SPEAKER Requested by: Idaho Association of Counties 1 AN ACT 2 RELATING TO THE DISPOSAL OF STOLEN OR EMBEZZLED PROPERTY; AMENDING SECTION 3 19-3805, IDAHO CODE, TO REQUIRE THE COUNTY SHERIFF TO DISPOSE OF THE PROP- 4 ERTY AS REQUIRED FOR OTHER UNNEEDED PROPERTY IN THE POSSESSION OF THE 5 COUNTY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 19-3805, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 19-3805. DELIVERY TO COUNTYTREASURERSHERIFF . 10 If the property stolen or embezzled is not claimed by the owner before the 11 expiration of six (6) months from the conviction of a person for stealing or 12 embezzling it, the magistrate or other officer having it in custody must, on 13 the payment of the necessary expenses incurred in its preservation, deliver it 14 to the countytreasurer, by whom it must be sold and the proceeds paid15into the county treasurysheriff. The county sheriff shall dis- 16 pose of it in accordance with the provisions for the sale of unneeded property 17 in the possession of the county .
STATEMENT OF PURPOSE RS 08432 The purpose of this legislation is to streamline the process for the disposal of unclaimed stolen or embezzled property. This proposal will shift the responsibility from the county treasurer to the board of county commissioners and the county sheriff who are currently charged with the disposal of other unneeded county property. FISCAL IMPACT There will be no fiscal impact on the State General Fund or any political subdivision of the State. Some efficiencies may be gained by consolidating property disposal functions in the office of the sheriff.
