S1444|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1444 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE COMMISSION OF PARDONS AND PAROLE; AMENDING SECTION 20-210, 3 IDAHO CODE, TO DELETE CERTAIN QUALIFICATIONS FOR MEMBERS OF THE COMMIS- 4 SION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 20-210, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 20-210. COMMISSION OF PARDONS AND PAROLE -- APPOINTMENT -- QUALIFICATIONS 9 -- TERMS -- SALARY -- STAFF. The board shall appoint a state commission of 10 pardons and parole, each member of which shall be subject to the advice and 11 consent of the senate, in this chapter referred to as the commission, which 12 shall succeed to and have all rights, powers and authority of said board of 13 pardons as are granted and provided by the provisions of the constitution of 14 the state of Idaho. 15 The commission shall be composed of five (5) members, with due16regard for their experience, knowledge and interest in sociology, psychology,17rehabilitative services and similar pertinent disciplines. The members 18 shall serve at the pleasure of the board and not more than three (3) members 19 shall be from any one (1) political party. 20 The members of the commission shall be appointed for the purposes of orga- 21 nization as follows: One (1) member is to be appointed for one (1) year, one 22 (1) for two (2) years, one (1) for three (3) years, one (1) for four (4) years 23 and one (1) for five (5) years, with each succeeding vacancy to be filled by 24 the board for terms of five (5) years; vacancies in the commission for unex- 25 pired terms shall be by appointment by the board for the remainder of the term 26 and all appointees may be reappointed. 27 The commission shall also act as the advisory commission to the board on 28 matters of adult probation and parole and may exercise such powers and duties 29 in this respect as are delegated to it by the board. 30 The commission shall meet at such times and places as determined to be 31 necessary and convenient, or at the call of the executive director and in any 32 event no less than quarterly. 33 The members shall be compensated as provided by section 59-509(i), Idaho 34 Code, when attending quarterly meetings conducted at a date and time separate 35 from a hearing session or other meetings approved by the executive director. 36 The members shall receive compensation of one hundred fifty dollars ($150) per 37 member per day when conducting parole, commutation, pardon, revocation or 38 other hearings, and shall be reimbursed for actual and necessary expenses sub- 39 ject to the limitations provided in section 67-2008, Idaho Code. 40 The board will liberally allow the reasonable payment for services of such 41 technical and professional advice and consultation as the commission may 42 require. The board shall appoint the executive director for the commission. 2 1 The executive director shall be the full-time employee who shall report to, 2 serve at the pleasure of, and be compensated as determined by the board. The 3 executive director shall be the official representative for the commission, 4 shall be responsible for the managing and administration of daily commission 5 business and shall schedule hearing sessions at times convenient to the mem- 6 bers of the commission. For each scheduled session, the executive director 7 shall designate one (1) of the members of the commission as the presiding 8 officer for conducting the hearings. The executive director may hire such 9 staff and employees as are approved by the board. The executive director shall 10 also have such other duties and responsibilities as the board shall assign.
STATEMENT OF PURPOSE RS 07852 The purpose of RS07852 is to amend Section 20-210, Idaho Code. The modifications to the statue removes subject criteria for Commission appointments.
