S1387|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1387 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO NOTARIES PUBLIC; AMENDING SECTION 51-106, IDAHO CODE, TO PROVIDE 3 REQUIREMENTS FOR THE OFFICIAL SEAL OF A NOTARY PUBLIC WHOSE CURRENT COM- 4 MISSION BECOMES EFFECTIVE ON OR AFTER JULY 1, 1998, AND TO MAKE TECHNICAL 5 CORRECTIONS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 51-106, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 51-106. SEAL. (1) Each notary public whose current commission 10 became effective prior to July 1, 1998, shall provide and keep an offi- 11 cial seal which shall conform to one (1) of the following config- 12 urations: 13 (a) A seal embosser engraved with the words "Notary Public"14, " the notary public's name, and the words "State of 15 Idaho." 16 (b) A rubber stamp with a serrated or milled edge border in rectangular 17 or circular form, which contains the same information required for the 18 seal embosser. 19 (2) Each notary public whose current commission became effective on 20 or after July 1, 1998, shall provide and keep an official seal which shall be 21 a rubber stamp with a serrated or milled edge border in a rectangular or cir- 22 cular form, which includes the words "Notary Public," the notary public's 23 name, the words "State of Idaho," and nothing more. 24 (3) The seal shall be impressed below or near the notary public's 25 official signature on each notary certificate which he administers.

This bill amends the Idaho Notary Public Act to require the use by notaries of a rubber
stamp seal. rather than giving a choice between an embosser and a rubber stamp. The
reason is that the increasing use of fax and digital scanning technologies has made the use
of embosser seals problematic, in that they are not visible on faxed or scanned images.
For example. the secretary of state must keep a copy of the impression of each notary's
seal. which is stored in a digital imaging system. The only way in which to make an
embossed seal impression visible is to brush a pencil over it before scanning, and even
then the quality is marginal. The same problem occurs in business contexts.
