H0195|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 195 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE CORRECT REFERENCES AND TO CLARIFY DEPOSIT OF REVE- 4 NUES FROM SPECIAL LICENSE PLATE PROGRAMS; AND AMENDING CHAPTER 4, TITLE 5 49, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-417B, IDAHO CODE, TO 6 ESTABLISH AN IDAHO AGRICULTURE LICENSE PLATE PROGRAM. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds, designed for the purpose of carrying passen- 13 gers and not used for hire shall be: 14 Vehicles one (1) and two (2) years old ............................ $48.00 15 Of the registration fees collected for vehicles one (1) and two (2) years 16 old, $36.48 shall be deposited to the highway distribution account and 17 $11.52 shall be deposited to the restricted highway fund. 18 Vehicles three (3) and four (4) years old ......................... $36.00 19 Of the registration fees collected for vehicles three (3) and four (4) 20 years old, $33.48 shall be deposited to the highway distribution account 21 and $2.52 shall be deposited to the restricted highway fund. 22 Vehicles five (5) and six (6) years old ........................... $36.00 23 Of the registration fees collected for vehicles five (5) and six (6) years 24 old, $26.28 shall be deposited to the highway distribution account and 25 $9.72 shall be deposited to the restricted highway fund. 26 Vehicles seven (7) and eight (8) years old ........................ $24.00 27 Of the registration fees collected for vehicles seven (7) and eight (8) 28 years old, $22.68 shall be deposited to the highway distribution account 29 and $1.32 shall be deposited to the restricted highway fund. 30 Vehicles over eight (8) years old ................................. $24.00 31 Of the registration fees collected for vehicles over eight (8) years old, 32 $16.08 shall be deposited to the highway distribution account and $7.92 33 shall be deposited to the restricted highway fund. 34 There shall be twelve (12) registration periods, starting in January for 35 holders of validation registration stickers numbered 1, and proceeding consec- 36 utively through December for holders of validation registration stickers num- 37 bered 12, each of which shall start on the first day of a calendar month and 38 end on the last day of the twelfth month from the first day of the beginning 39 month. Registration periods shall expire midnight on the last day of the reg- 40 istration period in the year designated by the validation registration 41 sticker. The numeral digit on the validation registration stickers shall, as 42 does the registration card, fix the registration period under the staggered 43 plate system of Idaho for the purpose of reregistration and notice of expira- 2 1 tion. 2 A vehicle that has once been registered for any of the above designated 3 periods shall, upon reregistration, be registered for the period bearing the 4 same number, and the registration card shall show and be the exclusive proof 5 of the expiration date of registration and licensing. Vehicles may be ini- 6 tially registered for less than a twelve (12) month period, or for more than a 7 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 8 tional registration tends to fulfill the purpose of the monthly series regis- 9 tration system. 10 (2) For all motor vehicles equipped to carry passengers and operated pri- 11 marily for hire exclusively within the limits of an incorporated city and 12 adjacent thereto, when the service outside the city is a part of a regular 13 service rendered inside the city, and for school buses operated either by a 14 nonprofit, nonpublic school or operated pursuant to a service contract with a 15 school district for transporting children to or from school or in connection 16 with school approved activities, the annual fee shall be twelve dollars and 17 forty-eight cents ($12.48). 18 (3) For all hearses, ambulances and wreckers the annual fee shall be 19 twenty-nine dollars and forty cents ($29.40), and these vehicles shall bear 20 passenger car plates. No operator of a hearse, ambulance, or wrecker shall be 21 entitled to operate them by virtue of any dealer's license that may have been 22 issued under the provisions of this chapter. 23 (4) For all motorcycles and all-terrain vehicles the annual fee shall be 24 nine dollars ($9.00). For operation of an ATV off the public highways, the fee 25 specified in section 67-7122, Idaho Code, shall also be paid. Registration 26 exemptions provided in section 49-426(2), Idaho Code, apply to all-terrain 27 vehicles and motorcycles used for the purposes described in that subsection 28 (2). 29 (5) For all motor homes the fee shall be as specified in subsection (1) 30 of this section and shall be in addition to the fees provided for in section 31 49-445, Idaho Code. 32 (6) Registration fees shall not be subject to refund. 