                        HOUSE BILL NO. 656, As Amended, As Amended

 1                                        AN ACT
 2    RELATING TO THE IDAHO SAFE BOATING ACT; AMENDING SECTION 67-7015, IDAHO  CODE,
 3        TO  REQUIRE  A PERSONAL FLOTATION DEVICE UNDER CONDITIONS SPECIFIED AND TO
 4        MAKE TECHNICAL CORRECTIONS; AND DECLARING AN EMERGENCY.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 67-7015, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        67-7015.  SAFETY EQUIPMENT -- ADDITIONAL REGULATIONS. (1)  The opera-
 9    tor  of  every  vessel  shall require every person twelve (12) years of age or
10    under to wear a United States Coast Guard approved type I, type II or type III
11    personal flotation device while on the deck of a moving vessel, while in oper-
12    ation, or being towed by the vessel. A life belt or ring shall not satisfy the
13    requirement of this section.
14        (2)   The department is hereby authorized to promulgate rules  
15    and regulations  establishing  additional  equipment require-
16    ments  for  any  vessel  subject  to  the provisions of law.  Regulations
17      Rules  shall be, wherever possible, in conformity with  the
18    provisions of the federal navigation laws or with navigation rules and regula-
19    tions  promulgated by the United States Coast Guard and shall be modified from
20    time to time to maintain that conformity.
21        ( 2  3 )  It shall be unlawful  for  any  person  to
22    operate  or  permit  the operation of any vessel on the waters of the state of
23    Idaho unless the vessel  shall  have  on  board  or  installed  the  equipment
24    required  by   this section and  rules  and regulations 
25    promulgated by the department.

26        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
27    declared to exist, this act shall be in full force and effect on and after its
28    passage and approval.

                           STATEMENT OF PURPOSE

    The purpose of this legislation is to change existing Idaho 
    Code 67-7015 from merely requiring that personal flotation 
    devices (PFDs) be borne on watercraft. This legislation 
    requires that they be worn by little people, aged twelve (12) 
    and under. It requires that operators choose to be 
    responsible for the well-being of children in their care.
