 1                                        AN ACT
 2    RELATING TO EXEMPTIONS FROM MOTOR VEHICLE  OPERATING  FEES;  AMENDING  SECTION
 3        49-426,  IDAHO CODE, TO PROVIDE AN EXEMPTION FROM OPERATING FEES FOR MOTOR
 4        VEHICLES OWNED OR LEASED BY ANY STATE  REGISTERED  NONPROFIT  SUBSCRIPTION
 5        FIRE PROTECTION UNIT.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section  49-426, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        49-426.  EXEMPTIONS FROM OPERATING FEES. The provisions  of  this  chapter
10    with respect to operating fees shall not apply to:
11        (1)  Motor  vehicles  owned  or  leased by the United States, the state, a
12    city, a county, any department thereof, any political subdivision or municipal
13    corporation of the state, any taxing district of the state,    any  state
14    registered  nonprofit subscription fire protection unit,  or any organi-
15    zation, whether incorporated or unincorporated, organized for  the  operation,
16    maintenance,  or  management  of  an irrigation project or irrigation works or
17    system or for the purpose of furnishing water to its members or  shareholders,
18    but in other respects shall be applicable.
19        (2)  Farm  tractors,  implements of husbandry, road rollers, wheel mounted
20    tar buckets, portable concrete and/or mortar mixers,  wheel  mounted  compres-
21    sors,  tow  dollies,  portable  toilet  trailers, street sweepers, and similar
22    devices as determined by the department  which  are  temporarily  operated  or
23    moved  upon  the  highways need not be registered under the provisions of this
24    chapter, nor shall implements of husbandry be  considered  towed  units  under
25    registration  of  vehicle  combinations as defined in section 49-108(2), Idaho
26    Code. In addition, self-propelled wheelchairs, invalids' tricycles, and wheel-
27    chair conveyances operated by persons who by reason of physical disability are
28    otherwise unable to move about as pedestrians shall be exempt  from  registra-
29    tion  requirements  under the provisions of this chapter. Motorcycles and all-
30    terrain vehicles, as  defined in section 67-7101, Idaho Code, need not be reg-
31    istered under the provisions of this chapter while being used  exclusively  in
32    connection  with  agricultural, horticultural, dairy and livestock growing and
33    feeding operations or used exclusively for snow removal purposes. Travel  upon
34    the  public  highways  shall  be limited to travel between farm or ranch loca-
35    tions. Motorcycles and all-terrain vehicles used for this purpose  shall  meet
36    the requirements of section 49-619, Idaho Code.

                         STATEMENT OF PURPOSE

    This proposed legislation would place nonprofit subscription fire protection units in the same 
    category as fire districts and other taxing districts approved under section 49-426, Idaho Code, 
    for exemption of motor vehicle operating fees.
    
    Subscription fire protection units are registered with the Office of the Secretary of State as 
    nonprofit organizations established for the purpose of rural fire protection. The number of 
    subscription fire protection units in the state is not tracked by any known state agency but a 
    rough estimate would be that there are fifteen or less such organizations.
    
    Subscription fire protection units operate on very limited budgets and vehicle registration fees for 
    fire trucks may amount to more than 10% of the total operating budget. For insurance purposes, 
    fire protection offered by subscription fire protection units is effective in reducing residential 
    insurance costs to a distance of approximately 10 miles from the base location of the trucks.
    
                             FISCAL NOTE
    
    There are 1,230 fire trucks registered statewide in the exempt plate program and 163 fire trucks 
    owned by individuals or other entities that are registered outside the current exempt plate 
    program. The sum total of registration fees collected in 1997 for nonexempt fire trucks in Idaho 
    was $6,675.20. Typically, registration fees for fire trucks less than 16,000 pounds is about $35.00 
    and for fire trucks under 26,000 pounds the fee is about $65.00. Assuming two 26,000 pound 
    trucks (10 wheelers) and one 16,00 pound truck per subscription unit, and fifteen units statewide, 
    the loss in Idaho Department of Transportation collections would be approximately $2,475.
