 1                                   A JOINT MEMORIAL
 2    TO THE PRESIDENT OF THE UNITED STATES,  TO  THE  UNITED  STATES  SECRETARY  OF
 3        TRANSPORTATION,  TO  THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED
 4        STATES IN CONGRESS ASSEMBLED AND TO THE  CONGRESSIONAL  DELEGATION  REPRE-
 5        SENTING THE STATE OF IDAHO.

 6        We,  your Memorialists, the House of Representatives and the Senate of the
 7    State of Idaho assembled in the Second Regular  Session  of  the  Fifty-fourth
 8    Idaho Legislature, do hereby respectfully represent that:

 9        WHEREAS,  the  Intermodal Surface Transportation Efficiency Act (ISTEA) of
10    1991, Public Law 102-240, expired on September 30, 1997, and  federal  surface
11    transportation programs are now being temporarily authorized under the Surface
12    Transportation Extension Act (STEA) of 1997, which expires on May 1, 1998; and
13        WHEREAS,  delay  or  disruption of federal surface transportation funds to
14    the states and local governments would cause serious transportation  and  eco-
15    nomic problems for the states and their citizens; and
16        WHEREAS, the United States Congress is currently considering various bills
17    and amendments concerning a multiyear reauthorization of ISTEA; and
18        WHEREAS,  the  Legislature of the State of Idaho recognizes the many posi-
19    tive aspects of ISTEA which should be retained  in  any  new  federal  surface
20    transportation  authorization  act,  including:  the  need  for development of
21    intermodal transportation systems; the  development  of  partnerships  between
22    federal,  state,  local and tribal governments for the delivery of transporta-
23    tion systems and services; and an increased level of responsibility and flexi-
24    bility given to state, local and tribal governments to  address  their  unique
25    transportation needs and characteristics; and
26        WHEREAS,  ISTEA does need revision in order to eliminate programs that are
27    no longer needed or are unproductive and to remove or revise those  provisions
28    which are overly restrictive on the states.
29        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
30    sion of the Fifty-fourth Idaho Legislature, the House of  Representatives  and
31    the  Senate  concurring therein, that the Congress of the United States adopt,
32    in as timely a manner as possible, a multiyear federal surface  transportation
33    program reauthorization legislation which:
34        1.   Increases  total  federal  funding  for highways to the maximum level
35             sustainable by federal law, including spending  authority  for  funds
36             derived  from  transfer  of 4.3[ in motor fuel taxes from the General
37             Fund to the Highway Trust Fund;
38        2.   Includes fair and equitable  formulas  for  distribution  of  federal
39             highway  funds,  based  on  the extent and use of the highway system,
40             both rural and urban;
41        3.   Recognizes the national interest in federal lands  and  the  economic
42             impact on states with a large percentage of federal lands;
43        4.   Streamlines and simplifies ISTEA by reducing regulations and mandates
44             on the states;

 1        5.   Provides  greater flexibility for state and local highway programs to
 2             spend funds in accordance with their unique transportation character-
 3             istics and priorities.
 4        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
 5    tives  be, and she is hereby authorized and directed to forward a copy of this
 6    Memorial to President Bill Clinton, Secretary of Transportation Rodney Slater,
 7    the President of the Senate and the Speaker of the House of Representatives of
 8    Congress, and the congressional delegation of the State of Idaho in  the  Con-
 9    gress of the United States.

                          STATEMENT OF PURPOSE

    The purpose of this Memorial is to strongly encourage the U.S. 
    Congress to enact a new Intermodal Surface Transportation 
    Efficiency Act (ISTEA).
    
    Congress adopted a 6-month Short Term Extension Act (STEA) 
    which will expire on May 1, 1998.
    
    Without a reauthorization, Idaho will be left with only state 
    funds to operate our transportation programs.
    
                               FISCAL NOTE
    
    Idaho's portion of the 6-month extension is $52.9 million. The loss 
    could be approximately double if not reauthorized or extended.
