H0186|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 186 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO ATTENDANCE AT SCHOOLS; AMENDING SECTION 33-203, IDAHO CODE, TO 3 ALLOW STUDENTS ATTENDING A PUBLIC CHARTER SCHOOL TO PARTICIPATE IN PUBLIC 4 SCHOOL PROGRAMS UNDER THE DUAL ENROLLMENT PROVISIONS OF LAW. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 33-203, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 33-203. DUAL ENROLLMENT. (1) The parent or guardian of a child of school 9 age who is enrolled in a nonpublic school or a public charter school 10 shall be allowed to enroll the student in a public school for dual 11 enrollment purposes. The board of trustees of the school district shall adopt 12 procedures governing enrollment pursuant to this section. If enrollment in a 13 specific program reaches the maximum for the program, priority for enrollment 14 shall be given to a student who is enrolled full time in the public non- 15 charter school. 16 (2) Any student participating in dual enrollment may enter into any pro- 17 gram in the public school available to other students subject to compliance 18 with the same rules and requirements that apply to any student's participation 19 in the activity. 20 (3) Any school district shall be allowed to include dual-enrolled non- 21 public school and public charter school students for the purposes 22 of state funding only to the extent of the student's participation in the pub- 23 lic school programs. 24 (4) Oversight of academic standards relating to participation in 25 nonacademic public school activities shall be the responsibility of the pri- 26 mary educational provider for that student. In order forthe27 any nonpublic school student or public charter school 28 student to participate in nonacademic public school activities the non- 29 public school or public charter school student shall achieve a 30 minimum score on the achievement test required annually by the state board of 31 education, and that score shall be used to determine eligibility for the fol- 32 lowing year. The student shall be eligible if the minimum composite test score 33 places the student within the average or higher than average range as estab- 34 lished by the test service utilized. 35 (5) A public school student who has been unable to maintain academic eli- 36 gibility is ineligible to participate in nonacademic public school activities 37 as a nonpublic school or public charter school student for the 38 duration of the school year in which the student becomes academically ineligi- 39 ble and for the following academic year. 40 (6) A nonpublic school or public charter school student par- 41 ticipating in nonacademic public school activities must reside within the 42 attendance boundaries of the school for which the student participates. 43 (7) Dual enrollment shall include the option of joint enrollment in a 2 1 regular public school and an alternative public school program. The state 2 board of education shall establish rules that provide funding to school dis- 3 tricts for each student who participates in both a regular public school pro- 4 gram and an alternative public school program. 5 (8) Dual enrollment shall include the option of enrollment in a post- 6 secondary institution. Any credits earned from an accredited post-secondary 7 institution shall be credited toward state board of education high school 8 graduation requirements. 9 (9) A nonpublic student is any student who receives educational instruc- 10 tion outside a public school classroom and such instruction can include, but 11 is not limited to, a private school or a home school.
