 1                                        AN ACT
 2    RELATING TO USE OF UNUSED SICK LEAVE  BY  STATE  EMPLOYEES;  AMENDING  SECTION
 3        67-5339, IDAHO CODE, TO INCREASE THE MAXIMUM AMOUNT OF SICK LEAVE THAT MAY
 4        BE  COUNTED  FOR  DETERMINING  THE MONETARY VALUE OF UNUSED SICK LEAVE FOR
 5        RETIREMENT PURPOSES FOR EMPLOYEES WITH A CERTAIN LONGEVITY; AND  PROVIDING
 6        AN EFFECTIVE DATE.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That  Section 67-5339, Idaho Code, be, and the same is hereby
 9    amended to read as follows:

10        67-5339.  USE OF UNUSED SICK LEAVE. (1) Upon separation from state employ-
11    ment by retirement in accordance with chapter 13, title 59 or chapter 1, title
12    33, Idaho Code, an employee's unused sick leave shall be determined  based  on
13    accumulated  sick  leave  earned  subsequent  to  July  1,  1976, and shall be
14    reported by the employer to the public employee retirement system. A sum equal
15    to one-half (1/2), or the maximum amount allowed  by  subsection  (2)  hereof,
16    whichever is the lesser, of the monetary value of such unused sick leave, cal-
17    culated  at the rate of pay for such employee at the time of retirement, shall
18    be transferred from the sick leave account provided by subsection (3) of  this
19    section and shall be credited to such employee's retirement account. Such sums
20    shall  be  used by the Idaho Public Employees Retirement Board to pay premiums
21    for such group health, accident, and life insurance programs as may  be  main-
22    tained  by  the  state,  to the extent of the funds credited to the employee's
23    account pursuant to this section. Upon an  employee's  death,  any  unexpended
24    sums remaining in the account shall revert to the sick leave account.
25        (2)  For  the  purposes  of  determining the monetary value of unused sick
26    leave, the maximum unused sick leave which may be considered, shall be:
27        (a)  During the first ten thousand four hundred (10,400) hours of credited
28        state service, the maximum unused sick leave which may be considered shall
29        be  one   two  hundred  ninety-two (192) 
30         forty (240)  hours;
31        (b)  During the second ten thousand four hundred (10,400) hours  of  cred-
32        ited  state service, the maximum unused sick leave which may be considered
33        shall be  two   three   hundred    forty  (240)
34          thirty-six (336)  hours;
35        (c)  During the third ten thousand four hundred (10,400) hours of credited
36        state service, the maximum unused sick leave which may be considered shall
37        be    two     four  hundred  eighty-eight (288)
38           thirty-two (432)  hours; and
39        (d)  Thereafter, the maximum unused sick leave  which  may  be  considered
40        shall  be    three    five  hundred  thirty-six
41        (336)   twenty-eight (528)  hours.
42        (3)  Each employer in state government shall contribute to  a  sick  leave
43    account  maintained  by  the public employee retirement system exclusively for

 1    the purpose of the provisions of this section. The rate of  such  contribution
 2    each pay period shall consist of a percentage of employees' salaries as deter-
 3    mined by the board, and such rate shall remain in effect until next determined
 4    by  the board. Any excess balance in the sick leave account shall be invested,
 5    and the earnings therefrom shall accrue to the sick leave account  except  the
 6    amount  required  by  the  board to defray administrative expenses. All moneys
 7    payable to the sick leave account are hereby perpetually appropriated  to  the
 8    board, and shall not be included in its departmental budget.

 9        SECTION  2.  This  act shall be in full force and effect on and after July
10    1, 1999.

Statement of Purpose / Fiscal Impact


    





                           STATEMENT OF PURPOSE

    The purpose of this legislation is to increase the number of 
    hours of unused sick leave available to help pay for health 
    insurance benefits upon retirement. By allowing increased 
    use of unused sick leave, state employee will have more 
    incentive to remain on the job. Under current law, once an 
    employee reaches the cap, unused hours are lost for the 
    purpose of premium payments upon retirement.
    
                               FISCAL NOTE
    
    Raising the limits will add .35% of pay to the cost of the 
    unused sick leave benefit. It will increase the cost from 
    .65% of pay to 1.00% of pay. This compares to the rate of 
    1.15% for school employees who have unlimited accrual. 
    Effective July 1, 1997, salaries covered by the State unused 
    sick leave program were $511,439,000. Therefore the 
    additional cost of .35% of salaries would be $1,790,036. 
    General fund portion at 59% = $1,059,164.
