BUDGET INFORMATION - STATE AGENCY - Amends and repeals existing law
relating to the state budgeting process to require the submittal of actual
and estimated receipts and expenditures to the Division of Financial
Management and the Legislative Services Office for the Joint
Finance-Appropriations Committee; to allow forms to be in written or
electronic format; to require submission of information to the Legislative
Services Office; to provide that the administrator of the Division of
Financial Management shall, on or before November 20, prepare and submit to
the governor or to the governor-elect information for development of the
executive budget; to revise the statutory procedures for appropriation
bills to be prepared by the Joint Finance-Appropriations Committee; and
repeals the law on the limitation of allotments.

 1                                        AN ACT
 2    RELATING TO THE STATE BUDGET PROCESS; AMENDING SECTION 67-437, IDAHO CODE,  TO
 3        PROVIDE CORRECT STATUTORY CITATIONS AND TO REQUIRE THE SUBMITTAL OF ACTUAL
 4        AND  ESTIMATED RECEIPTS AND EXPENDITURES TO THE DIVISION OF FINANCIAL MAN-
 5        AGEMENT AND  THE  LEGISLATIVE  SERVICES  OFFICE  FOR  THE  JOINT  FINANCE-
 6        APPROPRIATIONS COMMITTEE; AMENDING SECTION 67-3502, IDAHO CODE, TO PROVIDE
 7        FOR  BUDGET FORMS TO BE IN ELECTRONIC FORMAT, TO DELETE REDUNDANT LANGUAGE
 8        AND TO REQUIRE SUBMISSION  OF  INFORMATION  TO  THE  LEGISLATIVE  SERVICES
 9        OFFICE; AMENDING SECTION 67-3505, IDAHO CODE, TO PROVIDE THAT THE ADMINIS-
10        TRATOR  OF THE DIVISION OF FINANCIAL MANAGEMENT SHALL, ON OR BEFORE NOVEM-
11        BER 20, PREPARE AND SUBMIT TO THE GOVERNOR OR TO THE GOVERNOR-ELECT INFOR-
12        MATION FOR DEVELOPMENT OF THE EXECUTIVE BUDGET; AMENDING SECTION  67-3514,
13        IDAHO  CODE, TO REVISE THE STATUTORY PROCEDURES FOR APPROPRIATION BILLS TO
14        BE PREPARED BY THE JOINT FINANCE-APPROPRIATIONS COMMITTEE;  AND  REPEALING
15        SECTION 67-3613, IDAHO CODE.

16    Be It Enacted by the Legislature of the State of Idaho:

17        SECTION  1.  That  Section  67-437, Idaho Code, be, and the same is hereby
18    amended to read as follows:

19        67-437.  DEPARTMENTS, AGENCIES, AND INSTITUTIONS  TO  SUBMIT  INFORMATION.
20    All  departments,  agencies  and  institutions  of  state government which are
21    required by section 67-350 5  2 , Idaho Code, to  submit
22    reports  of actual and estimated receipts and expenditures to the  bureau
23    of the budget   division of financial management  shall  sub-
24    mit  the  same  information  to  the  legislative services office for the
25    joint finance-appropriations  committee, not  later  than  the  deadline
26    prescribed in section 67-350 3  2, Idaho Code .

27        SECTION  2.  That  Section 67-3502, Idaho Code, be, and the same is hereby
28    amended to read as follows:

29        67-3502.  FORMAT AND PREPARATION OF ANNUAL BUDGET REQUESTS. In the  prepa-
30    ration  of a state budget, the administrator of the division of financial man-
31    agement shall, not later than the fifteenth day of July have available for all
32    departments, offices and institutions of the state government forms  necessary
33    to prepare budget requests. Such forms , whether in electronic or written
34    format,  shall be developed by the administrator of the division and the
35    legislative services office to provide the following information:
36        (1)  For  the  preceding  fiscal  year,  each of the entities listed above
37    shall report all funds available to them regardless of source, including  leg-
38    islative appropriations, and their expenditures by fund and object of all sums
39    received from all sources, segregated as provided for on the forms.
40        (2)  For  the current fiscal year, each of the entities listed above shall
41    report their estimates of all funds available to them  regardless  of  source,

