SJR105|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE JOINT RESOLUTION NO. 105 BY STATE AFFAIRS COMMITTEE 1 A JOINT RESOLUTION 2 PROPOSING AN AMENDMENT TO SECTION 3, ARTICLE VI, OF THE CONSTITUTION OF THE 3 STATE OF IDAHO, RELATING TO DISQUALIFICATION OF CERTAIN PERSONS, TO DELETE 4 THE PROHIBITION OF A PERSON BEING UNDER GUARDIANSHIP FROM VOTING, SERVING 5 AS JUROR OR HOLDING CIVIL OFFICE; STATING THE QUESTION TO BE SUBMITTED TO 6 THE ELECTORATE; DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE THE STATE- 7 MENTS REQUIRED BY LAW; AND DIRECTING THE SECRETARY OF STATE TO PUBLISH THE 8 AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW. 9 Be It Resolved by the Legislature of the State of Idaho: 10 SECTION 1. That Section 3, Article VI, of the Constitution of the State 11 of Idaho be amended to read as follows: 12 SECTION 3. DISQUALIFICATION OF CERTAIN PERSONS. No person is 13 permitted to vote, serve as a juror, or hold any civil office who 14is under guardianship, or whohas, at any place, been 15 convicted of a felony, and who has not been restored to the rights of 16 citizenship, or who, at the time of such election, is confined in 17 prison on conviction of a criminal offense. 18 SECTION 2. The question to be submitted to the electors of the State of 19 Idaho at the next general election shall be as follows: 20 "Shall Section 3, Article VI, of the Constitution of the State of Idaho be 21 amended to delete the prohibition of a person being under guardianship from 22 voting, serving as a juror or holding any civil office?". 23 SECTION 3. The Legislative Council is directed to prepare the statements 24 required by Section 67-453, Idaho Code, and file the same. 25 SECTION 4. The Secretary of State is hereby directed to publish this pro- 26 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE RS07420 The purpose of this legislation is to provide an opportunity for the citizens of the State of Idaho to amend the Constitution of the State of Idaho to provide that persons under guardianships do not lose their right to vote, serve as a juror, or hold civil office. FISCAL IMPACT Information provided by the Elections Division, Office of the Idaho Secretary of State, indicates that each entry relating to a Constitutional issue which is placed on the ballot would cost approximately $30,000.
