H0198|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 198 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO THE CANCER REGISTRY; AMENDING SECTION 57-1703, IDAHO CODE, TO FUR- 3 THER DEFINE CANCER TO EXCLUDE IN SITU NEOPLASMS OF THE CERVIX. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 57-1703, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 57-1703. CANCER REGISTRY -- DEFINITIONS. (1) "Cancer" means all in situ 8 or malignant neoplasms diagnosed by histology, radiology, laboratory testing, 9 clinical observation, autopsy or suggestible by cytology, but excluding basal 10 cell and squamous cell carcinoma of the skin unless occurring on a mucous mem- 11 brane and excluding in situ neoplasms of the cervix . 12 (2) "Reportable benign tumors" means noncancerous neoplasms occurring in 13 the brain, meninges, pineal gland or pituitary gland. 14 (3) "Confidential information" refers to information which may identify a 15 cancer patient, health care facility or health care provider. 16 (4) "Contractor" means that individual, partnership, corporation or other 17 entity performing cancer registry services under a contractual agreement with 18 the department. 19 (5) "Department" means the Idaho department of health and welfare. 20 (6) "Population-based" refers to all cancers and reportable benign tumors 21 diagnosed and/or treated within the state of Idaho by hospitals or other 22 facilities providing screening, diagnostic or therapeutic services to patients 23 with respect to cancer, and from physicians, surgeons, and all other health 24 care providers diagnosing or providing treatment for cancer patients.
REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS08805 This legislation would discontinue the reporting and routine collection of cervix in situ (noninvasive) cases. National standard setting bodies cite long-standing problems of data comparability in pre-invasive cancer of the cervix; these problems will worsen over time as analysis systems evolve. Solutions require either dropping the collection of these data, as this legislation would do, or expanding the collection of data to include all high grade lesions and their equivalents, resulting in significant increases in data collection cost. The fact that some high grade lesions are not encompassed in the definition of cancer also raises concern as to the legality of access to records in these cases. The collection of data on all invasive cervical cancers will not be disrupted. In addition, the collection of data on in situ lesions of other anatomical sites also will continue. FISCAL IMPACT None.
