 1                                        AN ACT
 2    RELATING TO LICENSES TO HUNT, FISH AND TRAP; AMENDING  SECTION  36-401,  IDAHO
 3        CODE,  TO  REMOVE  THE PROVISION THAT DISABLED PERSONS ARE NOT REQUIRED TO
 4        OBTAIN A LICENSE; AND AMENDING SECTION 36-406, IDAHO CODE, TO PROVIDE THAT
 5        LICENSES OF THE FIFTH CLASS MAY BE PURCHASED BY DISABLED  PERSONS  AND  TO
 6        DEFINE A "DISABLED PERSON."

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That  Section  36-401, Idaho Code, be, and the same is hereby
 9    amended to read as follows:

10        36-401.  HUNTING, TRAPPING, FISHING -- LICENSE REQUIREMENT --  EXCEPTIONS.
11    No  person shall hunt, trap, or fish for or take any wild animal, bird or fish
12    of this state, without first having procured a  license  as  hereinafter  pro-
13    vided. Provided that no license shall be required:
14        (a)  1.  For  children  under the age of fourteen (14) years who are resi-
15        dents of this state to fish during the open season therefor.
16        2.  For nonresident children under the age of fourteen (14) years to  fish
17        during  the  open  season  therefor  provided  they are accompanied by the
18        holder of a valid fishing license, and  provided  further  that  any  fish
19        caught  by such nonresident children shall be included in the bag and pos-
20        session limit of such license holder.
21        3.  For resident children under the age of twelve (12) years to hunt, take
22        or kill predatory, unprotected birds and animals by means other than  with
23        firearms.
24        4.  For  resident  children  under  the age of fourteen (14) years to trap
25        muskrats from irrigation ditches or property on which they live during the
26        open season.
27        5.  For children under the age of eighteen (18) who  are  residents  of  a
28        licensed  foster home, a foster group home, or a child welfare institution
29        to fish during the open season therefor, provided they are accompanied and
30        supervised by the director, officer, or other  employee  of  the  facility
31        where the child resides.
32        (b)  For  any  person to fish on a "free fishing day" as may be designated
33    by the commission.
34        (c)  Senior Residents. For "senior residents" age seventy  (70)  years  or
35    older  who  are  holders of a "senior resident permit" to hunt and fish during
36    the open season.
37        (d)  Blind Persons. For resident  blind  persons  who  are  holders  of  a
38    "permit for the blind" to fish during the open season.
39        (e)  Institutional  Inmates.  For  any inmate of the state hospital north,
40    state hospital south, Idaho state school  and  hospital,  and  state  veterans
41    homes  to fish during open seasons, provided said inmate has a permit therefor
42    from the director. The director is authorized to issue such permits  upon  the
43    request  of  the  head  of  the  respective institution having custody of said

 1    inmate upon a showing that the institution recommends  the  issuance  of  such
 2    permit  and  will  assume full responsibility for and control over said inmate
 3    while using said permit.
 4        (f)  Resident Military Personnel. For resident persons engaged in the mil-
 5    itary service of the United States, while on temporary furlough or leave, upon
 6    receipt of a temporary permit from the director, to hunt and fish  during  the
 7    open season.
 8        (g)    Disabled  Persons.  For any resident person who is permanently
 9    and totally disabled as certified by a physician licensed to practice  in  the
10    United  States  or  Canada, to hunt and fish during the open season, providing
11    such person has obtained a permit from the director.
12        (h)   State Juvenile Corrections Center Students.  For  students  of
13    the  state juvenile corrections center, under the supervision of an officer of
14    the center, to fish during the open season.
15        ( i  h )  Boy Scouts. For boy scouts who  are  offi-
16    cial  participants  in  attendance at national or international encampments at
17    Farragut State Park to take fish during the encampment period from  Lake  Pend
18    Oreille in such areas and such numbers as may be designated by the commission.
19        (  j    i )  Participants in Fish and Game Sponsored
20    Functions. For persons who are official participants in attendance at official
21    department sponsored functions including clinics, courses or other educational
22    events, while under the supervision of a department  approved  instructor  for
23    the function, to fish during any open season, provided that the instructor has
24    been issued an educational fishing permit by the director.
25        (  k    j  )  Nothing contained herein shall be con-
26    strued to prohibit citizens of the United States  who  are  residents  of  the
27    state of Idaho from carrying arms for the protection of life and property.

