INSURANCE AGENTS - EXAMINATIONS - Amends existing law to delete the
requirement that application to take the insurance agent, broker or
consultant license examination be filed ten days prior to the examination
date and to require that application for a license be filed with the
Department of Insurance within 180 days after successful completion of the
examination.

 1                                        AN ACT
 2    RELATING TO LICENSING OF INSURANCE AGENTS, BROKERS AND  CONSULTANTS;  AMENDING
 3        SECTION 41-1038, IDAHO CODE, TO DELETE THE REQUIREMENT THAT AN APPLICATION
 4        FOR  EXAMINATION  MUST BE FILED TEN DAYS PRIOR TO THE DATE OF EXAMINATION,
 5        AND TO ADD THE REQUIREMENT THAT APPLICATION FOR LICENSURE WILL  BE  DENIED
 6        IF  NOT  RECEIVED WITHIN ONE HUNDRED EIGHTY DAYS OF THE SUCCESSFUL COMPLE-
 7        TION OF THE EXAMINATION.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Section 41-1038, Idaho Code, be, and the same  is  hereby
10    amended to read as follows:

11        41-1038.  EXAMINATION FOR LICENSE -- APPLICATION FOR EXAMINATION. (1) Each
12    person  who  applies  for  a  license  shall  have  taken or will take (unless
13    exempted therefrom under section 41-1039, Idaho Code) a personal written exam-
14    ination as to his competence to act as an agent, broker or consultant.
15        (2)  Examination of an applicant for an agent's license shall cover all of
16    the kinds of insurance for which the applicant has applied to be licensed,  as
17    constituted by any one (1) or more of the following classifications:
18        (a)  Life insurance and annuity contracts.
19        (b)  Disability insurance.
20        (c)  Credit  life  and credit disability insurance under a limited license
21        under conditions described in section 41-1045, Idaho Code.
22        (d)  Involuntary unemployment insurance under a limited license under con-
23        ditions described in section 41-1045, Idaho Code.
24        (e)  Credit property insurance under a limited  license  under  conditions
25        described in section 41-1045, Idaho Code.
26        (f)  Motor vehicle physical damage insurance under a limited license under
27        conditions described in section 41-1045, Idaho Code.
28        (g)  Vehicle insurance as defined in section 41-506(1)(a), Idaho Code.
29        (h)  Property insurance as defined in section 41-504, Idaho Code.
30        (i)  Marine  and  transportation  insurance  as defined in section 41-505,
31        Idaho Code.
32        (j)  Casualty insurance as defined in section 41-506, Idaho Code.
33        (k)  Surety insurance as defined in section 41-507, Idaho Code.
34        (3)  An applicant for license as a life broker  or  life  consultant  must
35    take  and  pass an examination as to life insurance, disability insurance, and
36    annuity contracts. An applicant for license as a  general  lines  broker  must
37    take  and pass an examination as to property, casualty, surety, and marine and
38    transportation insurances, as identified in subsection (2) of this section.
39        (4)  An applicant for license as both a life agent or life  broker  and  a
40    general lines agent or general lines broker shall be separately examined as to
41    life insurance and as to such general lines, and shall pay a separate examina-
42    tion application fee as to each of such two (2) examinations.
43        (5)  If  the  applicant is a firm or corporation, the examination shall be

 1    taken by each individual who is to  be  named  in  or  registered  as  to  the
 2    license, as provided in section 41-1036, Idaho Code.
 3        (6)  If  the applicant for license as a life agent or life broker is to be
 4    authorized also to transact variable  annuities  or  variable  life  insurance
 5    business,  the  director shall ascertain that the applicant  has met all state
 6    and federal qualifications as to such variable contracts.
 7        (7)   Written a  A pplication  and  payment  of
 8    fees specified in section 41-401, Idaho Code,  for the examination shall
 9    be    filed with   made to  the director or his designee
10    by or on behalf of the applicant .   not less  than  ten  (10)
11    days  prior  to  the  date  fixed  for the examination, as provided in section
12    41-1041, Idaho Code, and shall be accompanied by the fee for such  application
13    as  specified  in  section 41-401, Idaho Code (fee schedule). This application
14    fee is earned when paid, and is not subject to refund. If the  applicant  does
15    not  take  the  examination within ninety (90) days after applying therefor, a
16    new application and fee shall be  required  as  to  a  subsequent  examination
17       Applications for licensure not received by the department within
18    one hundred eighty (180) days of the successful completion of the  examination
19    shall be denied .

    STATEMENT OF PURPOSE

    The proposed legislation would eliminate the requirement that an application to take an 
    insurance agent, broker or consultant license examination must be received by the 
    department ten (10) days prior to the date for the examination. This will allow more 
    flexibility in the scheduling of the examination by applicants. The legislation also provides 
    that an application for license must be received by the department within one hundred 
    eighty (180) days of the successful passing of the examination for the passing score to 
    remain valid.
