                                   SENATE BILL NO. 1468

                               BY TRANSPORTATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO BEAUTIFICATION OF HIGHWAYS; AMENDING SECTION 40-1903, IDAHO  CODE,
 3        TO  PROVIDE  THAT A COUNTY MAY ADOPT REASONABLE LAND USE OR ZONING REGULA-
 4        TIONS AFFECTING THE PLACEMENT AND OPERATION OF JUNKYARDS; AND DECLARING AN
 5        EMERGENCY.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 40-1903, Idaho Code, be, and the same  is  hereby
 8    amended to read as follows:

 9        40-1903.  COUNTY ZONING ORDINANCES. It is the intention of the legislature
10    to  occupy  the whole field of regulation by this chapter, except that nothing
11    in this chapter prohibits enforcement of any or all of its provisions by  per-
12    sons designated to act by appropriate ordinances duly adopted by any county of
13    this  state,  nor does this chapter prohibit the passage by any county of rea-
14    sonable land use or zoning regulations affecting the  placing  of  advertising
15    displays    or the placement and operation of junkyards,  in accor-
16    dance with the provisions of chapter 65, title 67, Idaho Code.

17        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
18    declared to exist, this act shall be in full force and effect on and after its
19    passage and approval.

    This legislation amends Idaho Code to allow counties to adopt reasonable land use on zoning 
    regulations affecting the placement of junkyards.
    
    Fiscal Note
    
    There is no fiscal impact to the State General Fund or to Local Units of Government.
