                                   SENATE BILL NO. 1443

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO COURT REPORTERS; AMENDING SECTION 1-1108, IDAHO CODE,  TO  PROVIDE
 3        FOR COURT REPORTERS ACCRUING AND TAKING SICK AND VACATION LEAVE.

 4    Be It Enacted by the Legislature of the State of Idaho:

 5        SECTION  1.  That  Section  1-1108, Idaho Code, be, and the same is hereby
 6    amended to read as follows:

 7        1-1108.  DEPUTY AND ASSISTANTS -- APPOINTMENT,  DUTIES  AND  COMPENSATION.
 8    When owing to the absence,  vacation leave,  sickness or other dis-
 9    ability of the regular reporter, or when the business of the court demands it,
10    the  court  may  appoint  a  substitute or deputy court reporter to act in the
11    place of the regular reporter during such absence, sickness or other  disabil-
12    ity  of  the  regular reporter.  Such substitute or deputy reporter shall
13    perform the same duties prescribed by law for the regular reporter, give  such
14    bond  as  is required by the court, take the same oath, and shall receive such
15    compensation as may be allowed by the court when employed owing to the absence
16    of such regular reporter, to  be  paid  out  of  the  salary  of  the  regular
17    reporter,  but when such absence is on account of sickness then such compensa-
18    tion shall be paid out of the state treasury as the regular reporter's  salary
19    is paid: provided, that such compensation shall only be paid for the time such
20    deputy  reporter is actually engaged in such work: and, provided further, that
21    in all criminal cases where, in the opinion of the court,  the  notes  of  the
22    court  reporter  should be extended for use upon the trial of the cause, or in
23    civil cases where in the opinion of  the  court,  the  services  of  a  deputy
24    reporter are required, the court may appoint an additional or substitute court
25    reporter,  to aid the regular court reporter in reporting such causes, and who
26    shall be paid a sum to be fixed by the court, to be paid as is the  salary  of
27    the  regular court reporter   Reporters shall accrue vacation leave
28    and sick leave time and may take vacation leave time or sick leave time in the
29    same manner as other employees of the court .
30        When in the opinion of the court, or of the judge thereof, the services of
31    one (1) or more persons are required to assist in the making of transcripts of
32    testimony, the court or judge may by order authorize the  reporter  to  employ
33    such  persons  as  may be necessary to facilitate the work in order that tran-
34    scripts may be prepared without delay. Such assistants shall  be  entitled  to
35    charge  and  receive  for their services in the preparation of transcripts the
36    fees allowed by law therefor, the same to be paid by  the  reporter  from  the
37    money received by him for such work.

                           STATEMENT OF PURPOSE
                                     
    
    The purpose of this legislation Is to provide funding for replacement court 
    reporters while official court reporters take accrued vacation leave. 
    Currently, when an official court reporter takes vacation leave, the reporter 
    is required to personally reimburse a replacement reporter. Reporters are 
    the only state employees who are required to reimburse a replacement 
    out of their own salary.
    
    Official court reporters accrue vacation time the same as other state 
    employees. Official court reporters should be able to use their vacation 
    leave like all other state employees and not be required to reimburse a 
    replacement out of their salaries.
    
                                FISCAL NOTE
    
    There are 37 court reporters who accrue vacation leave of 12, 15, 18, or 
    21 days annually. This amount will vary depending on the number of 
    vacation days accrued by each reporter and the number of vacation days 
    a replacement reporter is actually required. Estimating high with 112 of the 
    37, fiscal impact would be $57,000.
