It is legislative intent that the following amounts shall be 37 expended from state sources for public schools for the period July 1, 1998, 38 through June 30, 1999: 39 FROM: 40 General Fund $741,660,000 41 Dedicated Funds: 42 Endowment Funds/Lands Receipts $39,900,000 43 Mineral Royalties 2,000,000 44 Liquor Fund 1,200,000 2 1 Cigarette Tax 5,000,000 2 Lottery Income Tax 500,000 3 Miscellaneous Receipts 2,100,000 4 Fund Balance 3,500,000 5 Total Dedicated Funds $ 54,200,000 6 TOTAL $795,860,000 7 SECTION 2. There is hereby appropriated from the General Fund for public 8 schools, the following amount to be transferred to the Public School Income 9 Fund for the period July 1, 1998, through June 30, 1999: 10 FROM: 11 General Fund $741,660,000 12 SECTION 3. There is hereby appropriated from the Public School Income 13 Fund to be expended for the Educational Support Program pursuant to law and 14 the provisions of this act, not to exceed $795,860,000 for the period July 1, 15 1998, through June 30, 1999. 16 SECTION 4. There is hereby appropriated from the Public School Income 17 Fund the amount necessary for the Unemployment Insurance Program to be 18 expended according to Section 72-1349A, Idaho Code, for the period July 1, 19 1998, through June 30, 1999. 20 SECTION 5. That Section 33-1004E, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 33-1004E. DISTRICT'S SALARY-BASED APPORTIONMENT. Each district shall be 23 entitled to a salary-based apportionment calculated as provided in this sec- 24 tion. 25 1. To determine the apportionment for instructional staff, first deter- 26 mine the district average experience and education index by placing all eligi- 27 ble district certificated instructional employees on the statewide index pro- 28 vided in section 33-1004A, Idaho Code. The resulting average is the district 29 index. Districts with an index above the state average index shall receive 30 their actual index but not more than the state average plus .03 for the 31 1994-95 school year, and shall receive their actual index but not more than 32 the state average plus .06 for the 1995-96 school year, and thereafter shall 33 receive their actual district index. The district instructional staff index 34 shall be multiplied by the instructional base salary of $19,7153520,306 . The amount so determined shall be multiplied by the 36 district staff allowance for instructional staff determined as provided in 37 section 33-1004 2., Idaho Code. The resulting amount is the district's salary- 38 based apportionment for instructional staff. 39 2. To determine the apportionment for district administrative staff, 40 first determine the district average experience and education index by placing 41 all eligible certificated administrative employees on the statewide index pro- 42 vided in section 33-1004A, Idaho Code. The resulting average is the district 43 index. Districts with an index above the state average index shall receive 44 their actual index but not more than the state average plus .03 for the school 45 year 1994-95, and shall receive their actual index but not more than the state 46 average index plus .06 for the 1995-96 school year, and thereafter shall 47 receive their actual district index. The district administrative staff index 48 shall be multiplied by the base salary of $28,8439,708 49 . The amount so determined shall be multiplied by the district staff 50 allowance for administrative staff determined as provided in section 33-1004 3 1 3., Idaho Code. The resulting amount is the district's salary-based apportion- 2 ment for administrative staff. 3 3. To determine the apportionment for classified staff, multiply 4 $15,300759 by the district classified staff allow- 5 ance determined as provided in section 33-1004 4., Idaho Code. The amount so 6 determined is the district's apportionment for classified staff. 7 4. The district's salary-based apportionment shall be the sum of the 8 apportionments calculated in subsections 1., 2. and 3., of this section, plus 9 the benefit apportionment as provided in section 33-1004F, Idaho Code. 10 SECTION 6. The Department of Education shall have the authority to moni- 11 tor and evaluate the use of funds appropriated to public school districts for 12 enhancement programs. 13 SECTION 7. It is legislative intent that $1,000,000 of the moneys appro- 14 priated in Section 3 of this act shall be distributed for reading improvement. 