 1                                        AN ACT
 2    EXPRESSING LEGISLATIVE INTENT WITH REGARD TO CERTAIN UNEXPENDED  AND  UNENCUM-
 3        BERED  BALANCES  IN  THE GENERAL FUND; AND APPROPRIATING MONEYS FROM UNEX-
 4        PENDED AND UNENCUMBERED BALANCES FOR DEPOSIT INTO CERTAIN RECREATION TRUST
 5        FUNDS.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  It is legislative intent that any unexpended and  unencumbered
 8    balance  in  the General Fund on June 30, 1998, that exceeds $16,000,000 shall
 9    be appropriated as follows in priority order, to the extent  possible  allowed
10    within such prescribed balance.

11        SECTION  2.  There  is  hereby  appropriated from the June 30, 1998, unex-
12    pended and unencumbered General Fund balance in  excess  of  $16,000,000,  the
13    following  amounts  to  be transferred and deposited into the designated funds
14    listed below:

                         STATEMENT OF PURPOSE

    This bill is a contingency appropriation for the State Trust for Outdoor Recreation 
    Enhancement (STORE), and the Harriman Trust Fund, and would go into effect only 
    if state general fund revenue collections exceed the amount projected for this 
    current fiscal year.
    
    Firstly, this Legislation would establish a badly needed source of funds for the State 
    Trust for Outdoor Recreation Enhancement (STORE). The 1995 Legislature created 
    the Interim Committee on Outdoor Recreation to examine the status and needs of 
    outdoor recreation and park facilities throughout the state, and the following year the 
    State Trust for Outdoor Recreation Enhancement (STORE) was authorized by the 
    Legislature to provide funds for matching grants from the interest earned on the trust 
    fund. The principal cannot be spent. However, past efforts to provide a source of 
    funds for the trust have been unsuccessful. There is no money in the trust fund at this 
    time.
    
    This bill would provide that source of funds on a one-time basis to build up the 
    principal to the point that the interest earned could be awarded as matching grants to 
    critical park and recreation facility needs for local communities as well as school 
    districts throughout the state.
    
    The Harriman State Park Trust fund would also receive $500,000 on a one-time 
    basis. The Department of Parks and Recreation was at the point last year of being 
    forced to spend a portion of the principal of the trust in order to support that park. 
    This bill would shore up that trust fund, protect the principal and ensure the future 
    of one of Idaho's flagship parks.
    
                             FISCAL IMPACT
    
    Currently, we are expecting a surplus at the end of this fiscal year of $15,191,200 
    which we have committed to one-time funding needs in FY 1999. If, at the end of 
    this fiscal year, we have a larger surplus than we have budgeted for (rounded up to 
    $16.0 million), the first $2.0 million would be earmarked for the STORE trust fund, 
    and the next $.5 million would be earmarked for the Harriman Park Trust fund. This 
    is a one-time transfer only, which would take place at the end of this fiscal year, but 
    only if revenues come in higher than projections, and all authorized appropriations 
    are covered first. Any surplus beyond this $2.5 million would simply accrue to the 
    general fund as always.
