                                   SENATE BILL NO. 1398

                          BY RESOURCES AND ENVIRONMENT COMMITTEE

 1                                        AN ACT
 2    RELATING TO FISH AND GAME; AMENDING CHAPTER 15, TITLE 36, IDAHO CODE,  BY  THE
 3        ADDITION  OF  A  NEW  SECTION  36-1512, IDAHO CODE, TO PROVIDE LEGISLATIVE
 4        FINDINGS AND A DECLARATION OF THE RIGHT TO HUNT, FISH AND TRAP.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Chapter 15, Title 36, Idaho Code, be,  and  the  same  is
 7    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
 8    known and designated as Section 36-1512, Idaho Code, and to read as follows:

 9        36-1512.  LEGISLATIVE FINDINGS AND DECLARATION OF RIGHT TO HUNT, FISH  AND
10    TRAP. The legislature finds that:
11        (1)  Hunting,  fishing and trapping activities have played a critical role
12    in the development of the human species and are central  to  the  heritage  of
13    this state;
14        (2)  These  activities  are  practiced  and enjoyed by a large part of the
15    population;
16        (3)  The state's unique geography and wild lands  provide  a  setting  for
17    these activities that is unparalleled in the United States;
18        (4)  These  activities  provide vital social and financial benefits to the
19    state that cannot be reproduced in any other way; and
20        (5)  Protection of hunting, fishing and trapping opportunities is critical
21    to the well-being of the state and its citizens.
22        Therefore, the legislature declares that the citizens of Idaho have a nat-
23    ural and inalienable right to hunt, fish, and take game in a safe,  sustained-
24    yield  manner,  subject  only  to  reasonable restrictions related to harvest,
25    licensure, seasons, limits, and methods, times, and locations  of  taking,  as
26    prescribed by law.

                            STATEMENT OF PURPOSE
    
    The purpose of this legislation is to create a new section 36-1512, Idaho Code, to provide that the 
    citizens of Idaho have a natural and inalienable right to hunt, fish, and take game in a safe, 
    sustained-yield manner, subject only to reasonable restrictions related to harvest, licensure, 
    seasons, limits, and methods, times, and locations of taking, as prescribed by law.