28        SECTION  2.  That  Section  36-406, Idaho Code, be, and the same is hereby
29    amended to read as follows:

30        36-406.  RESIDENT FISHING, HUNTING AND  TRAPPING  LICENSES  --  FEES.  (a)
31    Adult  Licenses -- Combination -- Fishing -- Hunting -- Trapping. A license of
32    the first class may be had by a person possessing the  qualifications  therein
33    described  on  payment  of  twenty dollars ($20.00) for a combined fishing and
34    hunting license entitling the purchaser to hunt and  fish  for  game  animals,
35    game  birds,  unprotected and predatory animals and fish of the state, fifteen
36    dollars ($15.00) for a fishing license entitling the purchaser to fish in  the
37    public  waters  of  the state, six dollars ($6.00) for a hunting license enti-
38    tling the purchaser to hunt game animals, game birds, unprotected  and  preda-
39    tory  animals  of  the  state, and twenty-five dollars ($25.00) for a trapping
40    license entitling the purchaser to trap furbearers, unprotected and  predatory
41    animals of the state.
42        (b)  Youth  Licenses -- Hunting -- Trapping. A license of the second class
43    may be had by a person possessing the qualifications therein described on pay-
44    ment of four dollars ($4.00) for a hunting license, and five  dollars  ($5.00)
45    for  a  trapping license entitling the purchaser to the same privileges as the
46    corresponding license of the first class provides.
47        (c)  Youth Combination -- Fishing Licenses. A license of the  third  class
48    may  be  purchased by a person possessing the qualifications therein described
49    on payment of ten dollars ($10.00) for a combined fishing and hunting license,
50    and seven dollars ($7.00) for a fishing license entitling the purchaser to the
51    same privileges as the corresponding license of the first class provides.
52        (d)  Senior Resident Combination. A license of the fourth class may be had
53    by a person possessing the qualifications therein described on payment of four

 1    dollars ($4.00) for a combined fishing and hunting license entitling the  pur-
 2    chaser  to the same privileges as the corresponding license of the first class
 3    provides.
 4        (e)  Lifetime Licenses -- Combination -- Hunting -- Fishing. A license  of
 5    the fifth class may be obtained at no additional charge by a person possessing
 6    the  qualifications  therein  described  for  a  combined  hunting and fishing
 7    license, for a hunting license, or for a fishing license, entitling the person
 8    to the same privileges as the corresponding license of the  first  class  pro-
 9    vides.  Lifetime  licensees  must be certified under the provisions of section
10    36-411, Idaho Code, before being issued a license to hunt.
11        (f)  A license of the eighth class may be had by a person  possessing  the
12    qualifications  therein  described  on  payment of sixty-nine dollars ($69.00)
13    entitling the purchaser to hunt and fish for game animals, game  birds,  fish,
14    and  unprotected  and  predatory  animals  of  the  state. With payment of the
15    required fee, a person shall receive with this license a deer    tag,  an  elk
16    tag,  a bear tag, a turkey tag, a mountain lion tag, an archery hunt permit, a
17    muzzleloader permit, an upland game permit, a  migratory  waterfowl  stamp,  a
18    steelhead  trout  permit  and  an anadromous salmon permit. The director shall
19    promptly transmit to the state treasurer all moneys received pursuant to  this
20    subsection for deposit as follows:
21        (i)  Three  dollars  ($3.00)  in the set-aside account for the purposes of
22        section 36-111(1)(a), Idaho Code;
23        (ii)  Two dollars ($2.00) in the set-aside account  for  the  purposes  of
24        section 36-111(1)(b), Idaho Code;
25        (iii)  One dollar and fifty cents ($1.50) in the set-aside account for the
26        purposes of section 36-111(1)(c), Idaho Code;
27        (iv)  Five  dollars  ($5.00)  in the set-aside account for the purposes of
28        section 36-111(1)(e), Idaho Code;
29        (v)  Two dollars ($2.00) in the set-aside account for the purposes of sec-
30        tion 36-111(1)(f), Idaho Code; and
31        (vi)  The balance in the fish and game account.
32        All persons purchasing a license pursuant to this subsection shall observe
33    and shall be subject to all rules of the commission  regarding  the  fish  and
34    wildlife of the state.
35        If  the  purchaser  of  this  license  does not meet the archery education
36    requirements of section 36-411(b), Idaho Code, then, notwithstanding the  pro-
37    visions of section 36-304, Idaho Code, the archery hunt permit portion of this
38    license is invalid. The fee for this license will not change and the issuer of
39    the  license  must indicate on the face of the license that the archery permit
40    is invalidated.
41         (g)  Disabled Persons. A license of the fifth class may be purchased
42    by any resident disabled person on payment of three dollars ($3.00) for a com-
43    bined fishing and hunting license; two dollars ($2.00) for a fishing  license;
44    and  one  dollar ($1.00) for a hunting license; entitling the purchaser to the
45    same privileges as the corresponding license of the first  class  provides.  A
46    disabled  person  means a person who is disabled as certified as eligible for:
47    federal supplemental security income (SSI); social security disability  income
48    (SSDI);  a  nonservice-connected veterans pension; or a service-connected vet-
49    erans disability benefit with  forty  percent  (40%)  or  greater  disability.

                           STATEMENT OF PURPOSE
    
                                 RS 07722
    
    To provide free hunting and fishing privileges for resident 
    disabled war veterans who have a 40% or greater service related 
    disability.
    
                               FISCAL NOTE
    
    There are currently 3200 vets in Idaho who would qualify as at 
    least 40% disabled. The actual number who would take advantage of 
    this benefit is unknown but the number is expected to be relatively 
    small and the fiscal impact to be small.
