H0127|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 127 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO BEAN COMMISSION; AMENDING SECTION 22-2912, IDAHO CODE, 3 TO DECREASE THE NUMBER OF MEMBERS, TO REVISE THE NUMBER OF DISTRICTS AND 4 THE GEOGRAPHICAL MAKEUP OF DISTRICTS AND TO INCREASE COMPENSATION FOR MEM- 5 BERS OF THE BEAN COMMISSION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 22-2912, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 22-2912. BEAN COMMISSION CREATED. There is hereby created and established 10 in the department of self-governing agencies the Idaho bean commission, here- 11 inafter called the commission. It shall be composed ofnine (9)12 eight (8) men or women engaged in the bean industry. The commis- 13 sion shall be appointed by the governor, and each member must have been a res- 14 ident of the state of Idaho for a period of three (3) years immediately prior 15 to his appointment, shall have had active experience in growing, processing or 16 shipping of beans produced in the state of Idaho, and at leastfive17four (54 ) members of the commis- 18 sion shall be growers actually engaged in production of beans, but who are not 19 handlers, dealers or processors. One (1) grower member of the commission shall 20 be appointed from each of the districts provided for by this section. The four 21 (4) remaining members of the commission may be engaged in the processing or 22 shipping of beans, at least one (1) of whom must be engaged in the processing 23 or shipping of snap bean seed. The processor or shipper members of the commis- 24 sion shall be appointed at large, keeping in mind insofar as possible geo- 25 graphic locations representative of the Idaho bean industry. The qualifica- 26 tions for membership on the commission shall continue throughout the respec- 27 tive terms of office of the commissioners. Upon recommendation of organiza- 28 tions of producers and shippers of beans,one (1) grower commissioner29shall be appointed from district No. 1, which district shall be composed of30the following counties: Boundary, Bonner, Kootenai, Benewah, Shoshone, Latah,31Clearwater, Nez Perce, Lewis and Idaho;one (1) grower commissioner 32 shall be appointed from district No.21 , which dis- 33 trict shall be composed of the following counties: Adams,Valley, Lemhi,34Custer, Boise,Boundary, Bonner, Kootenai, Benewah, Shoshone, La- 35 tah, Nez Perce, Clearwater, Lewis, Idaho, Washington, Payette, Gem, 36 Canyon and Ada; one (1) grower commissioner shall be appointed from district 37 No.32 , which district shall be composed of the fol- 38 lowing counties: Valley, Lemhi, Custer, Boise, Twin Falls, Owyhee 39 and Elmore; one (1) grower commissioner shall be appointed from district No. 4043 , which district shall be composed of the follow- 41 ing counties: Cassia, Oneida, Power, Bannock, Caribou, Bear Lake, Franklin and 42 Minidoka; one (1) grower commissioner shall be appointed from district No. 4354 , which district shall be composed of the follow- 2 1 ing counties: Camas, Blaine, Gooding, Lincoln, Jerome, Bingham, Bonneville, 2 Butte, Jefferson, Madison, Teton, Fremont and Clark.Commencing on July31, 1971 and July 1, 1973, when the terms of the present commission members4expire, the next regularly appointed grower members for districts No. 1 and5No. 2 will hold office for a term of one (1) year; the next regularly6appointed grower member from district No. 3 will hold office for a term of7four (4) years; the next regularly appointed grower member for district No. 48will hold office for a term of one (1) year; the next regularly appointed9grower member from district No. 5 will hold office for a term of four (4)10years. Also, commencing on July 1, 1971 and July 1, 1973, when the terms of11the present processor or shipper members, who were appointed heretofore from12districts 2, 3, 4 and 5, expire, the processor or shipper members replacing13the heretofore appointed processor or shipper members will serve the following14terms: the processor or shipper member who is appointed to replace the proces-15sor or shipper member appointed from district No. 2 will serve a term of four16(4) years; the processor or shipper member who is appointed to replace the17processor or shipper member appointed from district No. 3 will serve a term of18three (3) years; the processor or shipper member who is appointed to replace19the processor or shipper member appointed from district No. 4 will serve a20term of four (4) years; the processor or shipper member who is appointed to21replace the processor or shipper member appointed from district No. 5 will22serve a term of three (3) years.Commencing on July 1, 1999, the 23 governor shall appoint two (2) members for a one (1) year term, two (2) mem- 24 bers for a two (2) year term, two (2) members for a three (3) year term, and 25 two (2) members for a four (4) year term. Thereafter, the governor 26 shall appoint commissioners as their terms expire. Each commissioner shall 27 serve for a term of four (4) years. Each commissioner shall hold office until 28 his successor has been appointed. 29 A simple majority of members of the commission shall constitute a quorum 30 for the transaction of business and for carrying out the duties of the commis- 31 sion. All commissioners shall take an oath of office before commencing their 32 duties. 33 Each member of the commission shall be compensated as provided by section 34 59-509(jl ), Idaho Code, provided however, that com- 35 pensation paid to members of the commission on and after January 1, 1998, 36 shall not be considered salary as defined in section 59-1302, Idaho Code.

The purpose of this bill is to decrease the number of members on
the Commission Board from nine to eight. It also changes the
geographical areas to move those counties previously represented by
the ninth member into other regions for representation. It revises
the members' terms so that two members are appointed each year.
This bill also raises the member's compensation from fifteen
dollars per day to twentyfive dollars per day.
FISCAL NOTE
There is no fiscal impact to the general fund.
