                                    HOUSE BILL NO. 526

                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO MEMBERSHIP IN THE LEGISLATURE; AMENDING CHAPTER 4, TITLE 67, IDAHO
 3        CODE, BY THE ADDITION OF A NEW SECTION 67-465, IDAHO CODE, TO PROVIDE  THE
 4        RIGHT OF MEMBERS OF THE LEGISLATURE TO MAINTAIN THEIR EMPLOYMENT STATUS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Chapter  4,  Title  67, Idaho Code, be, and the same is
 7    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 8    known and designated as Section 67-465, Idaho Code, and to read as follows:

 9        67-465.  LEGISLATIVE  SERVICE ENCOURAGED. In order to protect and maintain
10    the part-time citizens' legislature which is valued by the citizens of  Idaho,
11    it  is  essential  that  individuals  who give legislative service are able to
12    retain their positions of employment in private life. Any  individual  who  is
13    duly  elected  or  appointed  to membership in the legislature of the state of
14    Idaho is entitled to resume the employment he holds in his private life at the
15    conclusion of a regular or special session of the legislature,  provided  that
16    the  requirements of this section shall not apply to any employer of less than
17    twenty-five (25) employees. An employer shall not  discharge  or  threaten  to
18    discharge,  intimidate or coerce any employee by reason of the employee's ser-
19    vice or scheduled service as a member or prospective member  of  the  legisla-
20    ture.  If  any employer fails or refuses to comply with this section, the dis-
21    trict court in the county in which the member  was  employed  shall  have  the
22    power, upon petition by the member, to compel the employer to comply with this
23    section and to compensate the member for lost wages and benefits, for costs of
24    the action, and for reasonable attorney's fees. The court shall order a speedy
25    hearing in any such case and advance it on the calendar.

    Adds a new section to Idaho Code to encourage citizens to 
    serve in the legislature. This statute will enable a duly 
    elected or appointed legislator to resume the employment he 
    holds in his private life at the conclusion of a regular 
    special session of the legislature.
