                                    HOUSE BILL NO. 79

                              BY ROBISON, BIETER, AND TRAIL

 1                                        AN ACT
 2    RELATING TO THE MINIMUM WAGE LAW; AMENDING SECTION  44-1504,  IDAHO  CODE,  TO
 3        INCLUDE  AGRICULTURAL  LABOR  WITHIN THE MINIMUM WAGE LAW, TO PROVIDE THAT
 4        OVERTIME PROVISIONS DO NOT APPLY TO AGRICULTURAL LABOR; AND  PROVIDING  AN
 5        EFFECTIVE DATE.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 44-1504, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        44-1504.  EMPLOYEES EXCEPTED FROM PROVISIONS OF  ACT.  The  provisions  of
10    this  act  shall  not apply to any employee employed in a bona fide executive,
11    administrative, or professional capacity,  to agricultural labor as  that
12    term  is  defined  in section 72-1304, Idaho Code,  to anyone engaged in
13    domestic service, to any individual employed as an outside salesman,  to  sea-
14    sonal  employees of a nonprofit camping program, or to any child under the age
15    of sixteen (16) years working part time or at odd jobs not exceeding  a  total
16    of  four (4) hours per day with any one (1) employer.   The overtime pro-
17    visions of this act shall not apply to agricultural  labor  as  that  term  is
18    defined in section 72-1304, Idaho Code. 

19        SECTION  2.  This act shall be in full force and effect on and after Janu-
20    ary 1, 2001.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

This legislation would extend the state minimum wage law to farm
workers effective Jan. 1, 2001. Farm workers with employees who use
more than 500 man hours of labor per quarter (equal to seven full-time employees) are presently covered by the federal minimum wage
law. Others who are not covered receive the minimum wage or
equivalent. But some farm workers receive less than $5.15 per hour.
Farm workers are not covered by overtime provisions under the
federal law and with this legislation they would not be covered
under state law.

                           FISCAL NOTE

There would be no impact in fiscal 2000. In fiscal 2001 it would be
necessary to add one or more employees for enforcement with the
Idaho Department of Labor at a cost of $60,000 or more.
