H0831|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 831 BY APPROPRIATIONS COMMITTEE 1 AN ACT 2 APPROPRIATING MONEYS FROM THE PERMANENT BUILDING FUND TO THE DIVISION OF PUB- 3 LIC WORKS FOR THE VARIOUS PURPOSES SPECIFIED; REAPPROPRIATING CERTAIN 4 UNEXPENDED PROJECT BALANCES; EXPRESSING LEGISLATIVE INTENT CONCERNING THE 5 USE OF MONEYS APPROPRIATED IN THIS ACT; EXEMPTING THE APPROPRIATIONS FROM 6 THE PROVISIONS OF CHAPTER 36, TITLE 67, IDAHO CODE, AND FROM THE PROVI- 7 SIONS OF SECTION 67-3516, IDAHO CODE; AUTHORIZING THE USE OF TAX ANTICIPA- 8 TION NOTES; PROVIDING FOR A TRANSFER OF $2,000,000 FROM THE GENERAL FUND 9 TO THE PERMANENT BUILDING FUND; AND DECLARING AN EMERGENCY FOR SECTIONS 1, 10 2, 3, 4 AND 5 OF THIS ACT. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. There is hereby appropriated from the Permanent Building Fund 13 to the Division of Public Works the following amounts, or so much thereof as 14 in each case may be necessary, for the purpose of paying the cost of any land, 15 building, equipment, or the rebuilding, renovation or repair, of buildings, 16 installations, facilities or structures at the places, institutions and agen- 17 cies, or their successors, including those listed in this section. The Perma- 18 nent Building Fund Advisory Council is hereby authorized and directed to 19 anticipate revenues accruing to the Permanent Building Account for the purpose 20 of undertaking the construction, renovation, repair and acquisitions herein 21 authorized, without delay, and to determine the priority of construction pur- 22 suant to which the work hereunder will be undertaken. 23 A. There is hereby reappropriated from the Permanent Building 18 Fund to the Division of Public Works the unexpended balance of moneys remain- 19 ing from the appropriations made for the following projects: 20 (1) Idaho State Historical Society - Historical Library and Archives 21 Building: Section 3, Chapter 412, Laws of 1996. 22 (2) Department of Correction - ISCI 500-bed Medium-security Facility: 23 Section 2, Chapter 310, Laws of 1995. 24 (3) Department of Law Enforcement - Headquarters Complex and POST Acad- 25 emy: Section 1, Chapter 302, Laws of 1994. 26 (4) Attorney General - Remodel in Joe R. It is the express intention that the moneys appropriated in 45 this act may be made available for matching any allocation of moneys now in 46 existence or hereafter made available by agencies of the United States and/or 47 private donations; and it is further the express intention of the Legislature 48 to authorize the Division of Public Works to expend, for the purpose of paying 49 the cost of any land, building, equipment or the rebuilding, renovation or 50 repair of buildings, moneys appropriated for public works to various agencies 51 as part of the respective agency operating budgets; provided the express 52 approval by the Permanent Building Fund Advisory Council is granted to make 3 1 application for such moneys in each instance. It is further the intention of 2 the Legislature that this authority be effective from the effective date of 3 this act. 4 SECTION 4. All appropriations made herein shall be exempt from the provi- 5 sions of Chapter 36, Title 67, and Section 67-3516, Idaho Code, but shall be 6 available for expenditure only after allotment in accordance with the other 7 provisions of Chapter 35, Title 67, Idaho Code, and all appropriations made 8 hereunder shall be subject to the provisions of Section 67-5711, Idaho Code, 9 except as otherwise provided herein. 10 SECTION 5. The State Treasurer is hereby authorized and directed to 11 anticipate the revenues in the Permanent Building Fund by the issuance of tax 12 anticipation notes in accordance with authority conferred in Sections 63-3201 13 through 63-3204, Idaho Code, and in accordance with the procedures and subject 14 to the limitations provided in those sections, in the same manner as though 15 the revenues in the General Fund were being anticipated. 16 SECTION 6. There is hereby appropriated and the State Controller is 17 directed to transfer the amount of $2,000,000 from the General Fund to the 18 Permanent Building Fund. 19 SECTION 7. An emergency existing therefor, which emergency is hereby 20 declared to exist, Sections 1, 2, 3, 4 and 5 of this act shall be in full 21 force and effect on and after its passage and approval.
