 1                                        AN ACT
 2    RELATING TO THE UNIFORM ANATOMICAL GIFT ACT; REPEALING SECTION 39-3402,  IDAHO
 3        CODE.

 4    Be It Enacted by the Legislature of the State of Idaho:

 5        SECTION  1.  That  Section 39-3402, Idaho Code, be, and the same is hereby
 6    repealed.

Statement of Purpose / Fiscal Impact








    STATEMENT OF PURPOSE

    To repeal Section 39-3402 Idaho Code, Duties of the Department of Health and Welfare 
    pertaining to the Uniform Anatomical Gift Act. The Section requires the Department to 
    maintain a register of facilities for the storage of human bodies or body parts for 
    transplantation. The Department shall not maintain on the register facilities that do not 
    certify that the individual from which the body part was obtained was tested for Human 
    Immunodeficiency Virus (HIV).
    
    There is no penalty provision for facilities not reporting information nor is there any 
    direction regarding the intended use of the register. In the eight-year history of the register 
    no one has used it for any purpose.
    
                               FISCAL IMPACT
    
    Repeal of the responsibility wili reduce the staff time necessary to collect and compile the 
    information, approximately $200.