15 The $1,000,000 for reading improvement is to be used as follows: $500,000 for 16 K-6 reading training for teachers which includes phonics, and $500,000 for 17 reading recovery K-6 or other locally developed programs which address 18 improvements in reading skills for students. The reading improvement shall be 19 distributed pro rata based on each district's prior year K-6 student enroll- 20 ment compared to the total prior year K-6 student enrollment statewide. 21 SECTION 8. It is legislative intent that $10,400,000 of the moneys appro- 22 priated in Section 3 of this act shall be expended by the Superintendent of 23 Public Instruction as follows: $3,135,000 for ongoing expenditures and 24 $7,000,000 for one-time expenditures for the Public School Technology Grant 25 Program and $265,000 for the State Library to negotiate a statewide license 26 through the Libraries Linking Idaho (LiLI) program upon direction of the Idaho 27 Council for Technology in Learning, in accordance with Section 33-4806, Idaho 28 Code. The Idaho Council on Technology in Learning will develop statewide per- 29 formance indicators to address the legislative intent of the impact, costs and 30 benefits of the projects funded by the Idaho Council for Technology in Learn- 31 ing. The performance indicators will be used to track progress and funds spent 32 to achieve the performance indicators. A report of the costs to attain the 33 performance indicators will be provided to the Legislature and the State Board 34 of Education annually. 35 SECTION 9. It is legislative intent that an amount not to exceed $140,000 36 of the $10,400,000 referenced in Section 8 of this act shall be expended by 37 the Superintendent of Public Instruction for staff support and various 38 expenses related to the Idaho Council for Technology in Learning as approved 39 by the State Board of Education. 40 SECTION 10. It is legislative intent that $250,000 of the moneys appro- 41 priated in Section 3 of this act be distributed by the Superintendent of Pub- 42 lic Instruction as grants to teachers or groups of teachers for the develop- 43 ment of creative and innovative instructional methods or curriculum. 44 SECTION 11. It is legislative intent that $3,000,000 of the moneys appro- 45 priated in Section 3 of this act be distributed for support of programs for 46 students with non-English or limited-English proficiency. The funding for 47 limited-English proficiency programs shall be allocated to school districts 48 pro rata based upon the population of limited-English proficient students 49 under criteria established by the State Department of Education. 4 1 SECTION 12. It is legislative intent that $375,000 of the moneys appro- 2 priated in Section 3 of this act shall be distributed by the State Superin- 3 tendent of Public Instruction for a teacher-mentor program. Payment shall be 4 calculated on the number of first-year teachers and teachers returning after 5 an absence of five (5) years or more. Funds may be used to provide mentor sti- 6 pends, release time, and professional development opportunities. 7 SECTION 13. It is legislative intent that of the amount appropriated in 8 Section 3 of this act, $5,000,000 of the moneys accruing pursuant to Sections 9 63-2506 and 63-2552A, Idaho Code, plus $500,000 of the income taxes collected 10 from lottery winnings, pursuant to section 67-7439, Idaho Code, shall be 11 expended by the Superintendent of Public Instruction for the Idaho Safe and 12 Drug-Free Schools Program for the period July 1, 1998, through June 30, 1999. 13 SECTION 14. It is legislative intent that the funds for the Idaho Safe 14 and Drug-Free Schools Program referenced in Section 13 of this act shall be 15 distributed as follows: $100,000 may be utilized by the Superintendent of Pub- 16 lic Instruction for program administration, technical assistance and evalua- 17 tion. Of the remaining amount, ninety percent (90%) shall be distributed to 18 each school district through a combination of a base amount of $1,500 and a 19 prorated amount based on the prior year's average daily attendance. Of the 20 remaining ten percent (10%), $80,000 shall be distributed on a one-time basis 21 to the Commission on Hispanic Affairs and used to encourage and direct His- 22 panic youth away from the habitual use of tobacco, alcohol, and other drugs by 23 developing programs for schools, families and communities, with the remainder 24 used to make discretionary grants as determined by the Drug-Free Schools and 25 Communities Advisory Board. 