                           SENATE CONCURRENT RESOLUTION NO. 130

 1                               A CONCURRENT RESOLUTION
 2    AUTHORIZING THE LEGISLATIVE COUNCIL TO UNDERTAKE AND COMPLETE A STUDY  OF  THE
 3        ALCOHOLIC BEVERAGE LAWS OF THE STATE OF IDAHO AND AN EVALUATION OF ALCOHOL
 4        BEVERAGE LAW THAT CREATES ALCOHOL SPECIAL INTEREST GROUPS.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS,  the  statutes,  laws  and rules governing the sale, distribution
 7    and consumption of alcoholic beverages in the state of  Idaho  have  developed
 8    through  a  process  of  deletions  and additions resulting in a confusing and
 9    oftentimes contradictory system of statutes, laws and rules; and
10        WHEREAS, several pieces of legislation are annually considered by the leg-
11    islature which propose amendments to  the  alcoholic  beverage  statutes,  and
12    debate  of  these  measures  illustrates  the  complexity of the current legal
13    framework in this area and every year bills pass which further complicate  the
14    legal framework of the alcoholic beverage control laws; and
15        WHEREAS,  it  is  incumbent  upon  the legislature to make the laws of the
16    state understandable while at the same time accomplishing or attaining  appro-
17    priate state policy as to the rationale for these laws.
18        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
19    sion of the Fifty-fourth Idaho Legislature, the Senate and the House of Repre-
20    sentatives concurring therein, that the Legislative Council is  authorized  to
21    appoint  a  committee, not to exceed eight legislators, to perform the follow-
22    ing:
23        1.  Undertake and complete a study of the alcoholic beverage statutes  and
24        rules  and  all matters relating thereto with the goals of simplifying the
25        regulatory framework while at the same time keeping  in  mind  the  public
26        policy  of encouraging temperance and sobriety of the citizens and assist-
27        ing those individuals for whom the consumption of alcohol  provides  prob-
28        lems.
29        2.  Evaluate alcohol beverage laws, that authorize or have resulted in the
30        creation of economic special interest groups and justify the ongoing value
31        of their public purpose and financial benefit to the citizens of Idaho.
32    The  Legislative Council shall determine the number of legislators and member-
33    ship from each house appointed to the committee and shall authorize  the  com-
34    mittee  to  receive  input, advice and assistance from interested and affected
35    parties who are not members of the legislature.
36        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
37    ommendations and proposed legislation, if any, to the First Regular Session of
38    the Fifty-fifth Idaho Legislature.

                          STATEMENT OF PURPOSE

    This legislation authorizes legislative council to appoint 
    an interim committee, of not more than eight members, to 
    review and evaluate the state's alcohol beverage code, 
    report findings and make recommendations for proposed 
    legislation.
    
    Sections of the alcohol beverage code have been changed 
    numerous times over the past several decades. As a result, 
    the law has become inconsistent, confusing and out-of-date 
    with several exceptions spread throughout the code. Changes 
    to the law over the years have also established or 
    authorized certain special economic interest groups. The 
    public purpose of these groups and their financial benefit 
    to the citizens of Idaho needs to be evaluated and 
    justified.
    
    The Department of Law Enforcement-Bureau of Alcohol 
    Beverage Control reports 40-50 percent of their personnel's 
    time is spent just interpreting the law for citizens. The 
    Idaho State Liquor Dispensary operations have also been 
    handicapped due to inconsistencies in the law.
    
    FISCAL NOTE
    
    The fiscal impact is estimated to not exceed 
    $5,000.
