 1                                        AN ACT
 2    RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-417, IDAHO  CODE,  TO  PROVIDE
 3        FOR  SELECTION OF ANY ONE OF TWO IDAHO WILDLIFE SPECIAL LICENSE PLATES, TO
 4        PROVIDE FEES, TO PROVIDE THAT SOME FEES SHALL BE TREATED AS  CONTRIBUTIONS
 5        TO  THE NONGAME WILDLIFE PROGRAM, TO AUTHORIZE THE DESIGN OF MORE THAN ONE
 6        WILDLIFE LICENSE PLATE, TO PROHIBIT USE OF MORE THAN TWO DIFFERENT DESIGNS
 7        AT ANY ONE TIME AND TO PROVIDE THAT SOME FEES SHALL BE USED  TO  FUND  THE
 8        COST OF ADMINISTRATION OF THE SPECIAL LICENSE PLATE PROGRAM.

 9    Be It Enacted by the Legislature of the State of Idaho:

10        SECTION  1.  That  Section  49-417, Idaho Code, be, and the same is hereby
11    amended to read as follows:

12        49-417.  IDAHO WILDLIFE SPECIAL PLATES. (1) On and after July 1,  199
13    3    8  , any person who is the owner of a vehicle registered
14    under the provisions of section 49-402, Idaho Code, may apply  for    any
15    one (1) of two (2)  Idaho wildlife special license plates.
16        (2)  In  addition  to  the  regular  operating fee, the applicant shall be
17    charged a fee of thirty-five dollars ($35.00) for the initial issuance of  the
18    plates, and twenty-five dollars ($25.00) upon each succeeding annual registra-
19    tion.  Twenty-five  dollars  ($25.00)  of  the initial fee and fifteen dollars
20    ($15.00) of the renewal fee shall be deposited in the  state  highway  account
21    and  shall  be used to fund the cost of administration of this special license
22    plate program. Ten dollars ($10.00)  of  each  initial  fee  and  ten  dollars
23    ($10.00)  of each renewal fee shall be deposited by the state treasurer in the
24    fish and game set-aside account pursuant to section 36-111,  Idaho  Code,  for
25    use  in  the  nongame    management  and protection   wildlife
26     program.   This fee shall be treated  as  a  contribution  to  the
27    nongame  wildlife  program, and shall not be considered a motor vehicle regis-
28    tration fee as described in section 17, article VII, of  the  constitution  of
29    the state of Idaho. 
30        Whenever title or interest in a vehicle registered under the provisions of
31    this  section  is  transferred or assigned, the owner may transfer the special
32    plates to another vehicle upon payment of the required transfer fees.  He  may
33    only display the plates after receipt of new registration from the department.
34        (3)   The   Each  Idaho wildlife license plate shall
35    be  of  a  color  and design acceptable to the board of directors of the Idaho
36    fish and wildlife foundation and approved by the department, utilizing a  num-
37    bering  system as determined by the department.  The Idaho fish and wild-
38    life foundation is authorized to design more than one (1) wildlife plate,  but
39    the  department may not allow more than two (2) different designs to be in use
40    at any one (1) time.   Initial costs  of  the  plate  program  including
41    costs  of  plate  design  shall be paid by the  board of directors of the
42     Idaho fish and wildlife foundation.
43        (4)  Sample Idaho wildlife plates may be purchased for  a  fee  of  thirty

 1    dollars  ($30.00),  twelve dollars ($12.00) of which shall be deposited in the
 2    state highway account  and   to be used to fund  the  cost  of
 3    administration  of  this  special  license  plate  program.  E    e
 4    ighteen  dollars  ($18.00)  of  which   the purchase fee
 5     shall be deposited in the fish and game set-aside account  pursuant  to
 6    section  36-111,  Idaho Code, for use in the nongame  management and pro-
 7    tection   wildlife  program.

    This legislation amends section 49-417 to provide for selection of one of two Idaho Wildlife 
    Special License plates, to provide that some of the fees generated from these plates shall 
    be treated as contributions to the Nongame Wildlife Program, and to provide language 
    currently absent for personalized Idaho Wildlife Special License plates and fees. This 
    amendment authorizes the design of more than one wildlife license plate, prohibits use of 
    more than two different designs at any one time, and provides that some fees shall be used 
    to fund the cost of administration of the special license plate program.
    
    The Nongame Wildlife Program, including watchable wildlife, is responsible for 80% of 
    Idaho's wildlife species, yet is funded primarily through contributions to the income tax 
    checkoff, the purchase of wildlife plates, the sale of goods, direct donations, and federal 
    grants. As Idaho's human population grows, so too does the demand for information and 
    opportunities to view and enjoy wildlife. The sale of wildlife plates with the bluebird design 
    has flattened, and the availability of an additional plate will add revenue to help meet the 
    demands of a growing constituency.
    
                                     
                                     
                               FISCAL IMPACT
    
    
    
    For the 5-year period beginning in July 1993, when the wildlife plate was first available, 
    sales of plates have generated approximately $871,000 for the Idaho Department of 
    Transportation (IDT) and $458,000 for the Idaho Department of Fish and Game. It is 
    projected that a second wildlife plate would generate an additional $2,365,000 for the IDT 
    and $1,200,000 for the IDFG during a 5-year period beginning in July 1998.
