S1513|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1513, As Amended in the House BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO SALARIES OF MEMBERS OF THE PUBLIC UTILITIES COMMISSION, THE STATE 3 TAX COMMISSION AND THE INDUSTRIAL COMMISSION; REPEALING SECTION 59-510, 4 IDAHO CODE; AMENDING SECTION 61-215, IDAHO CODE, TO INCREASE SALARIES OF 5 MEMBERS OF THE PUBLIC UTILITIES COMMISSION AND TO DELETE AN ARCHAIC REFER- 6 ENCE; AMENDING SECTION 63-102, IDAHO CODE, TO INCREASE SALARIES OF MEMBERS 7 OF THE STATE TAX COMMISSION; AND AMENDING SECTION 72-503, IDAHO CODE, TO 8 INCREASE SALARIES OF MEMBERS OF THE INDUSTRIAL COMMISSION, TO DELETE AN 9 ARCHAIC REFERENCE AND TO PROVIDE THAT EACH MEMBER SHALL DEVOTE FULL TIME 10 TO THE PERFORMANCE OF HIS DUTIES. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Section 59-510, Idaho Code, be, and the same is hereby 13 repealed. 14 SECTION 2. That Section 61-215, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 61-215. SALARIES OF PUBLIC UTILITIES COMMISSIONERS. Each member of the 17 public utilities commission shall devote full time to the performance of his 18 duties and shall each receive an annual salary as follows:Commencing on19July 1, 1993, an annual salary of sixty thousand dollars ($60,000); commencing20on July 1, 1994, an annual salary of sixty-five thousand dollars ($65,000);21and commencing on July 1, 1995, an annual salary of seventy thousand dollars22($70,000), notwithstanding the provisions of section 59-510, Idaho Code23 Commencing on July 1, 1998, an annual salary of seventy-three thousand 24 dollars ($73,000) , and shall be paid from sources set by the legisla- 25 ture. 26 SECTION 3. That Section 63-102, Idaho Code, be, and the same is hereby 27 amended to read as follows: 28 63-102. ORGANIZATION -- CHAIRMAN -- COMPENSATION -- QUORUM -- HEARINGS. 29 (1) A member of the state tax commission shall be appointed by the governor, 30 to serve at his pleasure, as chairman. Each member of the state tax commission 31 shall devote full time to the performance of duties and shall receive an 32 annual salary offiftysixty -five thousand dollars 33 ($56 5,000) .notwithstanding the34provisions of section 59-510, Idaho Code.35 (2) A majority of the state tax commission shall constitute a quorum for 36 the transaction of business. The state tax commission may delegate to any mem- 37 ber of the commission or to its employees, the power to make investigations 38 and hold hearings at any place it may deem proper, and such other matters as 39 will facilitate the operations of the commission. 40 (3) The chairman of the state tax commission shall delegate to each com- 2 1 missioner the responsibility for policy management and oversight of one (1) or 2 more of the taxes collected and/or activities supervised or administered by 3 the commission. The state tax commission shall perform the duties imposed upon 4 it by law and shall adopt all rules by majority decision. 5 In any case in which the state tax commission sits as an appellate body 6 upon an appeal from a tax decision from one (1) of the various administrative 7 units subject to its supervision, the state tax commissioner charged with 8 responsibility for policy management and oversight of the tax in controversy 9 shall not vote upon the appeal but may advise the remaining members of the 10 commission on the technical aspects of the problems before them. 11 (4) The chairman shall be the chief executive officer and administrative 12 head of the state tax commission and shall be responsible for, or may assign 13 responsibility for, all personnel, budgetary and/or fiscal matters of the 14 state tax commission. 15 SECTION 4. That Section 72-503, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 72-503. SALARY. The annual salary of each member of the industrial com- 18 mission shall besixty-sixseventy-three thousand 19seven hundred ninety-fourdollars ($66,79420 73,000 ),notwithstanding the provisions of section 59-510, Idaho21Code,and shall be paid from sources set by the legislature. Each 22 member of the industrial commission shall devote full time to the performance 23 of his duties.
STATEMENT OF PURPOSE RS 08122 This legislation increases the annual salaries of the Public Utility Commissioners from $70,000 to $75,000, State Tax Conunissioners from $55,000 to $65,000, and Industrial Commissioners from $66,794 to $73,000. FISCAL NOTE The fiscal year 1999 impact on the State General Fund is $48,400. Public Utility Commissioners and Industrial Commissioners are paid from dedicated funds.
