                            HOUSE CONCURRENT RESOLUTION NO. 33

                            BY REVENUE AND TAXATION COMMITTEE


 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
 3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF REVENUE  SHARING,
 4        LOANS AND GRANTS PROGRAMS AND SHARED REVENUE SOURCES.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, it is in the interests of all citizens of Idaho that the tax sys-
 7    tem should be fair and equitable; and
 8        WHEREAS,  a  significant amount of money is received through taxation into
 9    the state treasury and returned to cities, counties  and  other  special  dis-
10    tricts through various revenue-sharing formulas; and
11        WHEREAS,  the  distribution  method  provided in Section 63-3638(e), Idaho
12    Code, is based on economic conditions in 1965, 1966 and 1967, which conditions
13    have changed substantially; and
14        WHEREAS, the formula for distribution of sales tax revenue was  originally
15    intended  as  a  short-term alternative to the business inventory tax, and was
16    not designed to endure as a permanent addition to the tax structure; and
17        WHEREAS, other formulas also distribute funds to the highway  system  from
18    state  revenue and provide significant support to the cities, counties, public
19    schools, community colleges, highway districts and  other  special  districts;
20    and
21        WHEREAS,  additional  grant and loan programs, revenue sharing, and shared
22    revenue sources are involved in water treatment programs, water and sewer sys-
23    tems, law enforcement, health and welfare programs, and many others; and
24        WHEREAS, there is little evidence that the formulas provide the  necessary
25    degree  of  consistency  and responsiveness to the actual needs which exist in
26    the local governmental units, and provide a fair and equitable program of rev-
27    enue sharing; and
28        WHEREAS, changes to established distribution formulas should be done in  a
29    deliberate  and cautious manner, with ample time for all interested parties to
30    present input and concerns, and with time to assemble and analyze  all  neces-
31    sary data.
32        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
33    sion of the Fifty-fourth Idaho Legislature, the House of  Representatives  and
34    the  Senate  concurring therein, that the Legislative Council is authorized to
35    appoint a committee to undertake and complete a study of the revenue  sharing,
36    grant  and  loan  programs and shared revenue sources which affect the cities,
37    counties and other special districts which deliver services to Idaho citizens.
38    The Legislative Council shall determine the number of legislators and  member-
39    ship  from  each house appointed to the Committee and shall authorize the Com-
40    mittee to receive input, advice and assistance from  interested  and  affected
41    parties who are not members of the legislature.
42        BE IT FURTHER RESOLVED that nonlegislative members of the Committee may be
43    appointed  by  the Cochairs of the Committee who are appointed by the Legisla-

 1    tive Council. Nonlegislative members of the advisory committee  shall  not  be
 2    reimbursed  from legislative funds for per diem, mileage or other expenses and
 3    shall not have voting privileges regarding the Committee's recommendations  or
 4    proposed legislation.
 5        BE  IT FURTHER RESOLVED that the Committee shall report its findings, rec-
 6    ommendations and proposed legislation, if any, to the First Regular Session of
 7    the Fifty-fifth Idaho Legislature.

                         S TATEMENT OF PURPOSE

    To authorize the Legislative Council to appoint a committee to
    
    
    undertake and complete a study of Revenue Sharing, Loans and
    
    Grants programs and Shared Revenue Sources.
    
                              FISCAL NOTE
    
    If this resolution is adopted by the Legislature and the 
    committee is appointed by Legislative Council, any necessary 
    legislator travel and per diem expense would be pa d from the 
    existing legislative appropriation to the Senate and the House 
    of Representatives Funding for staff support and expenses would 
    be provided'. from the existing appropriation to the Legislative 
    Council for the Legislative Services Office. There would be no 
    additional impact upon the state general fund as a result of 
    this resolution.