 1    including legislative appropriations, and their estimated expenditures by fund
 2    and  object  of all sums received from all sources, segregated as provided for
 3    on the forms, including a statement of  the  purposes  for  which  anticipated
 4    funds are expected to be expended.
 5        (3)  An  estimate of appropriations needed for the succeeding fiscal year,
 6    showing each primary program or major objective as  a  separate  item  of  the
 7    request  ,      and    itemized  by  object  code .
 8     , as required by the forms provided by the  administrator  of  the
 9    division. 
10        (4)  A report concerning the condition and management of programs, program
11    performance, and progress toward accomplishing program objectives.
12        The  completed  forms  shall,  not  later than the first day of September,
13    except with special permission and agreement of the administrator of the divi-
14    sion of financial management and the  director  of  the  legislative  services
15    office,  be filed in the office of the administrator of the division of finan-
16    cial management  and the legislative services office . The legisla-
17    tive and judicial departments shall, as early as practicable and in any  event
18    no later than the first day of November, prepare and file in the office of the
19    governor    and  the  legislative  services  office  upon the forms
20    described in this section a report of all of the information required in  this
21    section.

22        SECTION  3.  That  Section 67-3505, Idaho Code, be, and the same is hereby
23    amended to read as follows:

24        67-3505.  BUDGET INFORMATION SUBMITTED TO GOVERNOR. The  administrator  of
25    the  division  shall,  on  or before the 20th day of November next succeeding,
26    prepare and submit to the governor,  or   to   the   governor-elect
27    if   there  is  one,   and to the legislature,  information for the
28     development of the executive   budget  as  designated  in  section
29    67-3502,  Idaho  Code,  including the requests of the legislative and judicial
30    departments as submitted by those departments.

31        SECTION 4.  That Section 67-3514, Idaho Code, be, and the same  is  hereby
32    amended to read as follows:

33        67-3514.  APPROPRIATION  BILLS  TO  BE  PREPARED  BY  JOINT  FINANCE-
34    APPROPRIATIONS  COMMITTEE S . The  joint  committees  of  the
35    legislature  in  charge  of  appropriation  measures,  after  considering  the
36    budget  ,  shall  prepare  and introduce appropriation bills covering the
37    requirements of the various  departments,  offices  and  institutions  of  the
38    state;  provided,  that  in  the case of any department, office or institution
39    operating under a continuing appropriation the joint committees of the  legis-
40    lature  in  charge  of  the appropriation measures shall prepare and introduce
41    appropriation bills covering the requirements for the administrative functions
42    of such department, office and/or institution; providing further, that for any
43    department, office, or institution operating in part or in whole under a  con-
44    tinuing appropriation or fund authorized by the legislature, the joint commit-
45    tees  of  the  legislature  having jurisdiction of appropriations shall, after
46    examining the budget, prepare and introduce appropriation bills  covering  all
47    the  requirements  of the respective departments, offices, and institutions of
48    the state operating under each  such  continuing  appropriation    
49    requests  required by section 67-3502, Idaho Code, and the executive budget as
50    required by section 67-3506, Idaho Code, shall prepare and introduce appropri-
51    ation bills covering the requirements of the various departments, offices  and

 1    institutions  of the state.  In the case of any department, office or institu-
 2    tion operating under a continuous appropriation, the joint committee may  pre-
 3    pare  and  introduce  appropriation  bills  covering  the requirements for the
 4    administrative functions of such department, office or institution. The  joint
 5    committee  may, after examining the budget of any department, office or insti-
 6    tution operating in part or in whole under a continuing appropriation or  fund
 7    authorized  by the legislature, prepare and introduce appropriation bills cov-
 8    ering all the requirements of the respective department, office  and  institu-
 9    tion .

10        SECTION  5.  That  Section 67-3613, Idaho Code, be, and the same is hereby
11    repealed.

                     STATEMENT OF PURPOSE

This bill is a statutory cleanup bill designed to clarify
existing practices in the state budget and appropriations
process that have not been updated in several years. The bill
eliminates archaic language, drops redundant or unnecessary
language and clarifies the Legislature's existing role in the
appropriations process.