33 (7) A financial institution or repossession service contracted to a 34 financial institution repossessing vehicles under the terms of a security 35 agreement shall move the vehicle from the place of repossession to the finan- 36 cial institution's place of business on a repossession plate. The repossession 37 plate shall also be used for demonstrating the vehicle to a prospective pur- 38 chaser for a period not to exceed ninety-six (96) hours. The registration fees 39 for repossession plates shall be as required in subsection (1) of this section 40 for a vehicle one (1) and two (2) years old. All other fees required under 41 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 42 The repossession plate shall be issued on an annual basis by the department. 43 (8) In addition to the annual registration fee in this section, there 44 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 45 program fee of fifteen dollars ($15.00) for all special license plate programs 46 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 47 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 48 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 49 program fee of twenty-five dollars ($25.00) but there shall be no annual 50 renewal fee. For special plates issued pursuant to sections 49-417 and 51 49-417A, 49-417B, 49-419 and 49-420, Idaho Code, there shall be 52 an initial program fee of thirty-five dollars ($35.00) and an annual program 53 fee of twenty-five dollars ($25.00). For special plates issued pursuant 54 to section 49-418A, Idaho Code, the initial program fee and the annual renewal 55 fee shall be fifty dollars ($50.00). The fees contained in this subsec- 3 1 tion shall be applicable to all new special plate programs. The initial pro- 2 gram fee and the annual program fee shall be depositedin the state3highway account and shall be used to fund the cost of administration of spe-4cial license plate programs which are provided to the public as a personal5alternative to the standard license plate requirementsas speci- 6 fied by law for each program . 7 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION , to be 9 known and designated as Section 49-417B, Idaho Code, and to read as follows: 10 49-417B. IDAHO AGRICULTURE PLATES. (1) On and after January 1, 2000, any 11 person who is the owner of a vehicle registered under the provisions of sec- 12 tion 49-402 or 49-434(1), Idaho Code, may apply for Idaho agriculture plates. 13 The provisions of this section shall not apply to any vehicle with a regis- 14 tered maximum gross weight over sixteen thousand (16,000) pounds. Availability 15 of Idaho agriculture plates for other vehicles may be authorized by rule of 16 the board. 17 (2) In addition to the regular operating fee, the applicant shall be 18 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 19 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 20 tion. Twenty-five dollars ($25.00) of the initial fee and fifteen dollars 21 ($15.00) of the renewal fee shall be deposited in the state highway account 22 and shall be used to fund the cost of the administration of this special 23 license plate program. Ten dollars ($10.00) of each initial fee and ten dol- 24 lars ($10.00) of each renewal fee shall be transferred by the state treasurer 25 to the ag in the classroom account created by the provisions of section 26 57-815, Idaho Code. 27 (3) Whenever title or interest in a vehicle registered under the provi- 28 sions of this section is transferred or assigned, the owner may transfer the 29 special plates to another vehicle upon payment of the required transfer fees. 30 The owner may only display the plates after receipt of new registration from 31 the department. 32 (4) The Idaho agriculture license plate shall be of a color and design in 33 accordance with the provisions of section 49-402C, Idaho Code. That portion of 34 the design which features Idaho agriculture shall be acceptable to the Food 35 Producers of Idaho, Inc. and shall be approved by the department utilizing a 36 numbering system as determined by the department. Initial costs of the plate 37 program, including the cost of plate design, shall be paid from the ag in the 38 classroom account. 39 (5) Sample Idaho agriculture plates may be purchased from the department 40 for a fee of thirty dollars ($30.00), twelve dollars ($12.00) of which shall 41 be deposited in the state highway account and eighteen dollars ($18.00) of 42 which shall be transferred to the ag in the classroom account.
STATEMENT OF PURPOSE RS 08909 This legislation authorizes the Idaho Department of Transportation to issue an Idaho Agriculture specialty license plate. The cost of the plate will be $35.00 for the initial issuance, and $25.00 for each annual registration thereafter. These fees are in addition to the regular registration. When issued, $25.00 of the intial fee and $15.00 of the annual renewal fees will be deposited in the state highway account to administer the program. The balance, or $10.00, will be transferred by the State Treasurer to the Idaho Ag in the Classroom Account created by the provisions of Section 57-8l5, Idaho Code. FISCAL NOTE The design of the plate, together with the initial cost of the program, is to be borne by the Idaho Ag in the Classroom Account.