26 SECTION 15. It is legislative intent that the Idaho Safe and Drug-Free 27 Schools Program shall include the following: 28 (1) Districts will develop a policy and plan which will provide a guide 29 for their substance abuse program. 30 (2) Districts will have an advisory board to assist each district in mak- 31 ing decisions relating to the program. 32 (3) The districts' substance abuse programs will be comprehensive to meet 33 the needs of all students. This will include prevention programs, student 34 assistance programs that address early identification and referral, and after- 35 care. 36 (4) Districts shall submit an annual evaluation of their program to the 37 State Department of Education as to the effectiveness of their programs. 38 SECTION 16. It is legislative intent that $1,000,000 of the moneys appro- 39 priated in Section 3 of this act shall be distributed for the following: 40 (1) Training of regular classroom teachers in working with children with 41 disabilities; 42 (2) Employing and training aides to assist regular classroom teachers in 43 working with children with disabilities; 44 (3) Employing substitute teachers whose employment allows regular class- 45 room teachers to be involved in college planning, parent contact, Individual 46 Education Plan (IEP) development, curriculum modification, or other necessary 47 activities directly related to meeting the needs of students in regular educa- 48 tion classrooms; 49 (4) Moneys in this section shall be distributed pro rata to the districts 50 as follows: fifty percent (50%) on the basis of the prior year's December 51 first child count and fifty percent (50%) on the basis of the prior year's 5 1 average daily attendance. 2 It is legislative intent that these funds be used to supplement rather 3 than supplant existing efforts in the training of regular classroom teachers 4 and the employment and training of aides; and that the State Department of 5 Education shall create a one-page report to be provided to the Legislature 6 showing current individual district expenditures in this area, as well as a 7 breakdown of how these appropriated moneys were spent. 8 It is further legislative intent that these funds shall not be used in any 9 calculation or report to the federal government that obligates a future appro- 10 priation of this amount or any other amount. 11 SECTION 17. It is legislative intent that $500,000 of the moneys appro- 12 priated in Section 3 of this act be distributed to train general education 13 teachers, gifted/talented (G/T) facilitators, administrators and/or parents to 14 better meet the need of gifted/talented students. One-half (1/2) of these 15 funds shall be allocated pro rata based on each district's prior year total 16 student enrollment compared to the prior year total statewide enrollment. One- 17 half (1/2) of these funds shall be allocated based on the number of 18 gifted/talented students identified and served as indicated on the prior 19 year's December first child count. No district will receive less than $300. 20 Funds shall be distributed upon submission and approval of an application sub- 21 mitted to the State Department of Education demonstrating how in-service 22 training will establish or improve identification and service of 23 gifted/talented students in the five (5) mandated talent areas. 24 SECTION 18. It is legislative intent that $30,000 of the moneys appropri- 25 ated in Section 3 of this act be expended by the Superintendent of Public 26 Instruction to continue the work of the Reading Study Committee. It is 27 intended that a report and recommendations be provided to the First Regular 28 Session of the Fifty-fifth Idaho Legislature. 29 SECTION 19. It is legislative intent that not more than $200,000 of the 30 moneys appropriated in Section 3 of this act shall be distributed by the State 31 Department of Education to private nonprofit agencies for the unfunded educa- 32 tional costs of Idaho students in state custody. Students must be 33 residentially placed by state agencies in a licensed children's treatment 34 facility or group home in Idaho during the 1997-98 and 1998-99 school years, 35 and educated in a nonsectarian accredited school operated by the same treat- 36 ment facility or group home. The agency's school must be accredited for the 37 1997-98 and 1998-99 school years. For students eligible for special education, 38 the school must have a special education program approved by the State Depart- 39 ment of Education. The per student amount shall not exceed sixty-five dollars 40 ($65.00) per day for one hundred eighty (180) days.
