                             SENATE BILL NO. 1323, As Amended

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE IDAHO  BOARD  OF  CHIROPRACTIC  PHYSICIANS;  AMENDING  SECTION
 3        54-709,  IDAHO  CODE,  TO  DELETE  THE  REQUIREMENT  OF GRADUATION FROM AN
 4        ACCEPTABLE SCHOOL OF CHIROPRACTIC FOR LICENSURE AND TO REQUIRE  COMPLETION
 5        OF  EDUCATIONAL  REQUIREMENTS  AS  ESTABLISHED BY BOARD RULE; AND AMENDING
 6        CHAPTER 7, TITLE 54, IDAHO CODE, BY THE ADDITION OF A NEW SECTION  54-716,
 7        IDAHO  CODE,  TO  REQUIRE LICENSED CHIROPRACTORS TO CARRY ERRORS AND OMIS-
 8        SIONS INSURANCE, TO PROVIDE FOR COVERAGE REQUIREMENTS, AND TO PROVIDE THAT
 9        THE SECTION SHALL BECOME EFFECTIVE AS A CONDITION OF GRANTING OR  RENEWING
10        ACTIVE LICENSES ON JULY 1, 1999, AND THEREAFTER.

11    Be It Enacted by the Legislature of the State of Idaho:

12        SECTION  1.  That  Section  54-709, Idaho Code, be, and the same is hereby
13    amended to read as follows:

14        54-709.  LICENSURE BY WRITTEN EXAMINATION. (1) Any person  seeking  to  be
15    licensed to practice chiropractic in this state must successfully complete the
16    following requirements before a license will be issued:
17        (a)  Each  applicant  must  submit  a completed written application to the
18        board on forms furnished by the board,  which shall require proof  of
19        graduation  from an acceptable school of chiropractic;   accom-
20        panied by satisfactory evidence of completion of the educational  require-
21        ments established in rules promulgated by the board.
22             (i)   The  rules  shall  require  that an application for the license
23             that is received after June 30, 2001, be accompanied by  satisfactory
24             evidence  that the applicant received a bachelor's degree from a col-
25             lege or university  accredited  by  an  accrediting  body  listed  as
26             nationally  recognized  by the secretary of the federal department of
27             education prior to entering chiropractic college; and
28             (ii)  That the applicant has graduated from a college of chiropractic
29             approved by the examining board. 
30        (b)  Each applicant must pass an examination conducted by or acceptable to
31        the board which shall thoroughly test the applicant's fitness to  practice
32        chiropractic. Such examinations must include, but shall not be limited to,
33        the  following  subjects:  anatomy and histology; clinical blood chemistry
34        and hematology; pathology; bacteriology; clinical nutrition;  hygiene  and
35        sanitation; physiology; symptomatology; urinalysis; chiropractic jurispru-
36        dence;  chiropractic  orthopedics; physiotherapy; chiropractic principles,
37        clinical and physical diagnosis; chiropractic adjustment;  neurology,  and
38        palpation.
39        (2)  If  an  applicant  fails  to  pass an examination on two (2) separate
40    occasions, he shall not be eligible to take the examination again for at least
41    one (1) year, and before taking the examination again, he must make a  showing
42    to  the  board  that  he has successfully engaged in a course of study for the
43    purpose of improving his ability to engage in the  practice  of  chiropractic.

 1    Applicants  who fail two (2) separate examinations in another state, territory
 2    or district of the United States or Canada, must make a showing to  the  board
 3    of  successful completion of a course of study prior to examination for licen-
 4    sure.
 5        (3)  Applicants may be personally interviewed by the board or a designated
 6    committee of the board. The interviews may be conducted to specifically review
 7    the applicant's qualifications and  professional  credentials.  The  applicant
 8    shall  be  further  examined by the board to determine that the applicant pos-
 9    sesses the arts and skills of chiropractic adjusting.

10        SECTION 2.  That Chapter 7, Title 54, Idaho Code,  be,  and  the  same  is
11    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
12    known and designated as Section 54-716, Idaho Code, and to read as follows:

13        54-716.  ERRORS AND OMISSIONS INSURANCE.  Each licensee  who  is  actively
14    licensed  under  this chapter shall, as a condition to licensing, carry errors
15    and omissions insurance with an insurance company authorized to do business in
16    Idaho to cover all licensed activities under the provisions of this chapter.
17        (1)  The board shall determine by rule the terms and conditions of  cover-
18    age  required  under the provisions of this section including, but not limited
19    to, the minimum limits of coverage, the permissible deductible and the permis-
20    sible exemptions.
21        (2)  A certificate of coverage, showing compliance with the required terms
22    and conditions of coverage, shall be filed  with  the  board  by  the  license
23    renewal date by each licensee.
24        (3)  The  errors and omissions insurance coverage required in this section
25    shall become effective as a condition of granting a  license  or  renewing  an
26    active license on July 1, 1999, and thereafter.

    STATEMENT OF PURPOSE

   Idaho Board of Chiropractic Physicians Amend existing statute by deleting the requirement 
    of graduation from an acceptable school of chiropractic and adding completion of education 
    requirements as established by board rule; and to require licensed chiropractors to carry 
    errors and omissions insurance and setting for the requirements, this section shall become 
    effective as a condition of license granting or renewing active licenses on July 1, 1999 and 
    thereafter.
    
    
    FISCAL IMPACT
    There is no fiscal impact to the General Fund or dedicated funds.
