HCR052|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 52 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE EMERGENCY 4 COMMUNICATIONS SYSTEMS IN IDAHO. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, in 1988, the legislature recognized that providing emergency com- 7 munications systems was vital to the welfare of Idaho's citizens and its 8 emerging tourism industry; and 9 WHEREAS, in some rural counties there is not a sufficient population base 10 to provide such a service and these counties are in need of this service 11 because of hazardous occupations and long travel distances to medical 12 providers; and 13 WHEREAS, Section 31-4807, Idaho Code, provides that no city or other 14 agency shall establish an individual emergency communication system once a 15 countywide system as provided in Chapter 48, Title 31, Idaho Code, has been 16 adopted by the board of county commissioners; and 17 WHEREAS, there were two bills introduced into the 1998 Idaho Legislature 18 dealing with the subject of emergency communications: Senate Bill No. 1507 and 19 Senate Bill No. 1514; and 20 WHEREAS, Senate Bill 1507 would have deleted a prohibition against cities 21 establishing an individual emergency communication system once a countywide 22 system is adopted and would have provided that cities within existing consoli- 23 dated emergency communications areas could separate from the consolidated area 24 and operate their own "911" and/or nonemergency communications system upon the 25 majority votes of their city council and it also would have provided for an 26 election to provide the authorization for funding to operate a "911" system; 27 and 28 WHEREAS, Senate Bill 1514 would have brought "radio access lines" (cell 29 phones, mobile phones and other emerging communications technology) into the 30 emergency communications act and would have provided that one-half of the rev- 31 enue from inclusion of radio access lines would be available for counties 32 without "911" or "E-911" services to purchase necessary equipment upon presen- 33 tation of a plan; and 34 WHEREAS, this is a subject that is of statewide importance and deserves 35 further study. 36 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 37 sion of the Fifty-fourth Idaho Legislature, the House of Representatives and 38 the Senate concurring therein, that the Legislative Council is authorized to 39 appoint a committee to undertake and complete a study of Idaho's emergency 40 communications systems and determine structures and funding mechanisms that 41 will encourage efficiencies and cooperation and provide this needed service to 42 all Idahoans as may be cost-effective. The Legislative Council shall determine 43 the number of legislators and membership from each house appointed to the com- 44 mittee and shall authorize the committee to receive input, advice and assis- 2 1 tance from interested and affected parties who are not members of the legisla- 2 ture and the committee may hold meetings outside of Boise. 3 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be 4 appointed by the cochairs of the committee appointed by the Legislative Coun- 5 cil. Nonlegislative members of the advisory committee shall not be reimbursed 6 from legislative funds for per diem, mileage or other expenses and shall not 7 have voting privileges regarding the committee's recommendations or proposed 8 legislation. 9 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 10 ommendations and proposed legislation, if any, to the First Regular Session of 11 the Fifty-fifth Idaho Legislature.
STATEMENT OF PURPOSE RS08168C1 This Resolution's purpose is to authorize Legislative Council to appoint an interim committee to undertake and complete a study of Idaho's emergency communications systems and determine structures and funding mechanisms that will encourage efficiencies and cooperation between cities and counties and provide this needed service to all Idahoans as may be cost effective. FISCAL NOTE If this resolution is adopted by the Legislature and the committee is appointed by Legislative Council, any necessary legislator travel and per diem expense would be paid from the existing legislative appropriation to the Senate and the House of Representatives. Funding for the support staff and expenses would be provided from the existing appropriation to the Legislative council for the Legislative Services Office.
