                         BY RESOURCES AND CONSERVATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO STATE PARKS; AMENDING SECTION 67-4212, IDAHO CODE, TO INCLUDE LAKE
 3        CASCADE STATE PARK AND LAKE WALCOTT STATE PARK IN THE  STATE  PARK  SYSTEM
 4        AND TO MAKE TECHNICAL CORRECTIONS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section 67-4212, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        67-4212.  STATE PARKS LISTED -- CONTROLLED BY PARK AND RECREATION BOARD OF
 9    THE DEPARTMENT OF PARKS AND RECREATION. The following described areas  in  the
10    state  of Idaho, so far as these areas are owned or controlled by the state of
11    Idaho, and used for public, outdoor recreational purposes, are hereby declared
12    to be Idaho state parks, and they are hereby placed under the jurisdiction and
13    control of the park and recreation board of the department of parks and recre-
14    ation of the state of Idaho:
15        (1)  Priest Lake State Park consisting of Indian Creek and Lion Head units
16    on the east shore of Priest Lake to a depth of one thousand (1,000) feet  from
17    the  shoreline  in  Bonner  County.  This park also includes Dickensheet Camp-
18    ground, located on Priest River downstream from Priest Lake in Bonner County.
19        (2)  Round Lake State Park, located on the shores  of  Little  Round  Lake
20    west of State Highway 95 in Bonner County.
21        (3)  Farragut  State  Park,  located  near the village of Bayview, east of
22    State Highway 95 in Kootenai County.
23        (4)  Old Mission State Park, located adjacent  to  Interstate  Highway  90
24    near Cataldo in Kootenai County.
25        (5)  Mowry  State  Park,  located on the south shore of Lake Coeur d'Alene
26    east of U.S. Highway 95 near Worley in Kootenai County.
27        (6)  Heyburn State Park, located on Lake Chatcolet east of U.S. Highway 95
28    in Benewah County.
29        (7)  Mary Minerva McCroskey Memorial State Park, located at and  near  the
30    boundary line between Latah and Benewah Counties and west of U.S. Highway 95.
31        (8)  Dworshak  State  Park,  consisting  of  the  Freeman  Creek and Three
32    Meadows Group Camp areas, located on the shores of Dworshak  Reservoir  north-
33    east of U.S. Highway 12, and leased from the U.S. Army Corps of Engineers.
34        (9)  Hells  Gate State Park, located on the Snake River at Lewiston, Snake
35    River Avenue, Nez Perce County.
36        (10) Winchester Lake State Park, located adjacent to the city of  Winches-
37    ter, on Winchester Lake in Lewis County.
38        (11) Ponderosa  State  Park,  constituted  by all the land of the state of
39    Idaho department of parks and recreation adjacent to Payette  Lake  in  Valley
40    County.  Also  included  in  this  park is the Packer John Cabin Site, located
41    along State Highway 55 near Old Meadows in Adams County.
42        (12) Eagle Island State Park, located on Hatchery Road west of the town of
43    Eagle in Ada County.

 1        (13) Veterans Memorial State Park, located in the city of Boise, on  State
 2    Highway 44 in Ada County.
 3        (14) Lucky  Peak  State Park, constituted by all recreational areas leased
 4    to the state of Idaho on the shores of Lucky Peak Reservoir on the Boise River
 5    in Ada and Boise Counties and the Sandy Point area on the Boise River  in  Ada
 6    County.  Discovery State Park, located approximately eight (8) miles southeast
 7    of Boise between Lucky Peak Dam and Diversion Dam on the Boise River and along
 8    State Highway 21 in Ada County.
 9        (15) Three Island State Park, located adjacent to the City of Glenns Ferry
10    and the Snake River, south of Interstate Highway 84 in Elmore County.
11        (16) Bruneau Dunes State Park, located approximately three (3) miles south
12    of the Snake River near the town of Bruneau and east of State  Highway  51  in
13    Owyhee County.
14        (17) Malad  Gorge  State  Park,  located  on  the Malad River and south of
15    Interstate Highway 84 in Gooding County. Crystal Springs and  Niagara  Springs
16    State Parks located on the Snake River south of Interstate Highway 84 and east
17    of U.S. 30 in Gooding County.
18        (18) City  of  Rocks,  (one  section  of land within the National Reserve)
19    located west of the Village of Almo in Cassia County.
20        (19) Massacre Rocks State Park, located approximately ten (10) miles  west
21    of  American Falls on Interstate Highway 86 in Power County and including Reg-
22    ister Rock.
23        (20) Bear Lake State Park, located on the  east  shoreline  of  Bear  Lake
24    south  of U.S. Highway 30 and east of U.S. Highway 89, north of the Idaho-Utah
25    state line in Bear Lake County. This park also includes the North  Beach  area
26    leased from Utah Power and Light Company.
27        (21) Harriman  State Park, located adjacent to and east of U.S. Highway 20
28    in Fremont County.
29        (22) Henry ' s Lake  State  Park,  located  on  the  shores  of
30    Henry ' s Lake west of State Highway 87 in Fremont County.
31          (23) Lake Cascade State Park, located on the shores of Cascade Res-
32    ervoir in Valley County.
33        (24) Lake Walcott State Park, located on the shores of  Walcott  Reservoir
34    in Minidoka County. 

Statement of Purpose / Fiscal Impact


                       STATEMENT OE PURPOSE

                             RS08626

This legislation adds Lake Cascade State Park and Lake Walcott
State Park to the list of state parks under the jurisdiction and
control of the Park and Recreation Board of the Idaho Department of
Parks and Recreation.

In 1994, the U.S. General Accounting Office found that the U.S.
Bureau of Reclamation (BOR) was exceeding its authority by
operating recreation areas. In response, the BOR sought an
agreement with the state to have the Idaho Department of Parks and
Recreation operate recreation areas at Cascade Reservoir and
Walcott Lake.

In 1996, the Legislature passed HB 764, which authorized the Park
and Recreation Board to enter into agreements with the BOR for the
development and administration of recreation areas at Cascade
Reservoir and Walcott Lake. The current legislation reflects the
execution of those agreements and adds references to Lake Cascade
State Park and Lake Walcott State Park to the appropriate statute,
signifying inclusion in the state park system.

The department's management of Lake Walcott State Park has already
been established. The department is proposing a twenty year
management agreement with the BOR regarding Lake Cascade State
Park. The park exists on federal lands that are adjacent to or used
in connection with the waters of Cascade Reservoir in Valley
County.

Associated with this proposal is the department's request for funds
to continue the operation and maintenance of the recreation
facilities on Lake Cascade State Park. The department took over
operation from BOR on a trial basis in April, 1998. At the time,
the operation was fully funded by the BOR. The trial period will
end July 1, 1999.
                           FISCAL NOTE

Operations at Lake Cascade State Park will be paid by a combination
of funds from BOR, user fees, and an appropriation from the state
General Fund. The BOR has agreed to pay one half of the net cost of
operating the recreational facilities at the park. The state's
share of the operating costs is included in the department's budget
request and is part of the Governor's recommended budget.
