S1549|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1549 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING MONEYS FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL 3 YEAR 1999; LIMITING FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIATING CER- 4 TAIN UNEXPENDED AND UNENCUMBERED BALANCES; AND SETTING FORTH CONDITIONS 5 FOR THE REAPPROPRIATION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. There is hereby appropriated to the State Board of Education 8 for the Office of the State Board of Education the following amounts to be 9 expended according to the designated standard classifications from the listed 10 funds for the period July 1, 1998, through June 30, 1999: 11 FOR FOR FOR 12 PERSONNEL OPERATING CAPITAL 13 COSTS EXPENDITURES OUTLAY TOTAL 14 FROM: 15 General 16 Fund $867,700 $264,600 $9,100 $1,141,400 17 Miscellaneous 18 Revenue 19 Fund 106,200 53,800 160,000 20 TOTAL $973,900 $318,400 $9,100 $1,301,400 21 SECTION 2. In accordance with Section 67-3519, Idaho Code, the agency is 22 authorized no more than fifteen and eighty-five hundredths (15.85) full-time 23 equivalent positions at any point during the period July 1, 1998, through June 24 30, 1999, for the program specified in Section 1 of this act, unless specifi- 25 cally authorized by the Governor. The Joint Finance-Appropriations Committee 26 will be notified promptly of any increased positions so authorized. 27 SECTION 3. There is hereby reappropriated to the State Board of Education 28 for the Office of the State Board of Education the unexpended and unencumbered 29 balance of any General Fund appropriation contained in Section 1, Chapter 253, 30 Laws of 1997, to be used for nonrecurring expenditures for the period July 1, 31 1998, through June 30, 1999. 32 SECTION 4. The reappropriation granted in Section 3 of this act shall be 33 subject to the following provisions: 34 (1) If the unexpended and unencumbered balance in the General Fund on 35 June 30, 1998, is zero, the reappropriation in Section 3 is hereby declared to 36 be null and void. 37 (2) If the unexpended and unencumbered balance in the General Fund on 38 June 30, 1998, is greater than zero but less than the total General Fund re- 39 appropriation authority granted to all state agencies, the amount reappropri- 40 ated in Section 3 of this act shall be in the proportion that the reappropria- 41 tion for the Office of the State Board of Education bears to the total General 42 Fund reappropriation authority granted to all state agencies.
