H0754|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 754 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO POSTSECONDARY ENROLLMENT OPTIONS; AMENDING SECTION 33-5106, IDAHO 3 CODE, TO PROVIDE THAT A PUPIL'S ENROLLMENT IN COURSES FOR SECONDARY CRE- 4 DITS SHALL BE COUNTED AS FOUR HOURS A DAY FOR PURPOSES OF DETERMINING THE 5 LOCAL DISTRICT'S INSTRUCTIONAL TIME EVEN IF ACTUAL TIME IS LESS THAN FOUR 6 HOURS; AND AMENDING SECTION 33-5109, IDAHO CODE, TO CLARIFY THAT FOUR 7 SEMESTER COLLEGE CREDITS SHALL EQUAL AT LEAST TWO SEMESTER CREDITS OF HIGH 8 SCHOOL CREDIT IN A PARTICULAR SUBJECT AND TO CLARIFY THAT POSTSECONDARY 9 FACULTY INSTRUCTING A COURSE FOR POSTSECONDARY, SECONDARY OR DUAL CREDIT 10 SHALL NOT BE REQUIRED TO OBTAIN A SECONDARY TEACHING CERTIFICATE AND SHALL 11 NOT BE DEEMED AN EMPLOYEE OF A LOCAL SCHOOL DISTRICT. 12 Be It Enacted by the Legislature of the State of Idaho: 13 SECTION 1. That Section 33-5106, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 33-5106. LIMIT ON PARTICIPATION. (1) A pupil who first enrolls in grade 16 eleven (11) may not enroll in postsecondary courses under the provisions of 17 this chapter for secondary credit for more than the equivalent of two (2) aca- 18 demic years. 19 (2) A pupil who first enrolls in grade twelve (12) may not enroll in 20 postsecondary courses under the provisions of this chapter for secondary 21 credit for more than the equivalent of one (1) academic year. 22 (3) A pupilshallmay also be enrolled in 23 courses for secondary credits approved by the local school district . 24for a minimum ofIf a pupil's enrollment pursuant to 25 this chapter decreases the pupil's instructional time in the local school dis- 26 trict to less than four (4) hours a day , the pupil shall never- 27 theless be counted as in local school district instructional time for four (4) 28 hours a day for purposes of chapter 10, title 33, Idaho Code . 29 (4) A pupil who has completed course requirements for graduation but who 30 has not received a diploma may participate in the program. 31 (5) A pupil who has graduated from high school cannot participate in the 32 program. 33 SECTION 2. That Section 33-5109, Idaho Code, be, and the same is hereby 34 amended to read as follows: 35 33-5109. CREDITS. (1) A pupil may enroll in a course under the provisions 36 of this chapter for secondary credit, for postsecondary credit or for dual 37 credit. At the time a pupil enrolls in a course, the pupil shall designate the 38 type of credit desired. A pupil taking several courses may designate some for 39 secondary credit, some for postsecondary credit and some for dual credit. 40 (2) A school district shall grant academic credit to a pupil enrolled in 41 a course for secondary credit if the pupil successfully completes the course. 2 1 Four (4) semester college credits equal at least one (1) full year (two 2 (2) semester credits) of high school credit in that subject. Fewer col- 3 lege credits may be prorated. 4 (3) The secondary credits granted to a pupil shall be counted toward the 5 graduation requirements and subject area requirements of the school district. 6 Evidence of successful completion of each course and secondary credits granted 7 shall be included in the pupil's secondary school record. A pupil shall pro- 8 vide the school with a copy of the pupil's grade in each course taken for 9 secondary credit under the provisions of this chapter. Upon the request of a 10 pupil, the pupil's secondary school record shall also include evidence of suc- 11 cessful completion and credits granted for a course taken for postsecondary 12 credit. In either case, the record shall indicate that the credits were earned 13 at a postsecondary institution. 14 (4) If a pupil enrolls in a postsecondary institution after leaving sec- 15 ondary school, the postsecondary institution shall award postsecondary credit 16 for any course successfully completed for secondary credit at that institu- 17 tion. Other postsecondary institutions may award, after a pupil leaves second- 18 ary school, postsecondary credit for any courses successfully completed under 19 the provisions of this chapter. An institution shall not charge a pupil for 20 the award of credit. 21 (5) Postsecondary faculty instructing a course for postsecondary, 22 secondary or dual credit shall not be required to obtain a certificate pursu- 23 ant to chapter 12, title 33, Idaho Code, nor shall the postsecondary faculty 24 be deemed an employee of a school district for any purpose under law.
STATEMENT OF PURPOSE RS08107 To provide that a pupil's enrollment in courses for secondary credits shall be counted as four hours a day for purposes of determining the local district's instructional time even if actual time is less than four hours; and amending Section 335109, Idaho Code, to clarify that four semester college credits shall equal at least two semester credits of high school credit in a particular subject and to clarify that post secondary faculty instructing a course for post secondary, secondary or dual credit shall not be required to obtain a secondary teaching certificate and shall not be deemed an employee of a local school district.
