                            BY REVENUE AND TAXATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO COUNTY BOND ISSUES; AMENDING SECTION 31-1903, IDAHO CODE, TO  PRO-
 3        VIDE  THAT  A COUNTY MAY ISSUE BONDS FOR THE PURCHASE OF PUBLIC OPEN-SPACE
 4        LAND AND/OR EASEMENTS FOR SCENIC AND RECREATIONAL  PURPOSES  AND  TO  MAKE
 5        TECHNICAL CORRECTIONS; AND DECLARING AN EMERGENCY.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 31-1903, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        31-1903.  BUILDING, ROAD,  AND  BRIDGE  ,  AIR  NAVIGATION
10    AND  OPEN-SPACE   BONDS. When the interests of the county require it and
11    the board of commissioners of the county deem it for the public good  to  bond
12    the  county  to  fund or refund the outstanding obligations or indebtedness of
13    the county or bond the county for the purpose of acquiring funds for  purchas-
14    ing  a  site and erecting a courthouse and jail, a public auditorium or a jail
15    thereon, or for the construction or repair of roads or bridges, or  to  assist
16    any city or village in said county in constructing a free bridge over any nav-
17    igable  stream  within, or partly within, or adjoining, the limits of any such
18    city or village, or for purchasing, improving  and  equipping  air  navigation
19    facilities as defined in chapter 4, title 21, Idaho Code, which facilities may
20    be  wholly or partly within or without the limits of such county, or wholly or
21    partly within or without the state of Idaho,  or  for  purchasing  public
22    open-space  land and/or easements for scenic and recreational purposes, 
23    or for any one  (1)  or more said purposes, and the indebtedness or
24    liability of the county that may be created by the bonding, funding or refund-
25    ing aforesaid, or in purchasing a site and erecting a courthouse and  jail,  a
26    public  auditorium  or  a  jail thereon, and for the construction or repair of
27    roads or bridges, or for assisting any city or village in the construction  of
28    any  such free bridge as aforesaid, or for purchasing, improving and equipping
29    air navigation facilities,  or  for  purchasing  public  open-space  land
30    and/or  easements  for scenic and recreational purposes,  or for any one
31     (1)  or more of said purposes, exceeds the income  or  revenue  of
32    the  county  for  that year, the board of commissioners may issue bonds of the
33    county as provided by sections 31-1901 and 31-1902, Idaho  Code,  and  by  the
34    "municipal  bond  law"  of  the state of Idaho: provided, that the issuance of
35    such bonds, except funding or refunding bonds, be first authorized by  a  vote
36    of  two-thirds  (2/3)  of  the  qualified electors of the county, voting at an
37    election held, subject to the provisions of section 34-106,  Idaho  Code,  for
38    that  purpose,  as hereinafter provided and as provided in the "municipal bond
39    law" and, provided, further, that before the  board  of  county  commissioners
40    shall  issue  any bonds to fund or refund the indebtedness of the county as in
41    the section provided, they shall deduct from the  legal  indebtedness  of  the
42    county, at the time of the issue of said bonds, the cash on hand in the county
43    treasury applicable to the discharge of said indebtedness, and may issue bonds

 1    for the remainder of the indebtedness.

 2        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 3    declared to exist, this act shall be in full force and effect on and after its
 4    passage and approval.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

The purpose of this legislation is to amend existing legislation to
allow counties to bond for purchasing public open-space land and/or
easements for scenic and recreational purposes. The issuance of such
bonds must first be authorized by a two-thirds vote of the qualified
electors on one of the four authorized election days as specified in
section 39-106.






                           EISCAL NOTE

Local qualified electors will vote to authorize the county to incur
the indebtedness. The fiscal impact will be locally controlled.
