                            HOUSE CONCURRENT RESOLUTION NO. 50

                               BY WAYS AND MEANS COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
 3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF ISSUES  SURROUND-
 4        ING  THE SEPARATION OF ENVIRONMENTAL MATTERS INTO A DEPARTMENT OF ENVIRON-
 5        MENTAL QUALITY.

 6    Be It Resolved by the Legislature of the State of Idaho:

 7        WHEREAS, during this session, and several other  recent  sessions  of  the
 8    legislature,  there  has  been  consideration and debate of issues surrounding
 9    legislation to establish a separate Department of Environmental Quality; and
10        WHEREAS, proponents, including the Governor of Idaho in his State  of  the
11    State  Address,  have maintained that the goals of protecting human health and
12    the environment can best be achieved by vesting this responsibility in a  sin-
13    gle state department with the sole mission of meeting these goals; and
14        WHEREAS,  complex  issues  of  the rights, powers, duties, budgets, funds,
15    contracts,  rulemaking  proceedings,  administrative  proceedings,   contested
16    cases, civil action and other matters relating to environmental protection are
17    now entwined within the Department of Health and Welfare; and
18        WHEREAS,  careful study of the interests of this state and her citizens in
19    protecting environmental values including, but  not  limited  to,  clean  air,
20    water  and  soil, reducing or eliminating environmental pollution arising from
21    human activities, ensuring the proper treatment, storage and disposal of  haz-
22    ardous wastes and ensuring the proper cleanup and restoration of existing nat-
23    ural resources is vital; and
24        WHEREAS,  it is advisable to establish an interim committee to study these
25    issues and prepare legislation if it is found to be the best approach.
26        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
27    sion  of  the Fifty-fourth Idaho Legislature, the House of Representatives and
28    the Senate concurring therein, that the Legislative Council is  authorized  to
29    appoint  a  committee  to undertake and complete a study of issues surrounding
30    the separation of environmental matters into  a  Department  of  Environmental
31    Quality. The Legislative Council shall determine the number of legislators and
32    membership  from each house appointed to the committee and shall authorize the
33    committee to receive input, advice and assistance from interested and affected
34    parties who are not members of the legislature.
35        BE IT FURTHER RESOLVED that nonlegislative advisors of the  committee  may
36    be  appointed by the cochairs of the committee who are appointed by the Legis-
37    lative Council. Nonlegislative advisors shall not be reimbursed from  legisla-
38    tive  funds  for per diem, mileage or other expenses and shall not have voting
39    privileges regarding the committee's recommendations or proposed legislation.
40        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
41    ommendations and proposed legislation, if any, to the First Regular Session of
42    the Fifty-fifth Idaho Legislature.
