SJM107|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE JOINT MEMORIAL NO. 107 BY STATE AFFAIRS COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF IDAHO 4 IN THE CONGRESS OF THE UNITED STATES, AND TO THE LEGISLATURES OF THE SEV- 5 ERAL STATES OF THESE UNITED STATES; STATING FINDINGS OF THE LEGISLATURE 6 AND PETITIONING THE CONGRESS OF THE UNITED STATES TO SUBMIT AN AMENDMENT 7 TO THE CONSTITUTION OF THE UNITED STATES PROTECTING THE FLAG OF THE UNITED 8 STATES. 9 We, your Memorialists, the Senate and the House of Representatives of the 10 State of Idaho assembled in the Second Regular Session of the Fifty-fourth 11 Idaho Legislature, do hereby respectfully represent that: 12 WHEREAS, although the right to free expression is part of the foundation 13 of the United States Constitution, very carefully drawn limits on expression 14 in specific instances have long been recognized as legitimate means of main- 15 taining public safety and decency, as well as orderliness and productive value 16 of public debate; and 17 WHEREAS, certain actions, although arguably related to one person's free 18 expression, nevertheless raise issues concerning public decency, public peace, 19 and the rights of expression and sacred values of others; and 20 WHEREAS, the American Flag to this day is a most honorable and worthy ban- 21 ner of a nation which is thankful for its strengths and committed to curing 22 its faults, and a nation which remains the destination of millions of 23 immigrants attracted by the universal power of the American ideal; and 24 WHEREAS, the law as interpreted by the United States Supreme Court no 25 longer accords to the Stars and Stripes that reverence, respect and dignity 26 befitting the banner of that most noble experiment of a nation-state; and 27 WHEREAS, it is only fitting that people everywhere should lend their 28 voices to a forceful call for restoration to the Stars and Stripes of a proper 29 station under law and decency. 30 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 31 sion of the Fifty-fourth Idaho Legislature, the Senate and the House of Repre- 32 sentatives concurring therein, that the Congress of the United States submit 33 for ratification by the states, an amendment to the United States Constitu- 34 tion, specifying that Congress shall have the power to prohibit the physical 35 desecration of the flag of the United States and commending and endorsing Sen- 36 ator Dirk Kempthorne and Senator Larry Craig, members of the congressional 37 delegation representing the state of Idaho in the Congress of the United 38 States, for their support of the amendment as proposed in S.J. Res. 40 in the 39 United States Congress. 40 BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is 41 hereby authorized and directed to forward a copy of this Memorial to the Pres- 42 ident of the Senate and the Speaker of the House of Representatives of Con- 43 gress, to the congressional delegation representing the state of Idaho in the 44 Congress of the United States and to the legislatures of the several states of 2 1 these United States.
