S1375|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1375 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO PURCHASES BY GOVERNMENTAL ENTITIES; AMENDING SECTION 67-2349, 3 IDAHO CODE, TO ADD SERVICES TO THE LIST FOR PREFERENCE OF IDAHO SUPPLIERS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 67-2349, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 67-2349. PREFERENCE FOR IDAHO SUPPLIERS FOR PURCHASES. To the extent per- 8 mitted by federal laws and regulations, whenever the state of Idaho, or any 9 department, division, bureau or agency thereof, or any city, county, school 10 district, irrigation district, drainage district, sewer district, highway dis- 11 trict, good road district, fire district, flood district, or other public 12 body, shall let for bid any contract for purchase of any materials, 13 supplies , services or equipment, the bidder domiciled outside the 14 boundaries of Idaho shall be required, in order to be successful, to submit a 15 bid the same percent less than the lowest bid submitted by a responsible bid- 16 der domiciled in Idaho as would be required for such an Idaho domiciled bidder 17 to succeed over the bidder domiciled outside Idaho on a like contract being 18 let in his domiciliary state. 19 For the purposes of this section, any bidder domiciled outside the bound- 20 aries of the state of Idaho may be considered as an Idaho domiciled bidder, 21 provided that there exists for a period of one (1) year preceding the date of 22 the bid a significant Idaho economic presence as defined herein. A significant 23 economic presence shall consist of the following: 24 (a) That the bidder maintain in Idaho fully staffed offices, or fully 25 staffed sales offices or divisions, or fully staffed sales outlets, or manu- 26 facturing facilities, or warehouses or other necessary related property; and 27 (b) If a corporation be registered and licensed to do business in the 28 state of Idaho with the office of the secretary of state.
STATEMENT OF PURPOSE RS07680 This legislation is designed to ensure a good business climate for Idaho service providers by requiring service contracts to be awarded on the same basis as contracts for the purchase of materials, supplies and equipment, with the same preference for Idaho businesses. The method of determining the rank-order of bids remains the same, as does the criteria for determining when an out-of-state business may be considered to be also domiciled in Idaho. FISCAL NOTE The minimal impact this bill might have on state agencies by encouraging more bids from Idaho service providers would be more than offset by the increased contribution of Idaho service providers to the state and local economy.
