SCR139|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 139 BY JUDICIARY AND RULES COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE OUTFIT- 3 TERS AND GUIDES LICENSING BOARD RELATING TO RIVER, LAKE AND RESERVOIR 4 POWER AND FLOAT OUTFITTER LIMITS AND SPECIFYING THAT THE CORRESPONDING 5 TEMPORARY RULE RELATING TO RIVER, LAKE AND RESERVOIR POWER AND FLOAT OUT- 6 FITTER LIMITS NOT BE EXTENDED BEYOND THE ADJOURNMENT OF THE SECOND REGULAR 7 SESSION OF THE FIFTY-FOURTH IDAHO LEGISLATURE. 8 Be It Resolved by the Legislature of the State of Idaho: 9 WHEREAS, the Legislature is vested with authority to reject executive 10 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 11 that the Legislature finds that the rules are not consistent with legislative 12 intent; and 13 WHEREAS, it is the finding of the Legislature that certain rules of the 14 Outfitters and Guides Licensing Board relating to river, lake and reservoir 15 power and float outfitter limits are not consistent with legislative intent 16 and should be rejected. 17 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 18 sion of the Fifty-fourth Idaho Legislature, the Senate and the House of Repre- 19 sentatives concurring therein, that IDAPA 25.01.01.059, rules of the Outfit- 20 ters and Guides Licensing Board relating to river, lake and reservoir power 21 and float outfitter limits, subsection (BO2) Boise River - Downstream westside 22 of the Garden City municipal limits to the confluence with the Snake River, 23 and subsection (PA2) Payette River - Black Canyon Dam to the confluence with 24 the Snake River, adopted as a pending rule under Docket number 25-0101-9701, 25 be, and the same is hereby rejected and declared null, void and of no force 26 and effect. 27 BE IT FURTHER RESOLVED by the members of the Second Regular Session of 28 the Fifty-fourth Idaho Legislature, the Senate and the House of Representa- 29 tives concurring therein, that IDAPA 25.01.01.059, rules of the Outfitters and 30 Guides Licensing Board relating to river, lake and reservoir power and float 31 outfitter limits, subsection (BO2) Boise River - Downstream westside of the 32 Garden City municipal limits to the confluence with the Snake River, and sub- 33 section (PA2) Payette River - Black Canyon Dam to the confluence with the 34 Snake River, adopted as a temporary rule under Docket number 25-0101-9701, and 35 made effective by the Outfitters and Guides Licensing Board on August 15, 36 1997, be, and the same is hereby rejected, and notwithstanding any other con- 37 current resolutions to the contrary, the same is not approved and not extended 38 and pursuant to Section 67-5226, Idaho Code, shall be declared null, void and 39 of no force and effect upon adjournment of the Second Regular Session of the 40 Fifty-fourth Idaho Legislature.
STATEMENT OF PURPOSE RS 08172C1 This resolution would reject certain rules of the Outfitters and Guides Licensing Board relating to river, lake and reservoir power and float outfitter limits on the Payette and Boise Rivers as not consistent with legislative intent.
