and comprehensive risk assessment criteria
20     that will assure uniformity and compatibility of  such  systems  within
21    state agencies;
22        (4)  Recommend  and  coordinate the use and application of state agencies'
23    information technology and telecommunications resources;
24        (5)  Review and approve large-scale information technology and  telecommu-
25    nications  projects    including,  but  not  limited  to, risk assessment
26    methodologies used by state agencies using council risk  assessment  criteria,
27     for state agencies;
28        (6)  Review state agencies' compliance with statewide information technol-
29    ogy and telecommunications systems plans;
30        (7)  Recommend  cost-efficient  procedures for state agencies' acquisition
31    and procurement of information technology and telecommunications systems;
32        (8)  Upon request, provide technical expertise to state government and any
33    other governmental entity;
34        (9)  Maintain a continuous  and  comprehensive  inventory  of  information
35    technology and telecommunications systems within state agencies;
36        (10) In accordance with statutes governing the availability or confidenti-
37    ality  of  public records and information, establish guidelines for the acces-
38    sing of public information by the public;
39        (11) On an annual basis, publish a report of the activities of the council
40    for provision to the governor and the legislature;
41        (12) Recommend the enactment or promulgation of any statutes or rules nec-
42    essary to carry out the statewide information  technology  and  telecommunica-
43    tions systems plans;

 1        (13) Enter  into  contracts  for  professional services and assistance not
 2    otherwise available in state government;
 3        (14) Encourage and promote the development and growth of  the  information
 4    technology  industry in the state in accordance with sound business principles
 5    and practices;
 6        (15) Encourage and promote cooperative information technology efforts  and
 7    activities between the state, private enterprise and the public;
 8        (16) Encourage  and  support education and training opportunities relating
 9    to information technology and telecommunications; and
10        (17) Perform any additional functions consistent with the purpose of  this
11    act which are necessary and appropriate for the proper conduct of the council.

    To amend Chapter 57, Title 67, Idaho Code, to provide that the
    
    Information Technology Resource Management Council's 
    responsibilities and duties include developing the 
    comprehensive risk assessment criteria to be used by state 
    agencies and included by state agencies as part of project 
    information to be provided to the council when seeking council 
    approval of large-scale projects.
